PART T1: TENDERING PROCEDURES

T1.1:Tender Notice and Invitation to Tender

CONTRACT NO: HS-B04/2017/2018 FOR COMPLETION OF COMMUNITY RESIDENTIAL UNITS, DARK & SILVER CITY: BOTTOM SITE, BLOEMFONTEIN
FREE STATE DEPARTMENT OF HUMAN SETTLEMENT invites tenders for the construction of Free State Mixed Use Housing Development
The tenderers should have a CIDB contractor grading designation of 8 GB or 7 GB PE will also be considered.
Joint ventures are eligible to submit tenders provided that they satisfy criteria stated in the Tender Data.
Tenderers must be registered with the CIDB in a GB class of construction works. As per the Preferential Procurement Regulation 2017 gazette 10684: A minimum 30 % sub-contracting to at least 51% black owned EME or QSE company, entity or cooperative is required. The sub – contractors ‘s details should be attached and returned with the bid document, e.g, company documents, BEE Certificates, valid tax clearance certificate, I.D copies, etc

Documents may be collected during working hours between 09h00 and 15h00 from 10 October 2017.
A non-refundable tender fee of R 1282.00 must be paid to the Free State Department of Human Settlements before any tender documents can be given to bidders. No bank payments or cheques allowed. Please be advised that the bid documents can also be downloaded from the e-tender portal at www.etenders.gov.za at no cost.

The closing time for receipt of tenders is 31 October 2017 @ 11h00 Telegraphic, telephonic,
telex, facsimile, e-mail and late tenders will not be accepted.
Requirements for sealing, addressing, delivery, opening and assessment of tenders are stated in the Tender Data.

EVALUATION CRITERIA

1.  PRICE

All bids will be evaluated on functionality and in accordance with 80/20preferential procurement system:

Price 80 points

B-BBEE Status level of contribution 20 points

2.  FUNCTIONALITY

Bidders must achieve a minimum of 75 points of the functionality points to be considered for further evaluation.

PART T1: TENDERING PROCEDURES

T1.2 Tender Data

The conditions of tender are the Standard Conditions of Tender as contained in Annex F of SANS294:2004, bound into section T1.3.

The Standard Conditions of Tender makes several references to the tender data. The tender data shall have precedence in the interpretation of any ambiguity or inconsistency between it and the standard conditions of tender.

Each item of data given below is cross–referenced to the clause in the Standard Conditions of Tender to which it mainly applies.

1.5 / The Employer’s right to accept or reject any tender offer.
1.5.1 / The employer may accept or reject any bid or portion thereof, variation, deviation, tender offer, or alternative tender offer, and may cancel the tender process and reject all tender offers at any time before the formation of a contract. The employer shall not accept or incur any liability to a tenderer for such cancellation and rejection, but shall give reasons for such action

2.2 / Add the following to the clause:
Accept that failing the submission of a bona fide tender, a Tenderer shall forfeit his tender deposit (if the deposit is refundable) if he fails to return a complete set of documents prior to the closing time for the submission of tender offers.
Accept that the Employer will not compensate the tenderer for any costs incurred in attending interviews in the office of the employer or the employer’s agent (if required).
2.7 / A compulsory site visit and clarification meeting will be held as follows:
Refer to tender notice and invitation to tender in Part T1.1
Confirmation of attendance will be recorded in the clarification meeting.
Tender documents will not be made available at the clarification meeting. Detail relating to the collection of tender documents is indicated in the Tender Notice and Invitation to Tender (Section T1.1 of the document)
2.8 / Replace the contents of the clause with the following:
Request clarification of the tender documents, if necessary, by notifying the Employer’s official or the Employer’s agent indicated in the tender notice and invitation to tender (section T1.1) in writing at least ten working days before the closing time stated in clause 2.15.
2.11 / Add the following to the clause:
To correct errors made, draw a line through the incorrect entry and write the correct entry above in black ink and place the full signatures of the authorised signatories next to the correct entry.
2.12.1 / Add the following to the clause:
All alternative tender offers shall be referred to in Section T2.2.1 – Alterations to Tender.
2.12.2 / Should the Tenderer wish to offer alternative designs and/or construction materials, he shall include with this Tender full details thereof, including a complete bill of quantities, formal design calculations, and full details of all alternative components proposed to be included in the Works. Refer also to Clause 4.2 of the Contract Data in this regard.
Failure to properly comply with this clause, thereby preventing the Employer and/or the Engineer to properly assess the full implications of the alternative tender, is likely to disqualify the alternative offered from further consideration.
No submission by the Contractor after award for additional payment or time for completion of Works relating to the alternative offer will be considered, the tendered rates submitted shall be considered to reflect the full and final cost implications of the alternative offer.
2.13 / Add the following to the clause:
No claim will be entertained for faults in the tender price resulting from any discrepancies, omissions or indistinct figures.
2.13.2 / Replace the contents of the clause with the following:
Return all volumes of the tender document to the Employer after completion of the relevant sections of each volume in their entirety, either electronically (if they were issued in electronic format) or by writing in black ink.
All volumes are to be left intact in its original format and no pages shall be removed or re-arranged.
2.13.3 / No copies of the tender offer are required.
2.13.4 / Add the following to the clause:
Only authorised signatories may sign the original and all copies of the tender offer where required in terms of 2.13.3.
2.13.5 / The Employer’s address for delivery of tender offers and identification details to be shown on each tender offer package are:

1  Identification details: HS-B04/2017/2018 - The department of human settlements hereby requests tenders from contractors for the completion of community residential units for the department of human settlements free state.

The name and address of the tender shall be entered on the back of the envelope.
2.13.6 / A two-envelope procedure will not be followed.
2.13.9 / Add the following new clause:
Accept that all conditions, which are printed or written upon any stationary used by the Tenderer for the purpose of or in connection with the submission of a tender offer for this Contract, which are in conflict with the conditions laid down in this document shall be waived, renounced and abandoned.
2.14 / Add the following to the clause:
