4.Onorabout March25,2011,theDepartmentofPublicHealth,DivisionofHealthCareQuality("DPH")completedacomplaintinvestigationsurveyatMasconometbasedonallegationsofabuseoffacilityresidents(DPHreference#11-0183and#11-0304).

5.OnoraboutMarch25,2011,DPHgeneratedaStatementofDeficienciesasaresultofthecomplaintinvestigationsurveywhichcontainedfindingsofsubstandardqualityofcareatMa.sconomet,includingbutnotlimitedto,thefollowing: '

allegationsofabusebyfourCNAsinvolvingsevenof41sampledresidents,
occurring betweenapproximately-November2010andFebruary2011werereported to theAdministratorortothe Department when at least seven facility..

theAdministratorwasnotifiedofsuchabuse.

c.Withrespectto'Paragraph5(c),above,Masconomet'sfailedtoensure thatfourof41sampledresidentsweretreatedbystaffinadignifiedmannerwhenmultiplestaffmemberswitnessedthreeCNAsusingprofanelanguage,textingoncellularphones,andplayinginappropriatemusicwhileprov1dingpersonalcare,talkingabouttheirsexuallivesandallegeddruguseinthepresenceofresidents,mockingmentallyill residents andtauntingresidentstoavoidprovidingneededcare.

7.WhileyouwereMasconomet'sAdministrator, youfailedtoensurethataneffective system.wasdevelopedandimplementedtoensurethatallegationsofabusewereimmediatelyreportedandinvestigated,andthatresidentswereprotectedwhileaninvestigation wasin.progress.

8.Yourconductasallegedwarrants disciplinaryactionbytheBoardagainstyourlicensetopracticeasaNursingHomeAdministratorpursuantto245CJ\-1R2.15(1)forfailingtoexerciseproperregardforthehealth,safetyandwelfareof yourpatients.

9.YourconductasallegedwarrantsdisciplinaryactionbytheBoardagainstyourlicensetopracticeasaNursing HomeAdministratorpursuantto245CMR2.15(4)forviolationoflocal;stateorfederalstatutesorregulationsrelatedtonursinghomeadministration.
