PURPOSE
Provide the grievance process available to employees in Career Service (CS) positions.
SCOPE
This policy is applicable to all career service employees of the Department of Management Services (DMS/department) who have satisfactorily completed at least a one-year probationary period in their current position.

POLICY
A grievance process is available to career service employees who have satisfactorily completed at least a one-year probationary period in their current position. A grievance is defined as the dissatisfaction that occurs when an employee believes that any condition affecting the employee is unjust, inequitable, or a hindrance to effective operation. Claims of discrimination and sexual harassment or claims related to suspensions, reductions in pay, demotions, and dismissals are not subject to the CS grievance process.
PROCEDURES
The following procedures apply to a grievance filed pursuant to this subsection, except that all timeframes may be extended in writing by agreementof the employee and agency designee:
(a)Step One.--The employee submit a signed, written grievance on the “Career Service Grievance Form” (HR-123-F1) to his/her supervisor within fourteencalendar days following the occurrence of the event giving rise to the grievance. The supervisor must meet with the employee to discuss the grievance and provide a written response to the employee within seven business days following receipt of the grievance.
(b)Step Two.--If the employee is dissatisfied with the response of his/her supervisor, the employee may submit the written grievance to the agency head (or designee) within seven business days following receipt of the supervisor's written response. The agency head (or designee) must meet with the employee to discuss the grievance within five business days following receipt of the grievance. The agency head (or designee) must respond in writing to the employee within fivebusiness days following the meeting. The written decision of the agency head will be the final authority for all grievances filed pursuant to this subsection. Such grievances may not be appealed beyond Step Two.
