CUMBERLAND COUNTY COMMISSION QUARTERLYMONTHLY MEETING

JANUARY 17, 2012

Be it remembered that the Cumberland County Commission met inQuarterlyMonthly Session on Tuesday, January 17, 2012 at the Cumberland County Courthouse. Present and presiding wasCounty Mayor Kenneth Carey who called the meeting to order and invitedMinisterDewey Peterson from the New Beginnings Fellowship Church tooffer the Invocation and the Young Marines to lead the Pledge of Allegiance to the Flag of the United States of America. Also present at the meeting were County Clerk Jule Bryson, County Attorney Randal Boston, and the following County Commissioners:

A quorum being present, the Cumberland County Commission Meeting was opened in due form of law and the following proceedings were had to wit:

1. MINUTES OF DECEMBER 19, 2011MONTHLY CUMBERLAND COUNTYCOMMISSION

MEETING:

On motion of CommissionerHarvel, second by Commissioner Cramer, moved the minutes of the December 19,2011Monthly Commission Meetingbe approved, treat same as read, made a matter of record, and filed.

The motion to approve the minutes of the December 19, 2011 Commission Meeting carried by a roll voteof 18 ayes from the Commission.

2. RESOLUTION 01-2012-1-TO APPROVE TO EXTEND CYCLE OF EMS AMBULANCE UNIT #463 FOR

ANOTHER YEAR:

On motion of Commissioner Carter, second by Commissioner Hassler, moved to adopt resolution 01-2012-1.

Before a vote was taken on the resolution, Commissioner Lynch offered a friendly amendment to delete paragraphs 4 and 5 from resolution 01-2012-1 which read:

Whereas, after the date of June 30, 2013, EMS Unit #463 will be recycled and transferred to the Cumberland County Recycling Center; and any further exceptions of operational span/cycle time to this policy must be determined and/or recommended by the Emergency Services Committee for any requested exceptions;

Whereas, if the Cumberland County Commission does not approve this resolution to extend the usage of EMS Unit #463, the only option would be to allocate funds from the fund balance for the purchase of a new EMS Unit.

Commissioner Lynch noted that he supported the exception to extend the life of the ambulance but his viewpoint was that some language in the resolution was inappropriate since a vehicle cannot be transferred from one county entity to another without requiring a budget line item and he further advised that before funds can be allocated

from the sale of the ambulance, the Budget Committee and full Commission must decide what the alternatives are.

Commissioner Sabineexpressed his concerns about the risk of making exceptions to the Ambulance Service Policy, however Emergency Services Director Jeff Dodson remarked that it would be unreasonable and expensive for the County to replace a valid ambulance and that if the resolution passed to extend the usage of EMS Ambulance Unit #462 for one more year, the one time policy change would only affect Cumberland County.

With Commissioners Carter and Hassler agreeing to accept the friendly amendment proposed byCommissioner Lynchto edit resolution 01-2012-1, the motion to allowtheCumberland County EMS Ambulance Unit #463 operational cycle span to be extended an additional year through June 30, 2013carried by a roll call vote of 15 ayes from the Commission with Commissioners Sabine, Harvel, and Brown voting no.

3. RESOLUTION 01-2012-2-TO ASK LEGISLATIVE DELEGATION TO MAKE THE SALE OF

SYNTHETIC DRUGS A FELONY AND REQUEST SUPPORT BY THE SURROUNDING COUNTIES:

On motion of CommissionerPresley, second by Commissioner Cramer, moved to adopt resolution 01-2012-2

After the County Attorney receivedand answered questions from Commissioners about what misdemeanor charges and penalties were involved for theoffense of selling controlled substances, Mr. Boston explained that since a statute is already in place in the State which bans the sale of synthetic drugs his conclusion was that the intent of resolution 01-2012-2 was to encourage legislation that would create uniformity in the law to prohibit the production, distribution, and possession of artificial or man-made drugs for all Tennessee Counties.

The motion to adopt resolution 01-2012-2,that Cumberland County legislative delegation be asked to write and

pass comprehensive legislation to make the manufacturing, distribution, and selling of synthetic drugs a felony in

the State of Tennessee, carried by a roll call vote of 18 ayes from the Commission.

COUNTY OFFICIAL REPORTS:

County Attorney,Randal Boston spoke briefly about the Supreme Court decision in theSmith Mountain

Solutions, LLC Court Case and the monthly financial report forlocal option sales tax, patient charges, and

hotel/motel tax collections were presented by Finance Department Employee, Jennifer Turner.

EMERGENCY SERVICES COMMITTEE AND HEALTH AND SAFETY STANDARDS BOARD:

Nancy Hyder, Chairperson for both the Emergency Services Committee and the Health and Safety Standards Board, reported to Commissioners the Emergency Services Committee was still continuing to work on the radio communications problems andin view of the fact thatthe Health and Safety Standards Board consisted of four new members, officers were appointed at the Health and Safety Standards Board January Meeting.

4. ELECTION OF NOTARIES:

On motion of CommissionerFoster, second by Commissioner Harvel, moved that Joan E. Adams, Barbara A. Hassler, Margaret E. Jodarski, Sharon B. Kerley, Karen McBride, Angie D. Patterson, Gregory K. Selby, Dawn R. Shaw,and Brittany Wilson be elected as Notary Publics for the State of Tennessee.

The motion to approve the notaries carried by a roll call vote of 18 ayes from the Commission.

COMMENTS:

Dann Dunham addressedthe Board to voice his concerns about the Crab Orchard Utility District taking over the

South Cumberland Utility District and he urged Commissioners to research all the information available to them

before allowing a take-over attempt that the residents did notsupport.

5. ADJOURNMENT:

On motion of CommissionerFoster, second by Commissioner Hyder, moved the January 17, 2012Quarterly Monthly Commission Meeting be adjourned at 6:35 o’clock P.M.

The motion to adjourn the meeting carried by unanimous voice vote from the Commission.
