Commonwealth Games Arrangements (Prescribed Powers and Functions) Regulations 2006
The Governor in Council makes the following Regulations:

1. Objective
The objective of these Regulations is to prescribe powers and functions for the purposes of section28AA of the Commonwealth Games Arrangements Act 2001.
2. Authorising provision
These Regulations are made under section 57(1)(bf) of the Commonwealth Games Arrangements Act 2001.
3. Definitions
r. 3
In these Regulations—
"field of play" means any area of land in a Games management area that is used for the sporting program, other than land which is—
(a) a M2006 venue; or
(b) Village land; or
(c) Venue land;
"M2006 venue" means land in the following Games management areas—
(a) Melbourne Park, including the Rod Laver Arena, the Multi-purpose venue and adjacent land, being the land subject to the Commonwealth Games venue Order dated 22 February 2006, published in Special Government Gazette (S56) on 28 February 2006 at page 1 to the extent of any area shown shaded grey and bordered by broken black lines on the MCG and Sports and Entertainment Precinct plan held at the Office of Commonwealth Games Coordination;
(b) Olympic Park, Edwin Flack field and adjacent land, being the land subject to the Commonwealth Games venue Orders, both dated 22 February 2006, published in Special Government Gazette (S56) on 28 February 2006 at page 1 to the extent of any area shown shaded grey and bordered by broken black lines on the MCG and Sports and Entertainment Precinct plan held at the Office of Commonwealth Games Coordination;
(c) the Melbourne Cricket Ground, being the land subject to the Commonwealth Games venue Order dated 30 August 2002, published in Special Government Gazette (S155) on 2 September 2002 to the extent of any area shown shaded grey and bordered by broken black lines on the MCG and Sports and Entertainment Precinct plan held at the Office of Commonwealth Games Coordination;
(d) Telstra Dome, being the land subject to the Commonwealth Games venue Orders dated 22 February 2006, published in Special Government Gazette (S56) on 28 February 2006 at pages 5 and 6 to the extent of any area shown shaded grey and bordered by broken black lines on the Docklands precinct plan held at the Office of Commonwealth Games Coordination;

(e) Ballarat Minerdome, being the land subject to the Commonwealth Games venue Orders both dated 22 February 2006, published in Special Government Gazette (S56) on 28 February 2006 at page 3 to the extent of any area shown shaded grey and bordered by broken black lines on the plan of the Ballarat Minerdome precinct plan held at the Office of Commonwealth Games Coordination;
(f) Melbourne Exhibition Centre, being the land subject to the Commonwealth Games venue Order dated 22 February 2006, published in Special Government Gazette (S56) on 28 February 2006 at page 4 to the extent of any area shown shaded grey and bordered by broken black lines on the Melbourne Exhibition Centre precinct plan held at the Office of Commonwealth Games Coordination;
(g) Traralgon Stadium and surrounds, being the land subject to the Commonwealth Games venue Order dated 10 February 2006, published in Special Government Gazette (S48) on 13 February 2006 at page 5 to the extent of any area shown shaded grey and bordered by broken black lines on the Traralgon Stadium precinct plan held at the Office of Commonwealth Games Coordination;

(h) the Bendigo Basketball Stadium, being the land subject to the Commonwealth Games venue Order dated 10 February 2006, published in Special Government Gazette (S48) on 13 February 2006 at page 4 to the extent of any area shown shaded grey and bordered by broken black lines on the Bendigo Basketball Stadium precinct plan held at the Office of Commonwealth Games Coordination;
(i) the Geelong Arena land, being the land subject to the Commonwealth Games venue Orders dated 22 February 2006, published in Special Government Gazette (S56) on 28 February 2006 at pages 3 and 4 to the extent of any area shown shaded grey and bordered by broken black lines on the Geelong Arena precinct plan held at the Office of Commonwealth Games Coordination;
(j) the Melbourne Gun Club and Spadoni's Reserve, Lilydale, being the land subject to the Commonwealth Games venue Order dated 10 February 2006, published in Special Government Gazette (S48) on 13 February 2006 at page 3 to the extent of any area shown shaded grey and bordered by broken black lines on the Melbourne Gun Club Lilydale precinct plan held at the Office of Commonwealth Games Coordination;

(k) the Melbourne International Shooting Club, the Melbourne International Kart Raceway and the Westgate Carpark, Fisherman's Bend, being the land subject to the Commonwealth Games venue Order dated 10 February 2006 published in Special Government Gazette (S48) on 13 February 2006 at page 3 to the extent of any area shown shaded grey and bordered by broken black lines on the Melbourne International Shooting Club precinct plan held at the Office of Commonwealth Games Coordination;
(l) the State Lawn Bowls Centre Northcote, being the land subject to the Commonwealth Games venue Order dated 10 February 2006, published in Special Government Gazette (S48) on 13 February 2006 at page 6 to the extent of any area shown shaded grey and bordered by broken black lines on the Darebin Lawn Bowls precinct plan held at the Office of Commonwealth Games Coordination;
(m) the Wellsford Rifle Range and the Wellsford State Forest, Bendigo, being the land subject to the Commonwealth Games venue Order dated 10 February 2006, published in Special Government Gazette (S48) on 13 February 2006 at page 4 to the extent of any area shown shaded grey and bordered by broken black lines on the Wellsford Rifle Range Bendigo precinct plan held at the Office of Commonwealth Games Coordination;

(n) the State Netball and Hockey Centre within Royal Park, being the land subject to the Commonwealth Games venue Order dated 10 February 2006, published in Special Government Gazette (S48) on 13 February 2006 at page 3 to the extent of any area shown shaded grey and bordered by broken black lines on the Royal Park precinct plan held at the Office of Commonwealth Games Coordination;
(o) Lysterfield Park, being the land subject to the Commonwealth Games venue Orders both dated 22 February 2006, published in Special Government Gazette (S56) on 28 February 2006, at page 2 to the extent of any area shown shaded grey and bordered by broken black lines on the Mountain Bike Course precinct plan held at the Office of Commonwealth Games Coordination;
(p) the Melbourne Sports and Aquatic Centre, being the land subject to—
(i) the Commonwealth Games venue Order dated 5 September 2003, published in Special Government Gazette (S166) on 8 September 2003 at page 1; and
(ii) the Commonwealth Games venue Order dated 31 January 2006 in respect of the whole of the area shown hatched in pink adjacent to the Parks Victoria Office on lodged plan LEGL./06-012 lodged in the Central Plan Office maintained under the Survey
Co-ordination Act 1958, published in Special Government Gazette (S34) on 31 January 2006 at page1—

to the extent of any area shown shaded grey and bordered by broken black lines on the Melbourne Sports and Aquatic Centre precinct plan held at the Office of Commonwealth Games Coordination;
(q) Catani Gardens, being the land subject to the Commonwealth Games venue Order dated 22 February 2006, published in Special Government Gazette (S56) on 28 February 2006, at page 7 to the extent of any area shown shaded grey and bordered by broken black lines on the Triathlon Course precinct plan held at the Office of Commonwealth Games Coordination;
(r) the Cycle Road Race Back of House Compound land, being the land subject to the Commonwealth Games venue Order dated 10 February 2006, published in Special Government Gazette (S48) on 13 February 2006, at page 2 to the extent of any area shown shaded grey and bordered by broken black lines on the Cycling Road Race precinct plan held at the Office of Commonwealth Games Coordination;
(s) the Sponsor Showcase at Birrarung Marr, being the land subject to the Commonwealth Games venue Order dated 31 January 2006, published in Special Government Gazette (S34) on 31January 2006 at page 1, to the extent of any area shown shaded grey and bordered by broken black lines on the Public Domain Birrarung Marr Zone 3 precinct plan held at the Office of Commonwealth Games Coordination;

(t) any other land in a Games management area shown shaded grey and bordered by broken black lines on any precinct plan referred to in paragraphs (a) to (s);
"sporting program" means the competition events, training activities and familiarisation activities held for the Commonwealth Games;
"the Act" means the Commonwealth Games Arrangements Act 2001;
"Venue land" means land that is subject to the following Orders made under the Act—
(a) Commonwealth Games venue Order dated 5 December 2005 in respect of the International Broadcast Centre, published in Special Government Gazette (S258) on 15 December 2005;
(b) Commonwealth Games venue Order dated 17 November 2005 in respect of the Uniform Accreditation Centre, published in the Government Gazette (G46) on 17 November 2005 at page2627;

(c) Commonwealth Games venue Order dated 5 December 2005 in respect of the Games Warehouse, published in Special Government Gazette (S258) on 15 December 2005;
(d) Commonwealth Games venue Order dated 10 February 2006 in respect of the Bendigo Athletes Village, published in Special Government Gazette (S48) on 13 February 2006 at page 4;
(e) Commonwealth Games venue Order dated 16 December 2005 in respect of 21 to 37 Lorimer Street, Southbank, published in the Government Gazette (G51) on 22 December 2005 at page2981;
(f) Commonwealth Games venue Order dated 5 January 2006 in respect of the Southbank Merchandise Tent, published in Special Government Gazette (S4) on 5 January 2006;
(g) Commonwealth Games venue Order dated 1 March 2006 in respect of the Melbourne 2006 Commonwealth Games Corporation headquarters at the World Trade Centre in Melbourne, published in Special Government Gazette (S60) on 2 March 2006;
"Village Land" means land described in the following Orders made under the Act—
(a) Commonwealth Games venue Order dated 1 April 2003 published in the Government Gazette (G14) on 3 April 2003 at page 657;

(b) Commonwealth Games venue Order dated 2 July 2004 published in Special Government Gazette (S163) on 5 July 2004 at page 2;
(c) Commonwealth Games venue Order dated 19 March 2005 published in Special Government Gazette (S52) on 21 March 2005, except for Gibson Avenue;
(d) Commonwealth Games venue Order dated 13 May 2005 published in Special Government Gazette (S92) on 13 May 2005, except those parts of Park Street that are excluded by fencing from the Games Village land;
(e) Commonwealth Games venue Order dated 7 September 2005 published in Special Government Gazette (S171) on 9 September 2005 at page 1, except for the land marked "2017 MHRI" on the plan in that Order.
4. Delegation of prescribed powers and functions
r. 4
(1) For the purposes of section 28AA of the Act, the Secretary must delegate to the Corporation, in respect of the land or any part of any land specified in sub-regulation (2), the following prescribed powers and functions under the following sections of the Act—
(a) section 26 of the Act, but only in respect of any Commonwealth Games project for which the Corporation is the responsible authority under section 17 of the Act;
(b) section 27 of the Act, but only in respect of any Commonwealth Games project for which the Corporation is the responsible authority under section 17 of the Act;
(c) section 49 of the Act;
(d) section 51 of the Act;
(e) section 51A of the Act;
(f) section 56AB(1) of the Act;
(g) section 56AD of the Act;
(h) section 56AE of the Act.
(2) For the purposes of sub-regulation (1), the specified land is—
(a) any M2006 venue; and
(b) Village land; and
(c) any field of play; and
(d) Venue land.
