PublicReview:

TheDARin particularseeks theverification ofsensitivearealocationsreported intheYOP.TheDPW itselfhasalimitedabilityto surveythegeography, land use,and thewatersupplies through whichthe rightsofwayarelocated.However, otherCityDepartmentsmayhavemostofthis information readily available,andtheparticularknowledge to bettercertifythesensitiveareasinthiscommunity. Therefore, theDPWrequestsand urges theassistanceof theConservation Commissionand theBoard ofHealthin reviewingthecompletenessand accuracyofthemapscontainedinthesubmitted documents.TheDAR hasestablished the followingproceduresforthisreview.

TheVMP, YOP, andacopyof thisnoticewillbesentbytheapplicant (HopkintonDPW)to the Conservation Commission,Board ofHealth(orotherdesignated health agent), andto thehead of government (CityMayor)of thecommunitywhereherbicidesare tobeapplied alongtherightsofway duringthecalendaryear2014. Municipalagenciesand officialswillhave forty-five (45)daysfollowing receiptoftheplansto reviewmapscontainedin thedocuments thatindicatethelocation of“sensitive areasnotreadilyidentifiable inthefield” forinaccuraciesand omissions.“SensitiveAreas”aredefined in Section 11.02 (a-f)of theRightsofWayManagementRegulations.

Municipalagenciesandofficialsarerequested toforwardtheVMPand YOP to theappropriateofficials in theirmunicipalityqualified tocertifytheaccuracy ofsensitivearealocationsasindicated on themaps. Themapsshould be“corrected”andreturnedto theapplicant. Also, acopyof themapswith these correctionsindicated should besenttotheDARtotheaddresslisted below, within theforty-fiveday reviewperiod. IfaCityorTown needsmoretime to carryoutthisreview, itshould send awritten requestforan extension to theDARand statewhythere isa“good cause”forrequestingadditional time.

Allcorrectionsarerequiredto bemadebytheapplicant, andcorrectedmapssentbackto the Town beforetheYOP canbeconsidered“approved”bytheDARforvegetationmaintenancein that municipality. Anydisputeon thepartof theapplicantregardingcorrectionsmadeby municipal authoritiesshould beindicatedin writingto theDARand theTown whichrequested thedisputed changes, within fifteen(15)daysofreceiptoftherequest.TheDAR willdecidewhetherornot theYOP

should beapproved withouttherequested changes.TheDAR willconsiderthe“finalapproval”ofaYOP

individuallyforeach municipality.

The final twentyone(21)daysof thepublic reviewperiod can serveconcurrentlyto providepublic notificationasrequired bySection 11.07 of theRightsofWayManagementRegulations, if theapplicant hasanapproved VMP, andifallthe requisiteCityorTown officeswhich havereceived copiesofthe YOP havecompletedtheirreviewandcorrectionshavebeendulymadebytheapplicantandapproved by theDAR.

FailurebytheCityorTown to respond to theapplicant’ssubmission of theYOP within theforty-five (45)daypublicreviewperiod willbeconsideredbytheDARto indicateagreementbythemunicipal officialswith thesensitiveareademarcationsasprovided bytheapplicantintheirYOP.

VII. Procedures and Locations forHandling, Mixing and Loading ofHerbicide

Concentrates:

Allmixingandloadingofherbicideswillbeconductedatthecentralfacilitywhere the herbicidesarestored (referto appendix E).Onlythe amountofherbicidenecessaryas determined bymonitoringresultswillbemixedto carryout thevegetationcontrol. The vehiclecarryingoutthesprayoperation willbeequipped with aspillkit, includingabagof absorbent, activated charcoal,leak-proofcontainerabroomand ashovel. Herbicide labels,factsheetsand/ormaterialsafetydatasheetsshould becarried on-sitebythe applicator.

Assoon asanyspillisobserved, immediateactionbytheapplicatorwillbetaken to contain thespilland protecttheenvironment.Thecauseofthespillmustbe identifiedandsecured. Spillcontainmentwillbeaccomplished bycoveringthespill with anabsorbentmaterialor, forlargespills, buildingclayorsoildikesto impedespillprogress. Untilcompletely cleaned,thegeneralpublicwillbeprotected againstaccidentalexposurebyplacing

barriers, postingsignsorflagmen atstrategiclocations. Ifa fireisinvolved, carewillbe taken toavoid breathingfumes fromanyburningchemical.

In theeventofaspill, information on safetyprecautionsand clean-up procedures maybe gatheredfromherbicidefactsheets, labels, and thesourceslisted onpage7 ofthisYOP, underSectionVIIIentitled“EmergencyContacts”.

Minorspillswillberemedied bysoakingup thespillwith an absorbentmaterialand placingitin aleakproofcontainerforproperlabelingand disposal. Dryherbicides, such asgranularswillbeswept-up orshoveled-up directlyin leakproofcontainersforproper disposal. Allcontaminatedsoilwillbeplaced inleakproofcontainers, removed fromthe siteanddisposed ofproperly. Activated charcoalwillbe incorporatedinto thesoilatthe spilllocationata rateof7 poundsperthousandsquarefeet toinactivateanyherbicide residue.Anyspillwillbereportedto thePesticideBureau. In additiontothePesticide Bureau,theDEP Incident ResponseUnitwillbenotified ofanyspill inexcessofthe reportablequantity(“RQ”)value for the herbicide.
