Job Summary

Works with prime and subcontractors to ensure compliance with prevailing wage requirements. Keeps abreast of Federal and State laws and other relevant information including Davis-Bacon and Related Act (DBRA), Federal Rate tables, etc. Ensures complete understanding and full administration of “Bona-Fide” fringe benefits under DBRA, including life insurance, health insurance, pension, vacation, etc. Reviews certified payrolls and appropriately addresses delinquent certified payrolls. Conducts wage rate interviews. Visits job sites to ensure appropriate labor and other related posted information. Performs other duties of a similar nature as may be required.

Essential Functions

  • Represents the District’s interests by attending pre-bid and/or pre-construction meetings. Gathers information pertinent to assist with related decision-making. Explains prevailing wage rate requirements and contractor’s responsibilities.
  • Keeps abreast with all applicable laws, federal, State and local. Maintains updated knowledge regarding wage and hour, Fair Labor Standards Act (FLSA), Davis-Bacon and Related Act, and other applicable Laws. Serves as lead on prevailing wages as issued by the Ohio Department of Commerce, Wage and Hour Bureau, etc. Keeps abreast with apprenticeship laws and relative guidelines. Ensures apprenticeships don’t exceed ratio permitted in wage and hour schedule. Confirms all appropriate apprenticeship registration with Ohio State Apprenticeship Council. Ensures appropriate examination of any apprenticeship agreement.
  • Ensures accurate quality assurance of contractor and subcontractors’ payroll records. Ensures records reflect necessary information including signed time records, daily work records, completed payroll ledger/journals, fringe benefit records, Statutory Agent in Ohio if out of state contractor, etc. Systematically audits information and takes appropriate actions.
  • Conducts analysis on job design and legitimacy of jobs.
  • Sets up and maintains files containing all contractors’ and subcontractors’ payroll reports, affidavits, and related documents, to be available for public inspection and reference. Obtains all pertinent information and documentation from contractors and subcontractorsrequired to complete projects.
  • Supplies contractors with any changes in Prevailing Wage Rates and other related information.
  • Establishes and follows procedures to monitor compliance by contractors and subcontractors for all projects. Visits project sites to verify posting requirements and job classifications. Reviews certified payroll reports to ensure they are submitted in a timely fashion and all necessary information is obtained. Compares rates and fringes reported to rates in prevailing wage schedule. Requires affidavit of compliance from each contractor and subcontractor upon project completion.
  • Reports any non-compliance to the Ohio Department of Commerce, Division of Labor & Worker Safety, Wage and Hour.
  • Conducts site audits in response to personal claims of non-compliance with prevailing wage rates on the part of construction contractors. Interviews claimants (contractor employees), collects witness statements, observes work being performed, and collects payroll documents and work order/assignment sheets. Conducts job studies of work being performed by claimant(s). Exercises judgment when matching documented activities to the most appropriate work group / title for which a prevailing wage rate exists. Analyzes payroll documents to determine pay rates provided employees of project contractors; matches rates being paid with work being performed and amount of time it was performed. Determines variance (if any) from prevailing wage rate(s) in effect for work activities. Upon determining that inappropriate rate(s) are being paid, calculates appropriate back wages and benefits to be paid to affected employees; determines liquidated damages to be assessed against the contractor - following guidelines specified in the contract. Prepares appropriate report of findings, documentation and recommended course(s) of action. Presents findings to contractor/ management and the District’s Law department.
  • Performs other duties of a similar nature as may be required. Conducts regular and annual surveys, as necessary. Coordinates and approves/disapprove additional wage rate requests, sent by Contractors. Receives and distributes general wage decisions from the U.S. Department of Labor. Ensures appropriate training for various areas of concerns including the Davis-Bacon and Related Act, Safety Standards Act, etc. Writes and maintains related procedural manual, forms, etc.
