Terms and conditions
Parties to application
The “Centre” refers to Melbourne City Council (MCC) trading as Melbourne City Baths. The “Customer” refers to you.
Swimming outside class times
Your chosen membership entitles you to reciprocal swimming access to Melbourne City Baths, North Melbourne Recreation Centre, Carlton Baths and Kensington Community Recreation Centre outside class times upon presentation of your membership card. To find out more, visit melbourne.vic.gov.au/mcb[1].
Child supervision
Melbourne City Baths is an accredited Platinum Pool and Watch Around Water facility. As such all children under 12 years of age must be actively supervised by a responsible person 17 years or older while in the Centre. All children under 5 years of age must be within arm’s reach of a responsible person 17 years or older whilst in the water. This applies for Aquatic Education and general access.
Liability
Despite foreseeable risk and the probability of serious harm, the burden of taking reasonable precautions to avoid the risk of harm lies with the Customer. These risks include, but are not limited to, loss or damage to personal property, injury or fatality. The Customer acknowledges and agrees that they use the Centre at their own risk. If the customer suffers injury or illness, the Centre and/or its employees or contractors may arrange medical treatment as deemed essential for the safety of the Customer.
Customer conduct
Inappropriate behaviour – physical, verbal or otherwise – by customers towards any employee, contractor, member or guest of the Centre may result in cancellation of membership or multi-visit pass and/or removal from the premises. The centre reserves the right to refuse entry to any person, request any person to leave and/or cancel any membership or multi-visit pass in accordance with these terms and conditions. Items that in the opinion of a Centre employee could cause harm or public nuisance are not permitted within the Centre.
Facility etiquette
Facility etiquette is displayed in prominent locations throughout the Centre. Customers are required to abide by this etiquette at all times.
Administration fee
It is the Customer’s responsibility to ensure that funds are available in the nominated account. Should your payment be dishonoured, an additional $20.00 administration fee will be charged to your outstanding direct debit amount. These fees will be required to be paid in full upon your next visit or the Centre will retrieve any outstanding funds on your next scheduled debit day. In the event of payments being dishonoured on two consecutive occasions or when eight or more consecutive classes are missed, the Centre reserves the right to terminate your membership.
Customer details
The Customer is responsible for notifying the Centre of any changes to their personal details by completing a customer amendment form available at the Centre or by completing the online change of personal details form.
Disputes
If you dispute any direct debit payment, suspension or cancellation related to your membership, you must notify the Centre in writing within 30 days. It is the Customer’s responsibility to retain a record any communication on disputes for verification purposes.
Enrolment
The aquatic education membership is ongoing unless a cancellation request has been successfully processed. Classes will operate during the Victorian state school term only, with no classes held on public holidays. Enrolment is non-transferable. It is your responsibility to know the start and finish dates of the relevant term. This information is available on the Centre website or by calling 9658 9011.
Class/level changes
The Customer may request to move their current class time once per aquatic education term. Changing classes is dependent on class availability. Customers may be moved to the next level at any time during the aquatic education term. Once the student displays competency in all skills for their level, in accordance with the aquatic education program, the teacher will instruct them to speak to reception staff and book into a class in the appropriate level.
Medical suspension
Suspension is only available for medical reasons with a minimum of two week absence and a medical certificate provided. Suspensions will only take effect upon receiving written notice and a medical certificate via the completion of a customer amendment form or by emailing . A medical certificate must be provided within two weeks of first class missed.
Missed class policy
We do not offer make up classes or refunds for missed lessons without a medical certificate.
Cancellation
The Customer may cancel their lessons by completing a cancellation form at reception or available online at melbourne.vic.gov.au/mcb1. It is the Customer’s responsibility to confirm the cancellation notification has been received and retain a copy of the cancellation communication. Facsimile will not be accepted. A period of 14 days written notice must be given, with one further debit charged within the 14 day period. Should there be any arrears in payments prior to cancellation, the Customer authorises the Centre to debit the outstanding balance in order to bring the account up to date, including a $20 administration fee if applicable.
Membership conditions
The Centre reviews prices and operations annually, taking effect 1 July. Intended pricing changes are displayed in the Centre from 28 May and written notice is sent to the Customer’s last known email address. It is the Customer’s responsibility to provide the Centre with any change of personal details. In the event that the initial membership conditions are to change we will provide 30 days notice. Operating hours
The Centre reserves the right to alter operating hours as required. Operating hours can be viewed at melbourne.vic.gov.au/mcb1.
Locker tokens
A locker token can be collected from reception for use when you are attending the Centre for your lesson and during free swimming outside of lesson time.
Aqua nappies
All children who are not toilet trained or newly toilet trained must wear an aqua nappy whist in the pool.
Damaged or lost cards
It is the Customer’s responsibility to ensure that your membership card is not damaged or lost. If your membership card is damaged or lost you will be required to pay a $10.50 replacement fee.
