O R D E R
The Delhi Medical Council examined complaint of Shri Charan Jit Singh Oberoi, forwarded by Medical Council of India, alleging medical negligence on the part of Dr. G.S. Kohli, in the treatment administered to the complainant’s wife Late Rajinder Kaur (referred hereinafter as the patient) at Joy Nursing Home, Rajouri Garden, New Delhi.
The Delhi Medical Council perused the complaint, reply of Dr. G.S. Kohli, case papers of Joy Nursing Home, Kukreja Hospital & Heart Centre, Rajouri Garden, New Delhi and heard the following in person :-

Following are the findings of the Delhi Medical Council :-
(1)The patient was admitted at Joy Nursing Home on 11.4.2003 at 3.00 PM with acute abdominal pain. As per the case papers of Joy Nursing Home, the respondent examined the patient on 11.4.2003 and found pallor, pulse rate 88 per min, BP - 150/70 mm Hg, Chest - clear, Abdomen - soft with mild tenderness, there was no rebound tenderness and bowels sounds were present. Investigations revealed Hb - 7 gm %, TLC - 7200 per cc mm, DLC - P83 L13 E4, S. Bilirubin - 6.2 mg %, blood urea – 62.4 mg %, S. Creatinine – 1.9 mg %, Serum Electrolytes were within normal limits, Plain X-ray abdomen including right dome of diaphragm bearing number R488 was also done on 11.4.2003. The patient was treated with I/V fluids, Injections, Monocef, Metrogyl, Aciloc and Buscopan. Thereafter the patient was continued on conservative management till 6 PM on 12.4.2003 when Dr. Anil Khetrapal performed exploratory laprotomy on the patient. The condition of the patient deteriorated further as she went into septicaemic shock and became semi-conscious with a very poor general condition.
(2)On 13.4.2003 the patient in a state of coma, not responding to verbal commands or painful stimuli, and septicaemic shock, was shifted to Kukreja Hospital for ventilatory support.
(3)The patient had a cardiac arrest at 11 PM on 14.4.2003 and inspite of all resuscitative measures could not be saved; she was declared dead at 12.00 midnight.
In light of the findings made hereinabove, it is the decision of the Delhi Medical Council :-
That since the X-ray referred hereinabove of the patient carried out on 11.4.2003 exhibited gas under the diaphragm, which is a clear indication of perforation of a hollow viscous and the patient had normal BP and heart rate, abdomen was soft on 11.4.2003, exploratory laprotomy was warranted on 11.4.2003 itself. There was no indication to treat the patient conservatively. The failure to perform timely surgical intervention led to the moribund condition of the patient. The delay in advising and ensuring the surgery which was imperative under the circumstances

reflects failure on the part of Dr. G.S. Kohli to exercise reasonable degree of skill and care in the management of the case which was expected of a prudent doctor. The name of Dr. G.S. Kohli is removed from the State Medical Register of the Delhi Medical Council for a period of six weeks from the date of this Order, censure to be recorded.
