FEE ORDINANCE AMENDMENTS RELATING TO THE WEBER COUNTY COMMUNITY & ECONOMIC DEVELOPMENT DEPARTMENT

WHEREAS, the manager of the Solid Waste Division has requested fee changes relating to waste and compost products; and

WHEREAS, the Community & Economic Development Department is charged with managing Weber County’s real property, including surplus property; and

WHEREAS, section 59-2-1351.5 of the Utah Code directs counties to allocate money received from the sale of property that is struck off to the county at a tax sale by first applying it to the cost of administering and supervising the property; and

WHEREAS, it has been determined that the minimum administrative cost related to selling properties acquired at tax sale is $100.00, due to the personnel and overhead costs associated with research, deed preparation, distribution of funds received, etc.; and

WHEREAS, after due consideration, the Board of County Commissioners of Weber County has determined to support such fee changes; and

NOW THEREFORE, the Board of County Commissioners of Weber County ordains as follows:

1.  Title 16, Chapter 2, Section 9 of the Weber County Code shall be amended to read as follows:

Sec. 16-2-9. – Solid waste fees.

General residential, commercial and industrial / $36.90 per ton (minimum $10.00 fee for loads 560 lbs or less)
Construction and demolition waste / $46.10 per ton (minimum $10.00 fee for loads 420 lbs or less)
Compost/Tree Waste / $30.00 per ton (minimum $10.00 fee for loads 680 lbs or less)
Used tires (residents only, up to 4 tires per person/per day) / $1.00 per tire plus minimum weight fee of $10.00
Special handling loads (campers, wet loads, etc.) / $55.00 per ton
Uncovered load fee (residential) / $10.00
Uncovered load fee (commercial) / $30.00
Vehicle weight fee / $4.00
Freon removal fee / $15.00 per unit
Friable asbestos / Not Accepted
E-Waste
Televisions and computer monitors / $10.00 for up to 3 units plus minimum weight fee; $3.00 for each additional unit

2.  The following section shall be added to Title 16, Chapter 5 of the Weber County Code:

Sec. 16-5-25. – Administrative fee for property struck off to the county at the tax sale.

The county shall collect an administrative fee when it disposes of real property that was struck off to the county at a tax sale. This administrative fee will be the greater of $100.00 or actual costs as documented by the county. The County commission has authority to waive this administrative fee if it is in the best interest of the county to do so.

This Ordinance shall be effective 15 days after publication in the Standard Examiner.
