Minutes of 172nd Meeting of Northern Regional Committee held on November 12-13, 2010

The 172nd meeting of the Northern Regional Committee (NRC), National Council for Teacher Education (NCTE) was held on November 12-13, 2010 at Conference hall, NRC, NCTE, Jaipur.

In pursuance of the Gazette Notification No.213 dated 25.08.2010, NRC has been terminated under Section 21(2)(a) of NCTE Act, 1993 and the powers and duties on behalf of the Northern Regional Committee are being exercised and performed under Section 21(2)(b) by Shri Hasib Ahmad, former Member Secretary, NCTE.

The following member and convenor were present:

Agenda Item No.172.01: CONFIRMATION OF THE MINUTES OF 171st MEETING

i)  The name of the Course in the decision of Shri P.L. Memorial Degree College (file No.UP- 2672 at page No. 13 be read as B.T.C. in place of B.Ed. and annual intake be read as 50 seats in place of 100 seats.
ii)  The number of seats in the decision of Rakshpal Bahadur Teachers Tranining Institute, Bareilly, U.P. ( File No. UP-3051) at page No.14 be read as “annual intake of 100 additional seats” in place of “annual intake of 100 seats”

Agenda Item No.172.02 : CONSIDERATION OF COURT CASES

1.  / HP-205 / Vijay Memorial College of Education, (Wisdom Education Society) Village & Post – Bhangrotu, Near Chowk, Distt. – Mandi (Himachal Pradesh) / J.B.T. / In view of the orders dated 07/07/2010 passed by the Hon’ble High Court of H.P. at Shimla , the CLU dated 06.05.2009 issued by the Sub Divisional Magistrate be accepted provisionally subject to submission of proper CLU, as per state Govt. rules at the time of inspection and case be processed further . VT is constituted for the purpose.
2.  / UP-1889 / C-Impact Institute, 20 K.M. Stone, Behind Gokulam Water Park, NH-2, Agra, U.P. / Additional intake in B.T.C. course / In view of the order dated 5/5/2010 passed by the Hon’ble High Court of Allahabad in Writ C. No. 24648 of 2010 filed by the institution, the case was carefully considered by NRC and the following was observed:
The institute was recognized on 5th August, 2004 for B.T.C. course with an intake capacity of 50 seats . The recognition, however was not made operative due to the policy of the State Govt. and therefore, the recognition could not get completed by way of proper affiliation by the State Examining Body. The institute after prolonged litigation could get affiliation for its course only in March 2010. It is not known whether, the institute has even admitted the students of its first batch, as only after three years of functioning it is entitled for additional intake as per Clause 8 (IV) of NCTE Regulation, 2002. Since the institution made an application in 2004 itself, without running the course for one year it was not entitled for additional intake even at that point of time in 2004. As per regulation 2009, currently in operation, the institution will be entitled for additional intake after completion of 3 academic sessions. The institution was therefore not entitled for additional intake at that point of time as per the NCTE, Regulations, 2002 and institution is also not entitled even at present as per current NCTE, Regulation, 2009
Hence, the Show Cause Notice under section 15 (3) (b) of NCTE act, 1993 be issued to the institution before refusing the recognition on the above grounds
3.  / UP-1463 / Shanti Niketan College of Business Management & Computer Science, NH-3, Agra Gwalior Road, Tehra, Agra, U.P. / B.T.C. / In view of the order dated 23/09/2010 passed by the Hon’ble High Court of Allahabad, the reply dated 30/07/2010 submitted by the institution after the decision of appellate body granting it 3 months time to appoint faculty was carefully considered by NRC and the following observed:
The Principal appointed by the institution does not possess the required experience of teaching in Elementary Teacher Training institution for a period of 5 years. Smt. Sarika Uppadhaya appointed as Principal / HOD does not have the experience of teaching in accordance with Clause 6 of Appendix 9 of NCTE Regulation 2009.
Hence, the Show Cause Notice under section 15 (3) (b) of NCTE act, 1993 be issued to the institution before refusing the recognition on the above grounds
4 / HR-1739 / Mahendra College Of Education, Majra Road, Vill- Majra Khurd, Post- Mahender Garh, Tehsil/District- Mahender Garh, Haryana. / B.ED. / Noted. Order of the Hon’ble Court be implemented.
5 / HR-1597 / Mahendra College Of Education, Majra Road, Vill- Majra Khurd, Post- Mahender Garh, Tehsil/District- Mahender Garh, Haryana. / D.ED. / The Order dated 10.09.2010 passed by the Hon’ble High Court of New Delhi in the Writ Petition NO. 5890/2009 has been considered and the Committee decides that the decision of the Appeal Committee may be awaited. A copy of the Judgment of the Hon’ble Court be sent to the Appellate Authority.
6 / RJ-1612 / Jai Marudhar Kesari B.Ed. College, Vpo-Merta City, Tehsil-Merta City, District-Nagaur, Rajasthan / B.ED. / The matter is sub-judice. The NRC’s Counsel should expedite the matter.

HR-944 / R.K.S.D. College Of Education, Kaithal, Ambala Road- 136027 Haryana / B.ED.
B.ED. ADD. / The order of the Hon’ble Court Civil Judge, Kaithal dated 05.10.2010 directs the Petitioner to represent before respondent no. 2 (NCTE Hqrs) and therefore the matter alongwith the original files and inspection report of the Commissioner appointed by the Hon’ble Civil Court be sent to NCTE Hqrs. for placing the matter before the Appellate Authority. The entire case is against the Appellate Order dated 13.08.2010 and therefore needs to be complied by the Appellate Authority. Moreover, since the matter is sub-judice in the Hon’ble Court of Punjab at Chandigarh and Final order of the Hon’ble Court has been passed and its certified copy is awaited, a copy of the orders be obtained by RD, NRC on priority and sent to Appellate Authority.

Agenda Item No.172.03 : CONSIDERATION OF APPEAL ORDERS

1.  / UP-2649 / Saraswati Higher Education & Technical College, Vill. – Gahni, Post – Ayar, Distt. – Varansai, Uttar Pradesh / B.Ed. additional intake / As per orders of the Appellate Authority the reply of the institution dated 23.08.2009, on various points raised in the Show Cause Notice has been carefully considered and the following observations are made:
i)  The VT categorically mentioned that the institution is not having proper language learning facilities. The institution in its reply has claimed that it has got all the facilities of learning lab, as per NCTE Norms, but has not submitted any documents whatsoever to substantiate its claim.
ii)  The claim of the institution that it has 27 computers has been supported by an invoice for 27 computers but no proof of actual payments /purchase or entry in stock register has been given. The VT has categorically observed that it has only 07 computers. Moreover, the language lab needs to have many more equipments as per recommendation of NCTE contained in its Manual for the Teacher Education Institutions and Teacher Educators. No indication about availability of equipments in language learning lab has been given by the institution
iii)  The observation that all labs are ill equipped has been refuted without any proof whatsoever to substantiate the claim that they are well equipped . No document, photographs etc. has been submitted to establish the claim.
Hence, the Show Cause Notice under section 15 (3) (b) of NCTE act, 1993 be issued to the institution before refusing the recognition on the above grounds

Agenda Item No.174.04 : CONSIDERATION OF THE REPLIES RECEIVED FOR CONVERSION FROM 7(9)

Whereas the institution has submitted the name of lecturer approved by the Examining Body it has not given the details of qualification and experience possessed by the teachers appointed by the institution.
Hence, the Show Cause Notice under section 15 (3) (b) of NCTE act, 1993 be issued to the institution before refusing the recognition on the above grounds
2.  / UP-1396 / Akbarpur Degree College, Akbarpur, Kanpur Dehat, Uttar Pradesh / B.T.C. / The reply of the Institution received on 18.10.2010 w.r.t. Letter of intent prior to recognition U/s 7(9) of the NCTE Regulations, 2009 has been considered and following observed:
i)  The institution has not submitted approval of the Affiliating / Examining Body for the selection/ appointment of the faculty made by them.
ii)  Experience Certificate of the Principal establishing 5 years experience in E.T.T. has not been submitted.
Hence, the Show Cause Notice under section 15 (3) (b) of NCTE act, 1993 be issued to the institution before refusing the recognition on the above grounds
3.  / HR-1645 / Shanti College Of Education, Vill- Rewasa, Tehsil- Mohindergarh, Distt- Mohindergarh-12309, Haryana / B.ED. / The reply of the institution dated 21.10.2010 has been considered and found satisfactory.
Hence, recognition order under section 7(11) of NCTE Regulations 2009 and 14(3)(a) of NCTE Act 1993 for B.Ed. course with an annual intake of 100 seats from the academic session 2010-2011 be issued subject to the following conditions:-
·  The admission of the students shall be made only after affiliation by the examining body before the commencement of the academic session and the admission of students shall be completed well before the cut-off date prescribed by the examining body for the academic session 2010-2011 failing which the recognition will be effective from the academic session 2011-2012.
Formal recognition / permission will operate for 2010-2011 only if the requirement of 180 teaching days in the session is fulfilled as per calendar of the University/affiliating body failing which the recognition will be effective from the academic session 2011-2012.
4.  / HR-1816 / Sohan Lal Dav College Of Education, Plot No. 307 To 313, Near Jagadhari Gate, Vpo- Ambala City, Distt- Ambala, Haryana / M.ED. ADD. INTAKE / The reply of the institution dated 21.10.2010 has been considered and the following observations are made:-
·  The faculty appointed by the institution for M. Ed. Course is not in accordance with the NCTE Norms as per clause 4 of Appendix-5 of NCTE Regulations 2009 in view of the following:-
i). Instead of five additional faculty members, the institution has appointed only four faculty members.
ii). The institution has not appointed one Professor.
·  The Institution has not obtained the approval of the Affiliating University for the four faculty members selected by it.
·  The institution may also be asked to submit the details of existing faculty of its various other Courses in education i.e. B. Ed. and M.Ed. , as the same is not available on the website of the institution.
Hence, the NRC decides that the institution be directed to clarify the position on the above points and reply within 30 days.

HR-917 / Aastha College Of Education For Women, Vpo- Damla, Tehsil- Jagadhari, Distt- Yamuna Nagar, Haryana / D.ED. ADD.
B. ED. / The reply of the Show Cause Notice has been considered and found satisfactory as the institution has constructed a new Building for which application for approval of shifting has been sought.
Hence, NRC constitutes a VT for inspection of the new premises for all the Courses being run by the institution.
6.  / HR-998 / Yaduvanshi College Of Education, V&Po-Patikara, Tehsil-Normeel, Distt-Mohindergarh, Haryana / B.ED. / The reply of the institution dated 01.11.2010 has been considered and found satisfactory.
Hence, recognition order under section 7(11) of NCTE Regulations 2009 and 14(3)(a) of NCTE Act 1993 for B.Ed. course with an annual intake of 100 seats from the academic session 2010-2011 be issued subject to the following conditions:-
·  The admission of the students shall be made only after affiliation by the examining body before the commencement of the academic session and the admission of students shall be completed well before the cut-off date prescribed by the examining body for the academic session 2010-2011 failing which the recognition will be effective from the academic session 2011-2012.
·  Formal recognition / permission will operate for 2010-2011 only if the requirement of 180 teaching days in the session is fulfilled as per calendar of the University/affiliating body failing which the recognition will be effective from the academic session 2011-2012.
