MINUTES OF MEETING OF HEMINGBROUGH PARISH COUNCIL HELD AT HEMINGBROUGH METHODIST CHAPEL ON THURSDAY 19TH JANUARY 2017

17/001 PRESENT: - Councillor L Carstairs, R Chilvers, F Davidson, R Drew, G Harrison,

17/002 PUBLIC FORUM:-

A member of the public present said that he was pleased that NYCC had finally cleared the path from the Memorial Garden to Hagg Lane and asked if it would also be possible to get the footpath from Hagg Lane to the east side of the village cleared.

The Chairman advised that NYCC had employed George Fillingham who is the Parish Council grass cutting contractor to clear the path from the Memorial Garden to Hagg Lane and it was agreed to ask George to provide a quote to clear the other footpath.

Mrs Susan Sellers advised that Reverend Francis Loftus was retiring and his last service was to be held on Sunday 29th January at Riccall.

17/003 POLICE REPORT:-

A report listing the recent Ringmaster notifications received by the clerk was distributed.

17/004 LISTEN TO REPORTS FROM COUNTY AND DISTRICT COUNCILLORS:-

District Councillor J Deans spoke about the District Councils proposed increase in council tax for 2017/2018.

17/005 APOLOGIES: - Councillor J Sedman and District Councillor K Arthur

17/006 DECLARATION OF INTEREST/DISPENSATION REQUESTS:-

a) Councillors L Carstairs, F Davidson and R Procter declared a Disclosable Pecuniary Interest in Item (17/010g) Hall for Hemingbrough and Item (17/011a No.1) Planning Applications Received due to being a member of the Hall for Hemingbrough group.

b) Councillor G Harrison declared a Disclosable Pecuniary Interest in Item (17/010a) Registration and License Update / Village Greens due to being a member of Hemingbrough Hagg Lane Green Conservation Group.

17/007 CHAIRMAN’S OPENING REMARKS:-

The Chairman advised that Item 17/010i) United Charities had been withdrawn by the Parish Council member who had requested this item.

17/008 CLERKS REPORT:-

The clerk read out correspondence received from YLCA advising that following a successful procurement PKF Littlejohn have been appointed as the external auditor for all Parish and Town Councils in North, South and West Yorkshire for 2017/18 to 2021/22.

A letter received from Mrs Susan Sellers on behalf of Hemingbrough Parochial Church Council asking if the Parish Council would make a contribution towards the felling and removal of the dead horse chestnut tree in the churchyard was read out.

As the letter was received too late to put on the agenda the Parish Council were unable to make any decision and it was agreed to put this on the March agenda and to also ask Mr George Fillingham to provide a quote.

17/009 CONFIRMATION OF MINUTES:-

The Minutes of the Meeting held on Thursday 15th December 2016 were proposed by Councillor F Davidson, seconded by Councillor L Stebbings and agreed with a show of hands. RESOLVED

17/010 TO RECEIVE INFORMATION ON THE FOLLOWING ON-GOING ISSUES AND DECIDE FURTHER ACTION WHERE NECESSARY:-

a) Registration and License Update/Village Greens

It was noted that a further meeting had been held with Elmhirst Parker and that the clerk had amended the paperwork as agreed and sent this back to the solicitor but had not heard back from them.

b) Water Lane Pond

The Chairman gave an overview of the meeting held with Steve Mees – Mires Beck Nursery (Councillor R Procter and the clerk were also in attendance) and spoke about the advice received regarding suitable species of plants and marking off the corner of Water Lane Pond for use as a wildflower meadow and this was unanimously agreed.

c) Oldways

The Chairman advised that George Fillingham had removed the willow tree growing over the track as this was in a dangerous state.

It was also noted that the large branch that had become lodged in a tree at the cemetery had also been removed at the same time by Mr Fillingham.

Councillor R Chilvers asked that the Hemingbrough Historical Heritage Society keep the Parish Council informed of the work being carried out in the Oldways and the Chairman agreed to speak to the group about this.

d) Speeding Measures Update – Landing Lane: - No Further Update

e) Speeding on School Road

The Chairman gave an update on the 20’s Plenty campaign and advised that he was now in receipt of the 20’s Plenty wheelie bin stickers.

It was noted that the Chairman would produce a notice to put on the noticeboard/community boards to inform residents of the campaign and how they can obtain the wheelie bin stickers from the Parish Council.

f) Land on St Marys Avenue registered to the Parish Council

It was agreed that following a request from a resident the piece of land should be left as a village green and that Councillors F Davidson and L Stebbings would look at planting some trees and tidying up the area. RESOLVED

g) Hall for Hemingbrough

Councillor R Procter reported that the group have received a grant to engage professional services to advise on land acquisition and that they were in the process of arranging a further public meeting to provide a progress report and to seek the views of residents.

It was also noted that the group have been running competitions at Hemingbrough Primary School and Barlby High School to gauge the views of local children and teenagers.

h) Riverbank Footpath Safety

The Chairman referred to a piece from a national newspaper regarding a man that had been stamped on by a herd of cows whilst walking on a public footpath.

Councillor R Drew raised concern that a number of residents had complained that they had been chased by the cows and that they are unable to walk dogs on the riverbank in the summer.

It was agreed that the clerk would write to the Environment Agency who let the land to a farmer for grazing cattle and ask them to take action to ensure the safety of people walking on the riverbank. RESOLVED

j) Tree Preservation Order

Councillor R Chilvers reported that he had spoken to Selby District Council regarding tree preservation orders (TPO’s) and proposed that the clerk clarify with SDC the procedure for putting TPO’s on trees.

The Chairman read out advice previously received in March 2015 from Selby District Council outlining the criteria for TPO’s and stressed that based on that advice the implementation of TPO’s was not necessary.

Councillors L Carstairs, F Davidson and R Procter left the meeting.

17/011 PLANNING:-

a) Applications Received ex Selby District Council:

1. (2016/1337/OUTM) Outline application for residential development of up to 21 dwellings (with all matters reserved) on land to the east of Street Record, School Road, Hemingbrough. Strongly Object (unless significant road improvements are carried out)

1) The development would extend the village and there is sufficient brownfield land within the village that should be used before a greenfield site.

2) Lack of infrastructure to support further development.

3) Planning conditions should ensure that the hedges and trees remain on site.

4) No drives should come out directly onto School Road and the line of sight must be kept open for safety reasons.

5) The proposed development would cause a build-up of traffic pulling out onto the A63 from School Road. This entrance/exit to the village would need to be developed for any future traffic increase and a roundabout/waiting area in the road for turning into School Road would be required (at the applicants cost) on the grounds of safety.

If road improvements are not carried out then this development should be refused.

The Parish Council discussed any potential Community Infrastructure Levy (CIL) that would be generated from this development and how this could be used for further road improvements and the Chairman agreed to speak to Gary Lumb (NYCC Highways) regarding this.

Councillors L Carstairs, F Davidson and R Procter returned to the meeting.

2. (2016/1485/HPA) Proposed erection of replacement oak framed conservatory at Silver Birches, Landing Lane, Hemingbrough. No Objections

3. (2016/1507/DOC) Discharge of condition (02) pigeon waste of appeal decision APP/N2739/C/16/3145909 for appeal against Enforcement Notice concerning a breach of planning control within paragraph (a) of Section 171 A(1) of the Town and Country Planning Act 1990 (as amended) for the unauthorised erection of two unauthorised pigeon lofts at Land adjacent to Frog Hall, Hagg Lane, Hemingbrough.

b) Note planning permission refused for: NIL

c) Note planning permission granted for: NIL

d) Note planning permission withdrawn for: NIL

The Chairman thanked Councillor F Davidson for collecting the rock salt and the repair work he had carried out on the salt bin.

District Councillor J Deans left the meeting.

c) Receive Finance Report, consider the budget proposals for 2017/2018 and decide upon the level of precept followed by the signing of the form for Selby District Council.

It was proposed, seconded and agreed with a show of hands to keep the Band D charge per property the same for 2017/2018. RESOLVED

d) Consider and Decide on the introduction of electronic banking and Parish Council debit card.

It was proposed by Councillor F Davidson, seconded by Councillor R Procter and unanimously agreed that as cheques are being phased out the Parish Council would implement electronic banking and apply for a Parish Council debit card. RESOLVED

17/014 CORRESPONDENCE:-

a) Charitable Donations – Receipt of letter of thanks received from Hemingbrough Institute and Playing Fields Association was noted.

17/015 RECEIVE REPORTS FROM COUNCILLORS REGARDING PARISH ISSUES:-

The Chairman advised that a letter had been sent to the companies concerned regarding

sat navs misdirecting HGV’s down Hagg Lane. The Chairman also advised that at present there is no weight limit sign on Hagg Lane and he has raised this with Gary Lumb – Highways.

Councillor R Chilvers reported that the hunt had been down Oldways again recently and churned it all up.

Councillor Chilvers also asked if the footpath on Landing Lane could be reinstated and it was agreed to put this on the February agenda for further discussion.

Councillor G Harrison reported fly tipping opposite the Memorial Garden.

17/016 MATTERS FOR THE CLERKS ATTENTION AND ITEMS FOR NEXT MONTHS AGENDA:-

The clerk was asked to report a number of lights out to NYCC.
