PUBLIC HEARING. Mayor Albrecht opened the public hearing at 6:00 p.m. and welcomed those in attendance. Tina Mitchell then discussed the proposed changes to the Land Use ordinance, including a detailed definition of portable storage units, requirements for accessory apartments, and replacing “Multi-Family Dwelling” with “Accessory Apartment” as conditional on the Conditional Use Matrix. She then discussed proposed changes to the Subdivision Ordinance, including adding a requirement for a drainage plan prepared by a professional engineer and a section addressing drainage improvements. Tina then explained the proposed Nuisance Ordinance which, if approved, would replace the current one. Changes include a section addressing excessive noise and changes to the enforcement of the ordinance.

Mayor Albrecht explained that the Planning Commission has been discussing the proposed changes for over a year and has worked closely with the Town’s attorney, David Church. Mayor Albrecht then asked for any questions or concerns from those in attendance.

Steffin Whitlock asked why portable storage units are not permitted within Annabella Town limits. Mayor Albrecht explained that while the storage units are great for temporary use during construction, many residents have voiced their concerns regarding their appearance and other problems associated with leaving them on the property.

Councilman Nielson then asked how changes to the Land Use Ordinance would affect someone who wanted to rent out a section of their home. Tina Mitchell then read the proposed definition of an accessory apartment. Mayor Albrecht stated that the Planning Commission would need to review it and make the decision.

No other questions or concerns were stated. The public hearing closed at 6:25 p.m.

TOWN COUNCIL MEETING 6:30 p.m.

1. ROLL CALL. Roll call was answered by Mayor Albrecht. In attendance were Councilmen Brent Christensen, Wade Peterson, and Jay Dee Nielson. Councilman Roberts was excused. Tina Mitchell, Clerk, and Dusty Wilkinson, Maintenance Supervisor, were also in attendance.

2. OPENING REMARKS. Councilman Nielson offered a prayer.

3. PLEDGE OF ALLEGIANCE. Councilman Christensen led the group in the Pledge of Allegiance.

4. APPOINTMENT/AUSTIN MANWILL EAGLE PROJECT. Austin was not in attendance. Mayor Albrecht asked Tina Mitchell to contact him regarding his progress on the project.

5. APPOINTMENT/RUSS VARKER, NEIGHBORHOOD WATCH. Mr. Russ Varker, Six County Neighborhood Watch Coordinator, explained that he is working on revitalizing the program. He would like at least one coordinator for each town, along with block captains. He explained that the town coordinator would attend quarterly meetings and trainings. Mayor Albrecht noted that Glen Holmes is the Neighborhood Watch Coordinator for Annabella Town. Officer Stewart Reid then asked if the Neighborhood Watch Program included the Community Emergency Response Team (CERT) program. Mr. Varker then asked if anyone was interested in taking the CERT classes. Cory Sorensen noted that a few residents in Annabella have taken the course.

6. APPOINTMENT/JERRY DAVIS, CENTENNIAL CELEBRATION. Ms. Davis discussed the script for the DUP presentation. She noted that she has received a few pictures, but is in need of more. Tina Mitchell was asked to put another reminder in the newsletter. Ms. Davis also noted that they will be having an art show and a wagon tour throughout the town. There will also be a parade around the block. Mayor Albrecht noted that it may be a good idea to already have food prepared and brought in for the Saturday celebration. Tina Mitchell was asked to contact the ward Bishops and Young Men & Women leaders to attend the next meeting to discuss plans for the celebration and ideas on getting more residents involved.

Ms. Davis stated that she was going to ask Bridget Peterson to be in charge of an Annabella float for the Richfield Parade on July 5th. Mayor Albrecht noted that he would like to involve as many people as possible in the preparation of the celebration. He added that Larry Gleave and Elwin Hoyle might be willing to speak during part of the wagon tour.

7. APPROVAL OF MINUTES. The minutes from the February Town

Council meeting were presented for approval. Councilman Nielson made a motion to approve the minutes. Councilman Christensen seconded the motion and the motion carried unanimously.

8. APPROVAL OF WARRANT REGISTER. The warrant register was presented for approval. Councilman Christensen made a motion to approve the warrant register as presented. Councilman Nielson seconded the motion and the motion carried unanimously.

9. DISCUSS/APPROVE LAND USE, SUBDIVISION AND NUISANCE ORDINANCE CHANGES. The Council discussed the public hearing and all Council members in attendance felt that the changes had been well prepared and thought out.

Councilman Nielson made a motion to:

·  Repeal Ordinance 1997-1, the Annabella Nuisance Ordinance, and adopt Ordinance 2010-01, a revised Nuisance Ordinance

·  Adopt Ordinance 2010-02, an ordinance amending the Annabella Land Use Ordinance (4-2001).

·  Adopt Ordinance 2010-03, an ordinance amending the Annabella

Subdivision Ordinance (1996-4).

The motion was seconded by Councilman Peterson and the motion carried unanimously.

10. PRESSURIZED IRRIGATION. Mayor Albrecht noted that pressurized irrigation is scheduled to go on-line April 1st, weather permitting. He asked Tina Mitchell to put a reminder in the newsletter regarding the importance of keeping the valves off until the system is fully pressurized.

11. BUDGET REVIEW. Tina Mitchell reviewed the current financial statement with the Town Council. She explained that sales tax revenue is down over $6,000 compared to this time last year. Mayor Albrecht explained that the decrease in tax revenue has been a concern for most cities and towns. He added that it doesn’t affect Annabella as much as larger cities because we operate on a much smaller budget.

12. DEPARTMENT BUSINESS.

Councilman Sorensen noted that they will be meeting at the ball park on Saturday, March 27th to prepare for the concrete to be poured under the bleachers. Councilman Peterson asked about more dirt for the infield. Mayor Albrecht noted that it is not in the current year’s budget.

Councilman Christensen noted that it was important to get the roads swept. He added that he would like to have the large hole near the Post Office filled in with some gravel.

Dusty Wilkinson noted that Hawley’s is working on getting some gravel crushed for Annabella.

Officer Reid reported that there have been random acts of vandalism throughout the county. He added that motorcycles and helmets will be a concern as the weather warms.

13. ADJOURN. At 7:56 p.m. Councilman Christensen made a motion that the meeting adjourn. Councilman Nielson seconded the motion and the motion carried unanimously.
