Theactivities,controlsandassessmentcriteriaintheunderlyingRuralProductionzoneandAuckland­widerulesapplyinthefollowingprecinctunlessotherwisespecifiedbelow.Refertoplanningmapsforthelocationandextentoftheprecinct.

2.1 Building height

1.Buildingsonthenewlycreatedsitesmustnotexceed9minheight.

4.Anysubdivisionwhichdoesnotmeettheserequirementsisanon­complyingactivity.

3.1Restricteddiscretionaryactivities

1.SubdivisionandassociateddevelopmentofserviceswithintheRiverhead3precinctthatmeetsallthecontrolsbelowwillbeassessedasarestricteddiscretionaryactivity.

3.1.1Numberofsites

1.Subdivisionofthetotallandareawithintheprecinctislimitedto20sites.

3.1.2Vegetationclearance andprotection

1.Removalofnativebushmustnotexceed650m²oneachproposedsite.

2.SubdivisionandassociateddevelopmentofservicesmustbeconsistentwithPrecinctplan1:Ecological sensitivity.

3.Nativebushwithintheareamarked''NilCarryingCapacity­C''onPrecinctplan1:EcologicalsensitivitymustonlyberemovedtotheminimumamountnecessarytoupgradeexistingtracksorroadswithinareaC(ortoextendthosetracksorroadstoreachareaAorBiftheydonotalreadydoso)inordertoprovideaccesstoanysite.

3.1.3Minimumsite size

1.Theminimumsitesizeis1hectare.

2.Thosepartsofasitewhicharetobeprotectedbycovenantaretobeincludedinthesitesizecalculation.

3.2Discretionaryactivities

SubdivisionandassociateddevelopmentofserviceswithintheRiverhead3precinctthatdoesnotmeetthecontrolsin3.1.1and3.13,butmeetsthecontrolsin2.1.1and2.2.1andtheadditionalcontrolsbelowwillbeassessedasadiscretionaryactivity.

3.2.1Numberofsites

1.Subdivisionoftotallandareawithintheprecinctislimitedto30sites.

3.2.2Locationofsignificantecologicalareaaornativebush,andspecifiedbuildingarea

1.TheSEAornativebushmustbeentirelywithinanindividualparentsite.

2.IftheSEAornativebushiswithinanewsite:

a.anylandtobeusedforbuildingandaccessmustnotcompromiseanynativevegetation

b.ifthereislessthan1500m²availableforbuildingoraccessthatisnotcoveredinnativetreesthemaximumcombinedsizeofthespecifiedbuildingareaandanyaccesswaysis1500m².

3.2.3Minimumsite size

1.Theminimumsitesizeis0.6hectares.

2.Thosepartsofasitewhicharetobeprotectedbycovenantaretobeincludedinthesitesizecalculation.

3.Theminimumruralresidentialsitesizeis1hectarewheretheprotectednativebushorSEAsitswithinthebalancesite.

4.Theminimumruralresidentialsitesizeis2.2hectares(2hectaresprotectedareaand2000m²specifiedbuildingareaandaccessway)wheretheprotectednativebushorSEAistobecontainedwithinthenewruralresidentialsite.

5.Theminimumbalancesitesizeis1hectareandanysmallerareaistobeincludedwithinthenewsite.

3.2.4Maximumsitesize

1.Themaximumruralresidentialsitesizeis2hectareswheretheprotectednativebushorSEAremainsontheparentsite.

2.TheprotectednativebushorSEAdoesnotremainontheparentsite,themaximumruralresidentialsitesizeistheprotectedareaplusthespecifiedbuildingarea.

3.2.5Accessandfrontage

1.Eachsitemusthaveaminimumroadfrontageof6m.Uptofivesitesmaygainfrontageoverajointly

ownedaccesssite,orrightofwayatleast6mwide.

Assessmentcriteria

Thecouncilwillconsider therelevantassessmentcriteriainclause4.1oftheAucklandwide­subdivisionrulesandtherelevantassessmentcriteriabelowfortherestricteddiscretionaryactivitieslistedabove.

1.Sitesuitabilityanddesign

a.whetherthesiteisunusualintermsofshape,orsize,topography,landstability,orsusceptibilitytootherhazards,andthedegreetowhichthesemattersnecessitateanonstandardfrontageoraccessshouldbeconsidered.

b.theeffectoftheproposedfrontageandaccessesontheruralcharacterinthevicinityofthesiteshouldbeconsidered.

c.buildingplatformsshouldbeappropriatelylocated,withregardtotheinformationprovidedfromthedetailedsitesurveyandsiteinvestigation,includinganygeotechnicalsurveys.

d.theproposalshouldmitigatepotentialvisualimpact,includingimpactonotherbuildingsitesandonviewsfrompublicroads.

e.heightandexternalappearanceofstructurestobebuiltonthenewlycreatedsiteshouldbecontrolled.

d.theproposedsubdivisionlayoutshouldbeconsistentwiththerequirementthatnonativebushshouldberemovedfromwithintheareamarked''NilCarryingCapacity­C''onPrecinctplan1:Ecologicalsensitivity,excepttotheminimumamountnecessarytoupgradeexistingtracksorroadswithinareaC(ortoextendthosetracksorroadstoreachareaAorBiftheydonotalreadydoso)inordertoprovideaccesstoanysite.

a.theproposedaccessshouldprovidesafeandadequateaccesstotheproposedsites,andtheproposedstandardofvehicleaccessconstructionanddesign.

b.theaccesstotheproposedsitesshouldbeadequate,safeandshouldmitigatepotentialadverseeffectsontheenvironment.

c.accesstotheproposedsites,includingreinstatementofthebridgeatthebottomofCobblersLaneifsuchisproposed,oralternativeroadaccess,shouldbeformedtothecouncil'srequiredstandards.

8.Riparianmarginsandaquaticfaunahabitats

a.theproposalshouldenhanceriparianmarginsandaquaticfaunahabitatswhereaccessconsiderationsmakesuchpracticable.Ingrantinganysubdivisionconsent,thecouncilwillnotimposerequirementsfortherestorationandenhancementofriparianmarginsonanylandtovestinthecouncilasesplanadereservealongthenorthernbankoftheRangitopuniStream.

5.Specialinformationrequirements

Schemeplan

1.Anapplicationforrestricteddiscretionaryordiscretionarysubdivisionactivitymustbeaccompaniedbyaschemeplan.

2.Aschemeplanmustbepreparedaftercarryingoutadetailedsitesurvey,toprovideaframeworkforanysubdivisionapplication.Theschemeplanmustidentify:

a.theboundariesofallproposedsites.

b.thatnoremovalofnativebushwilloccurwithintheareamarked''NilCarryingCapacity­C''onPrecinctPlan1­EcologicalsensitivityexcepttotheminimumamountnecessarytoupgradeexistingtracksorroadswithinareaC(ortoextendthosetracksorroadstoreachareaAorBiftheydonotalreadydoso)inordertoprovideaccesstoanysite.

c.thelayoutofaccesstoeachproposedsitetobeformedtothecouncil'srequiredstandards,whichmightincludereinstatementofabridgeatthebottomofCobblersLane,oralternativeroad
