HUBSubcontractingPlan(HSP)
InaccordancewithTexasGov’tCode§2161.252,thecontractingagencyhasdeterminedthatsubcontractingopportunitiesareprobableunderthiscontract.Therefore,allrespondents,includingStateofTexascertifiedHistoricallyUnderutilizedBusinesses(HUBs)mustcompleteandsubmitthisStateofTexasHUBSubcontractingPlan(HSP)withtheirresponsetothebidrequisition(solicitation).
NOTE:ResponsesthatdonotincludeacompletedHSPshallberejectedpursuanttoTexasGov’tCode§2161.252(b).
TheHUBProgrampromotesequalbusinessopportunitiesforeconomicallydisadvantagedpersonstocontractwiththeStateofTexasinaccordancewiththegoalsspecifiedinthe2009StateofTexasDisparityStudy.ThestatewideHUBgoalsdefinedin34TexasAdministrativeCode(TAC)§20.13are:
•11.2percentforheavyconstructionotherthanbuildingcontracts,
•21.1percentforallbuildingconstruction,includinggeneralcontractorsandoperativebuilders’contracts,
•32.9percentforallspecialtradeconstructioncontracts,
•23.7percentforprofessionalservicescontracts,
•26.0percentforallotherservicescontracts,and
•21.1percentforcommoditiescontracts.

In accordance with 34TAC§20.14(d)(1)(D)(iii), a respondent (primecontractor)maydemonstrategood faitheffort toutilize Texas certifiedHUBs for itssubcontractingopportunitiesifthetotalvalueoftherespondent’ssubcontractswithTexascertifiedHUBsmeetsorexceedsthestatewideHUBgoalortheagencyspecificHUBgoal,whicheverishigher.Whenarespondentusesthismethodtodemonstrategoodfaitheffort,therespondentmustidentifytheHUBswithwhichitwillsubcontract.IfusingexistingcontractswithTexascertifiedHUBstosatisfythisrequirement,onlycontractsthathavebeeninplaceforfiveyearsorlessshallqualify for meeting the HUB goal.
