Drugs, Poisons and Controlled Substances (Industrial Hemp) Regulations 1998

1.Objectives

The objectives of these Regulations are—

(a)to prescribe fees for the application and renewal of an authority to cultivate and process low-THC cannabis; and

(b)to prescribe fees and charges to be imposed by inspectors, including maximum fees and charges; and

(c)to authorise and require inspectors to impose fees and charges.

2.Authorising provisions

These Regulations are made under sections 62, 67 and 69M of the Drugs, Poisons and Controlled Substances Act 1981.

3.Definition

In these Regulations "the Act" means the Drugs, Poisons and Controlled Substances Act 1981.

4.Application fee and renewal application fee for an authority to cultivate and process low-THC cannabis

Reg. 4(1) amendedby S.R. No. 88/2004 reg.4(Sch. 1 item14.1).

(1)For the purposes of section 62(2) of the Act, the prescribed application fee for an application for an authority under section 62(1)(a) to possess, process, sell or supply cannabis seed which has been harvested from low-THC cannabis is 30 fee units.

(2)For the purposes of section 62(2) of the Act, the prescribed application fee for an application for an authority under section 62(1)(b) to cultivate and possess cannabis from seed which has been harvested from low-THC cannabis is 30 fee units.

(3)For the purposes of section 62(2) of the Act, the prescribed application fee for an application for an authority under section 62(1)(c) to possess, process, sell or supply cannabis which—

(a)is substantially free of leaves and flowering heads; and

(b)does not contain tetrahydrocannabinol in excess of 01 per cent—

is 30 fee units.

(4)For the purposes of section 67(1) of the Act, the prescribed fee for an application for renewal of an authority is 95 fee units.

5.Authorisation and determination of fees and charges imposed by inspectors

Inspectors are authorised and required to impose fees and charges of the amounts or rates specified in the Table of Fees and Charges below—

The Drugs, Poisons and Controlled Substances (Industrial Hemp) Regulations 1998, S.R.No.129/1998 were made on 27 October 1998 by the Governor in Council under sections 62, 67 and 69M of the Drugs, Poisons and Controlled Substances Act 1981, No.9719/1981 and came into operation on 27 October 1998.

The Drugs, Poisons and Controlled Substances (Industrial Hemp) Regulations 1998 will sunset 10 years after the day of making on 27 October 2008 (see section 5 of the Subordinate Legislation Act 1994).
