V.s Production Rate Limitations
The production rate terms and conditions are used to restrict the operation of emissions units to limit potential emissions. This is done so facilities can avoid various regulations. For instance, a facility may be installing a new emissions unit that has potential emissions over the 40-ton PSD threshold for VOCs. To avoid PSD review, the facility may agree to a production restriction that results in less than 40 tons of emissions. By agreeing to this restriction, the facility can avoid PSD review.
Note: Restrictions can be in the form of gallons of coating used per unit of time or on the hours of operation, instead of a production rate limitation. Use the Terms and Conditions Library Section W for coating usage limitations and Section X for limitations on the hours of operation.
The terms and conditions template file numbered “VA” should be used when a rolling 365-day or 12-month limit is not needed to limit the production rate. Daily, monthly and/or annual limitations can be used to avoid State-only requirements. These terms and conditions should be used where a facility can agree to or requests a limitation in their permit that does not involve federal requirements. Use term file “VA” for State-only permits or where a rolling limit is not required.
For a new source using a restriction on the production rate to avoid Federal requirements, month-to-month production rate limitations would be required for the first 12 months of operation. Use the terms and conditions in file “VC” to develop the month-to-month “table” of limits for the first 12 months and the continuos rolling 12 months.
Use the terms and conditions in file “VB” for existing sources using a restriction on the production rate to avoid Federal requirements, where production rate data exists for the past 12 months and the records are available to start a rolling 365-day or 12-month record of the production rate upon the issuance of the permit.
