4. RATES BASIS
(a) The rates scheduled are Basic RATES current at March 2011. They are subject to the Variation of Price surcharge clause 4.
(b) The rates include the SCOLA levy refundable to Pillar Consultancy.
(c) The rates do not include the main contractor’s discount if appointed as a sub-contractor in which case 1/39th is to be added
(d) The rates exclude Value Added Tax.
(e) To ensure the benefits and rates applicable to this programme agreement are obtained it is imperative that the initial enquiry states the quotation is to be in accordance with the Pillar/Scola Consultancy Programme Agreement for Modular Buildings; Rollalong Limited - Contract No. 111; Wernick Buildings Limited - Contract No. 211
5. VARIATION OF PRICE SURCHARGE
The basic rates are subject to a surcharge to update the rates to current prices, according to the date of commencement of sub-contract work on site as follows:
The surcharges are calculated by the following formula, which allows for movement in the Department for Business, Innovation & Skills (BIS) (formerly known as the BERR) index Table 1 Construction Material Prices Category “B”

6. RATES SCHEDULE
The rates schedule contain the detailed specification notes for each standard unit together with an overall price and elemental breakdown. Detailed quotations must be sought from the Nominee for each project. Pillar Consultancy can check that any quotation is in accordance with the Programme Agreement, upon request from a user.
7. QUANTITY DISCOUNTS
If the total value of an individual order is a) between £1million and £2million pounds there will be a 1% discount and b) over £2million the discount will be 2% .
8. SECTIONAL WORKING
If sub-contract work on site has to be carried out either discontinuously or in sections with different starting dates (even if work is continuous), for any reason outside the Nominees control, each section of work shall be treated separately when ascertaining the relevant commencement dates and the appropriate variation of price surcharge.
9. DAYWORK RATES
Daywork, when authorised, shall be charged at the following rates in accordance with the "Definition of Prime Cost of Daywork carried out under a Building Contract, Second Edition (1/12/75)" (subject to cash discount but not subject to surcharge or SCOLA levy).

10 MINIMUM NOTICE PERIODS
The following minimum notice will be required from placement of order and/ or final confirmation of details (whichever is the later), for delivery and commencement covered by this arrangement.;-

11. SPECIFICATION FOR STANDARD UNITS
Before the costs for each of the standard units there is a detailed list of exactly what items have been included, followed by a comprehensive schedule of rates for alternatives and external works.
12. NOMINEE ACTING AS MAIN CONTRACTOR
If a principal contractor has not been appointed the nominee is willing to operate as the main contractor, in which case the following will apply:-
In respect of any prime cost sums to be incorporated in the contract an addition of 10% will be made to cover profit and general attendance. Any special attendance will be quoted on each individual project for which it is required.
