Conditions of contract /

Consignee understands that the Agent undertakes customs procedure based on the information of the attached documents of the shipment without extra notification.

Agent is liable for representation of Consignee in the customs clearance procedure according to Consignee’s instructions with regard to the operative laws.

In order to undertake the customs procedure, Consignee is liable for fully informing the Agent about all necessary facts and data, and in addition, to hand over complete documentation necessary for customs clearance.

Agent is not liable for any losses originating from false or delayed data supply.

Consignee undertakes that in case the goods are cleared on false information or by Agent’s fault, Agent is notified in written form within 10 days of the clearance, so that the necessary modifications and corrections can be fulfilled at the Agent’s own cost.

Consignee accepts that modifications from misinformation by the sender of the consignment or by the Consignee are to be fulfilled by the Consignee. Possible customs penalties originating from these types of misinformation are to be paid for the Agent within 30 days of demand note.

Consignee accepts that after the 10th day of customs clearance the Agent is not liable for commitments for false information used in the customs procedure, and in addition, does not take responsibility for damages originating from the use of false information.

Consignee is responsible for paying all costs in connection with the clearance of the consignment as well as any advanced payments by the Agent – incidentally including public dues imposed by the customs authority, paid by the Agent – at the time of receiving the notification of consignment and the resolution on imposing customs.

In addition, Consignee is responsible for informing the Agent about all subsequent changes relevant to the customs clearance with no delay.

Consignee declares that in case of any changes in vital information concerning customs clearance (i.e. name, tax number, premise, address, bank account number), Agent shall immediately be notified in written form, either via mail to DHL Express Hungary Ltd. 1097 Budapest, Fehérakác u. 3. or by fax to 061 8817521, 061 8817522, 061 8817523 fax number.

Parties come into contract until the customs clearance of the related consignment is fulfilled, with the clause that any parties can one-sidedly denounce the contract by a written statement to the other party.

However, at termination of the contract, Consignee is responsible for reimbursement of any advance payment by the Agent without any delay.

Questions not regulated by this contract are to be provisioned by Regulation (EU) No 952/2013 oftheEuropeanParliamentandoftheCouncil laying down the Union Customs Code. Act XIII of 2016 on implementation, Union Customs Code.

In addition, we call your kind attention to article no 144-152. of Regulation (EU) No 952/2013 of the European Parliament and of the Council laying down the Union Customs Code regulating temporary custody, and articles no. 25 of Council Regulation (EC) No 1186/2009 of 16 November 2009 setting up a Community system of reliefs from customs duty, which regulate the cases of duty free shipments from private individual to private individual.
