A SENATE RESOLUTION

PROVIDING FOR THE REIMBURSEMENT OF LEGAL FEES INCURRED BY STATE EMPLOYEES RESPONDING TO SUBPOENAS ISSUED BY THE SENATE FINANCE COMMITTEE IN CONNECTION WITH THE CAPITAL GAINS INVESTIGATION, TO PROVIDE FOR A CLAIM FOR REIMBURSEMENT TO BE MADE TO THE SENATE FINANCE COMMITTEE, AND TO PROVIDE THAT UPON VERIFICATION THE COMMITTEE SHALL FORWARD THE CLAIM TO THE CLERK OF THE SENATE FOR PAYMENT FROM THE APPROVED ACCOUNTS OF THE SENATE.

Whereas, the members of the Senate note that numerous state employees were subpoenaed by the Senate Finance Committee on behalf of the Subcommittee to Investigate the Special Capital Gains Tax Provisions; and

Whereas, the nature of these subpoenas and the investigation have raised concern by these employees, reasonably causing them in some instances to retain private counsel to advise them on matters relating to the subpoena and their testimony before the subcommittee; and

Whereas, in order to insure that state employees are not burdened by personal legal expenses incurred by virtue of the performance of their official duties. Now, therefore,

Be it resolved by the Senate:

That state employees, not including any elected official, subpoenaed by the Senate Finance Committee on behalf of the Subcommittee to Investigate the Special Capital Gains Tax Provision who were subpoenaed by virtue of their state service during the time covered by the investigation and who remained state employees, regardless of employer, at the time the subpoenas were served, must be reimbursed all legal expenses incurred by them in responding to these subpoenas.

Be it further resolved that employees claiming reimbursement shall submit documentation of legal expenses incurred to the Senate Finance Committee, which after verification of the expenses shall forward the claim to the Clerk of the Senate who shall pay the claim from approved accounts of the Senate.
