If you have been the victim of a rape or sexual abuse:
- Remain calm, find a safe place, and get help from someone you trust.
- Do not change clothes, shower, use the restroom, or destroy any clothing. A rape or sexual abuse survivor should try to remain in the same condition as when the attacker left.
- Seek medical attention. Public Safety, Health Services, or others on the Student Affairs staff can assist you in getting medical attention.
- After the incident, you may suffer from acute emotional stress. The College has various support services and off-campus resources that can assist and support you. They are listed on the back of this handout.
- You have the right to make a report to Public Safety, local law enforcement, or choose not to report the incident.
- You have the right to report the incident to your institution, to be protected by the institution from retaliation for reporting an incident, and to receive assistance and resources from your institution.
Regarding Consent
Affirmative consent is a knowing, voluntary, and mutual decision among all participants to engage in sexual activity. Consent can be given by words or actions, as long as those words or actions create clear permission regarding willingness to engage in the sexual activity. Silence or lack of resistance, in and of itself, does not demonstrate consent. The definition of consent does not vary based upon a participant’s sex, sexual orientation, gender identity, or gender expression.
- Consent is required regardless of whether the person initiating the act is under the influence of drugs and/or alcohol.
- Consent may be initially given but withdrawn at any time.
Regarding Drugs and Alcohol
The health and safety of every student at Molloy is of utmost importance. Molloy recognizes that students who have been drinking and/or using drugs at the time that violence, including but not limited to domestic violence, dating violence, stalking, or sexual assault occurs may be hesitant to report such incidents due to fear of potential consequences for their own conduct. Molloy strongly encourages students to report domestic violence, dating violence, stalking, or sexual assault to institution officials. A victim and/or bystander acting in good faith or a reporting individual acting in good faith that discloses any incident of domestic violence, dating violence, stalking, or sexual assault to Molloy College’s officials or law enforcement will not be subject to Molloy’s code of conduct action for violations of drug and/or alcohol use policies occurring at or near the time of the commission of the domestic violence, dating violence, stalking, or sexual assault.
If you are not comfortable with what someone is doing or saying:
- Trust your instincts (you’re probably right)!
- Ask the person to stop doing the thing that is offensive.
- Leave the person and location, find a safe place, and call for help.
Quick Tips for Being an Active Bystander:
- If you see something wrong, say something.
- Help a person, friend or classmate to not make a bad decision.
- Try to find some safe way to do something, to change what’s happening, or intervene.
- Don’t leave a friend or classmate alone at a party or bar.
Reporting Sexual Misconduct at Molloy
Please report the following types of incidents: sexual violence, rape, sex abuse, forcible touching, sexual harassment, other sexual misconduct (exploitation, etc.), domestic and dating violence, stalking, sex and gender discrimination and retaliation for reporting such instances.Molloy College offices and employees who cannot guarantee confidentiality will maintain your privacy to the greatest extent possible. This information you provide to a non-confidential resource will be relayed only as necessary for the Title IX Coordinator to investigate and/or seek a resolution.
