2)Description of Services and Deliverables:
- General Description of Project:
Supplierwillprovide all supervision, labor, tools, material, and equipment necessary to perform Crane Rental Services for the Lower Colorado River Authority (LCRA).
- Description of Deliverables:
Operational Expectations - It is expected that the Supplier will deliver and operate equipment and otherwise execute this contract in a safe and efficient manner, that the equipment will be maintained and serviced per manufacturer's recommendations in order to provide safe and efficient operation, and that all personnel will conduct themselves in a safe and professional manner. The Supplier will be responsible for all clearance requirements at each site and will be otherwise responsible for the safe delivery, set up and removal of equipment. When the Supplier's operator is part of the services provided under an Order, the Supplier's operator is ultimately responsible for the safe operation of the equipment. LCRA is authorized, as part of this contract, to determine if equipment and/or personnel are operating in a safe manner, and also has the authority to halt work and/or hoisting operations as LCRA sees fit in order to maintain a safe working environment.
Operator Certification - Supplier's designated operators will be certified in the proper use of the specific equipment rented in accordance with The Crane Manufacturers Association of America (CMAA) and/or the National Commission for the Certification of Crane Operators (NCCCO) (or other OSHA qualified certification). Certification should be in keeping with all applicable ANSI and OSHA standards, i.e., U.S. Dept. of Labor OSHA, Subpart Title: Cranes, Derricks, Hoists, Elevators, and Conveyors Standard Number:1926.550, Subpart Title: Cranes, Derricks, Hoists, Elevators, and Conveyors et. al. (Supplier is directed to Supplierwill be prepared to prove to LCRA at any time that the operator(s) is certified on the specific equipment being used. At no time will non-certified operators be in control of any hoisting equipment. LCRA supervisors and/or Safety Department personnel will have the right to request operator certification from the crane operators upon arrival at the jobsite.
OSHA and ANSI Standards - Operation of equipment rentedin this RFP/Contract will be in accordance with applicable OSHA standards and Regulations (Standards - 29 CFR) Cranes and derricks. - 1926.550 et. al. Operator is to be responsible that all OSHA and ANSI standards will be upheld for operation and maintenance of equipment being rentedby the LCRA in accordance with this RFP/Contract. LCRA will be able to audit all maintenance records at any time. It is expected that the equipment in this Contract will be maintained and serviced so as to provide a safe and efficient work site.
Annual Equipment Inspections — All cranes are to be current with annual inspection certifications affixed to all cranes rented by LCRA.
Material Safety Data Sheets (MSDS) – Supplier will provide MSDS forms for any product which contains compounds that can precipitate harmful byproducts through the exposure to heat, ignition, reaction to/with other chemicals, which would in any manner create a health hazard should any individual become exposed to the chemical or it’s associated byproducts. The MSDS shall accompany the order and be available to jobsite personnel where the crane rental services are being provided. Crane rental services may be rejected and returned to the Supplier, and at the Supplier’s expense if the MSDS forms are not available and on hand at the service location.
C. Description of Services:
Supplier shall supply all supervision, labor, tools, material, and equipment necessary to perform Crane Rental Services. Supplier will also supply riggers, matting, straps, cable slings, cable softeners, shackles, additional trucks for carrying counter weights and all other necessary equipment to perform the work.
Most of the crane services will be for hoisting needs at one of LCRA’s power plants or for transformer relocations, transformer setting, transformer on-loading and off-loading, tower and electrical pole installation, tower and electrical pole on-loading and off-loading, and general needs for LCRA’s loading and unloading operations.
Visits to Job Site - Supplier's designated representative may visit each job site prior to sending cranes or crane operators to ensure personnel and equipment are adequate for site. This is to ensure that the Supplier understands requirements of job to include the required size of crane, height of lift, restrictions, any safety issues, etc. Supplier is responsible for determining clearances and right of way for cranes, booms and equipment. Coordination with LCRA representative is required before Supplier visits the site. All job site visits shall be prearranged and approved by the LCRA. LCRA will not be liable for costs associated with unauthorized job site visits.
Technical Capabilities and Support Functions – Supplier will provide technical personnel, via telephone, email, or in person as required, to assist LCRAin all areas of providing the appropriate equipment for each specific project or task. This technical assistance will be at no additional cost to LCRA.
Emergency Response – There are instances where LCRA requires Crane Rental Services on an emergency basis. Supplier will respond with requested equipment and service on an “as soon as possible” response time, but not to exceed 24 hours from order placement. Rates for emergency response shall be the same rates contained in Exhibit A of this SOW.
Equipment Delivery Errors – If the Supplier delivers supervision, labor, tools, material, and/or equipment unsuited for, or incapable of, performing an order placed by LCRA, the Supplier will issue a credit for all related charges. The Supplier, at no cost to LCRA, will remove the unsuitable items from the LCRA site. Supplier will consult with LCRA to rectify the error and provide the proper supervision, labor, tools, material, and/or equipment that meets the requirements to complete the project or task.
Defective or Unsafe Items – If a crane(s) or other items are defective or unsafe in any way, as determined by LCRA at the time of delivery and beyond, the Supplier will remove the defective items from the LCRA site. The Supplier will remove and replace the defective items at no cost to LCRA, and the replacement(s) are to meet the requirement of this SOW.
3)Other Requirements:
Performance review meetings may be held bi-annually with the LCRA or as required to mutually evaluate the overall performance of each of the parties. Areas to be addressed will include, but not be limited to, the following:
Quality of Supplier(responsiveness, accurate invoices, cost savings assistance, etc.)
Delivery performance and on-site performance
Price competitiveness
Quality of services (the right equipment and personnel was delivered to the right place, at the right time, etc.)
4)Schedule:
Services are to be provided on an “as needed” basis. Specific rental and/or project specific start and finish dates will be provided by LCRA Representative placing the order.
5)Acceptance Criteria:
- Verbal acceptance of the Deliverables and Services shall be provided by LCRA.
- Any dispute by the Supplier regarding LCRA’s non-acceptance of a Deliverable or Service shall be made in writing within 10 business days after LCRA’s notice of non-acceptance.
6)Locations:
LCRA reserves the right to add or remove LCRA service locations and project sites throughout the term of this contract.
Deliveries – The delivery locations will be specified by the LCRA representative placing the order. Most deliveries will be made to a specific jobsite or to LCRA’s Dalchau Service Center at 3505 Montopolis Drive, Austin TX, 78744. Most jobsites will be located in the central Texas area within an approximate radius of 150 to 200 miles from Austin, TX. Crane services may be required outside of this service area, but not outside the state of Texas. The Supplier will deliver the crane(s) specified in an order to the location specified, and at the time the delivery is requested.
7)Payment Schedule:
For the Services and Deliverables to be provided hereunder, LCRA will pay Supplierbased upon Unit Pricing, or Time and Materials Pricing Not to Exceed Pricing, based on the rates in accordance with Exhibit C of theContract. All work invoiced for a given order, or work within a given month that is part of a longer term rental, must be accepted prior to the Supplier’s issuance of an invoice. Invoices shall be generated no more than monthly.
8)Approval:
The parties hereto have caused this Statement of Work to be executed by their respective duly authorized representatives, and this SOW is effective as of the date of the last signature below. Any changes to this SOW must be made in writing and signed by the Supplier and the LCRA Agent noted above or one appointed by LCRA Supply Management with appropriate delegation of authority.
