1. / Hutton Village is identified as an ‘Other Village’ in the settlement hierarchy in the NYM Local Development Framework. The application site is well beyond what constitutes the main built up area of the village, lying between the Gate House and Hutton Hall and for the purposes of the policies in the Local Development Framework it falls within open countryside. Core Policies B and J of the NYM Local Development Framework restrict new residential development in the open countryside to that which is proven as essential for farming, forestry or other essential land management activities. The current application does not relate to an essential need to live in the countryside and the personal circumstances of the applicant and health reasons put forward to support an exception to normal policy are deemed insufficient to set aside the above planning policy which restricts new housing in the open countryside.2. / The site lies within the extensive Hutton Village Conservation Area and adjacent to the Pease Court development a complex of Grade II listed properties. The proposal would conflict with the National Planning Policy Framework, the Hutton Lowcross Conservation Area Appraisal and Core Policy G and Development Policies 3, 4 and 5 of the NYM Local Development Framework in terms of failing the preservation of open space, views, the relationship between buildings and spaces and the setting of the Listed Buildings.
3. / The design of the proposed bungalow, whilst simple, relates poorly to the existing historic buildings which have a distinctively and elaborately Victorian architectural character, and the site, to the front of the principal frontage of the impressive stable block, detracts from the stable block's historical and architectural presence facing across the Park. As such the design of the proposal is not compatible with the surrounding buildings and fails to contribute to the character and quality of the environment and will result in the loss of an open space which contributes to the amenity, character and setting of the area. As such the proposal conflicts with Development Policy 3 and the National Planning Policy Framework which seeks high quality design appropriate to its setting.
Explanation of how the Authority has Worked Positively with the Applicant/Agent
The Local Planning Authority has acted positively and proactively in determining this application by identifying matters of concern with the proposal and discussing those with the Applicant. However, the issues are so fundamental to the proposal that it has not been possible to negotiate a satisfactory way forward and due to the harm which has been clearly identified within the reason(s) for the refusal, approval has not been possible.Guisborough Town Council
