RelatingtoSupplementalMandatoryReportingRequirementsofChildAbuseandNeglect

WHEREAS,wemustalwaysbevigilantinprotectingourchildrenandcreatingasafeenvironmentforthem;and

WHEREAS,thehealth,safety,andbestinterestsofourchildren areofchiefconcern,anditisappropriateandnecessarythattheStatedoeverythingwithinitsmeanstoensurethatsuspectedcasesofabuseandneglectofourchildrenarereportedtotheproperauthorities;and

WHEREAS,pursuanttoWis.Stat.§48.981(2)(a),certainpersonscurrentlyarerequiredtoreportincidentsofchildabuseorneglect,includinghealthpractitioners,socialworkers,lawenforcementofficers,childcareproviders,counselors,schoolteachers,andschoolstaffmembers;and

WHEREAS,currentmandatoryreportinglawsdonotrequiremostcollegeoruniversityprofessors,administrators,coaches,orothercollegeoruniversitystaffmemberstoreportcasesofchildabuseorneglect;

NOWTHEREFORE,I,SCOTTWALKER,GovernoroftheStateofWisconsin,bytheauthorityvestedinmebytheConstitutionandlawsofthisState,doherebyorderanddirectasfollows:

1.AllUniversityofWisconsinSystem(UWS)professors,administrators,coaches,andotherUWSemployeesshallreportchildabuseorneglectimmediatelyiftheemployee,inthecourseofemployment,observesanincidentorthreatofchildabuseorneglect,orlearnsofanincidentorthreatofchildabuseorneglect,andtheemployeehasreasonablecausetobelievethatchildabuseorneglecthasoccurredorwilloccur.

2.Areportshallbemade,personally orbytelephone, tooneofthefollowing:

a.thecountydepartmentof socialservicesorthecountydepartmentofhumanservices,pursuanttoWis.Stat.§48.02(2g);

b.inacountyhavingapopulationof500,000ormore,thecountydepartmentofsocialservices,thecountydepartmentofhumanservices,oralicensedchildwelfareagencyundercontractwiththecountydepartmentofsocialservicesorthecountydepartmentofhumanservices;or

c.thesherifforthecity,village,town,oruniversitypolicedepartment.

3.“Child”shallbedefinedasinWis.Stat.§48.02(2),“abuse”and“neglect”shallbedefinedasinWis.Stats.§48.02(1)and(12g),and“report”referstoareportunderWis.Stat.§48.981(3)(a)(1).

4.AUWSemployeewhoisamandatoryreporterunderWis.Stat.§48.981(2)(a)shallcomplywiththerequirementsofthestatemandatoryreporterlawandshallnotbesubjecttothisOrder.

5.NoUWSemployeemakingareportunderthisOrderingoodfaithmaybedischargedfromemployment,disciplinedorotherwisediscriminatedagainst inregardtoemployment,orthreatenedwithanysuchtreatment,forsodoing.

6.ThisOrdershallcontinue ineffectuntilamended,modified,terminated,orrescindedbytheGovernor,orduplicated,superseded,orterminatedbyoperationoflaw.
