Old Mill Pointe Architectural Committee Charter

A.Mission Statement

To ensure that all modifications, additions, improvements, and/or changes to the exterior of homes, buildings, property and land adhere to and are consistent with the communities architectural design scheme, by-laws, declarations and architectural guidelines.

B.Powers

The Architectural Committee shall be empowered as follows:

1.To review all applications for modifications, additions, improvements, and/or changes to the exterior of homes, buildings, property and land;

2.To make recommendations to the Old Mill Point Homeowners Association Board of Directors (OMP HOA BOD) for approval, denial, or no action required on all applications for modifications, additions, improvements, and/or changes submitted to the OMP HOA BOD;

3.To ensure that the architectural design scheme of the community is maintained and the by-laws, declarations and architectural guidelines are complied with;

4.Final approval of all applications as well as enforcement is the sole responsibility of the OMP HOA BOD and not the committee;

5.A recommendation from the committee is not an approval or disapproval of the applications. Only the OMP HOA BOD can approve or disapprove;

6.To ensure that there is a publication of the results and recommendations of all applications sent to the committee after a decision is made by the OMP HOA BOD;

7.To maintain a historical record of the applications, recommendations and decisions of the OMP HOA BOD;

8. Commencement of work on any application which receives final approval from the OMP HOA BOD must begin within 90 days of the date of final approval or the application and approval thereto automatically expires and/or terminates, and a new application must be submitted;

9.Work on any application that has received final approval from the OMP HOA BOD must be completed within one year of the date of the final approval from the OMP HOA BOD. At the expiration of that one year period, approval and authority to commence or continue work automatically expires and/or terminates and a new application must be submitted;

10.The application, name and address of the applicant, committee’s recommendation, and the final approval of the OMP HOA BOD will be posted on a separate committee website contained within the Old Mill Point website.

C.Procedures

1.The committee will meet on the first Monday of each month at 7 p.m. or as required at various homes of the committee members;

2.Applications for modifications, additions, improvements and/or changes must be submitted to the OMP HOA BOD (not the committee) by the 15th of the prior month to be considered at the next month’s committee meeting;

3.All procedures listed and required in the by-laws, declarations, and architectural guidelines must be complied with for an application to be considered by the committee and the OMP HOA BOD, including by not limited to the following:

a.the OMP Architectural Request Change Form must be utilized and completed in its entirety, this form may be amended from time to time by the OMP BOD;

b. all adjacent and/or contiguous neighbors, including neighbors across a roadway/street from the applicant must be notified of the application and must sign the application confirming that they have been advised of the building project contained within the application, prior to submission;

c.a full detailed description of the requested modification, addition, improvement and/or change must be included in the application, including but not limited to dimensions, colors, location, etc;

d.a plan/drawing with scale elevations and measurements as required in the architectural guidelines can at the option of the applicant be submitted with the application to assist the committee in their recommendation, or later to the OMP HOA BOD if a recommendation for final approval is made by the committee. This plan/drawing must be submitted pursuant to the architectural guidelines to the OMP HOA BOD prior to the OMP HOA BOD being able to consider for approval the application;

e. once the committee has decided and made its recommendation to the OMP HOA BOD on any application, the applicant will be notified that a recommendation has been made and advised to submit a plan/drawing as required in the architectural guidelines to the OMP HOA BOD if same was not previously submitted.

f. committee meetings will be open to anyone wishing to attend or to provide input with regards to any submitted application. It is suggested that contact with a committee member be made to determine the location of each month’s meeting and whether the date for some reason has been changed.
