Notice of public hearing availability
Proposed improvements of Tyler Avenue and intent to acquire property rights in Osceola County to be discussed in Sibley, Iowa on August 2, 2017
All interested persons are invited to attend a public hearing between 8:50 AM and 9:30AM at the Osceola Board of Supervisors Board Room 300 Seventh Street, Sibley, Iowa. The purpose of the public hearing is to discuss the proposed improvements to Tyler Avenue in Ocheyedan, IA. The proposed improvements begin in the South at the intersection of 170th Street and Tyler Avenue then commence North to Highway 9. Additionally this public hearing is to gather feedback from the public regarding the identified planned improvements, and the intent to acquire property rights for the proposed improvements. Right-of-Way impacts for the programmed project from 170th street to Highway 9 approximately a 2 mile corridor.
Osceola County Board of Supervisors, Osceola County Engineer, Engineers from Schlotfedt Engineering (contracted to design the proposed project), and representatives from JCG Land Services, Inc. (contracted Right-of-Way personnel) will be available to discuss the project following the formal presentation scheduled to begin at 8:50AM. Oral and written statements will be accepted during both the open forum and the formal sessions. Written statements and related exhibits, in place of or in addition to oral statements made at the public meeting, will be accepted at the meeting or may be submitted to the Board of Supervisor’s Office located at 300 7th Street, Sibley, IA 51249. All written comments received by July 27th, 2017 will be included in the project transcript. Interested individuals are encouraged to attend to express their views and ask questions about the proposed improvement.
NOTICE TO PROPERTY OWNERS
When Osceola County is proposing to acquire property and/or property rights under the power of eminent domain for public improvement project it is required to give notice of a public hearing to all owners and contract purchasers of record of agricultural land which may be subject to condemnation.
Proposed improvements: Notice is hereby given that the County of Osceola Board of Supervisors will consider the project described above.
Private property may be acquired by purchase or condemnation: If the Osceola Board of Supervisors approves the project described above, Osceola County will be required to acquire property rights for the proposed improvements. Osceola County will attempt to purchase the required property rightsby good faith negotiations; however, it may condemn those properties it is unable to purchase the needed property rights through eminent domain. The proposed location of the public improvements described above is shown on preliminary plans for the project. Preliminary plans are available from the Osceola County Engineers office located at 300 Seventh Street, Sibley, IA, 51249.
Process to decide to fund the design, approve the route location, or acquire or condemn property interests: To acquire the necessary properties and property interests required for the project, the Osceola County Board of Supervisors are required to approve the project location. The Osceola County Board of Supervisors will hold a public hearing, to present the proposed improvements and potential impacts as a result of the improvements. Persons, whose property may be affected by the project, as well as the general public, may comment on the project at the public hearing, Based in part on the information received at the hearing, the Osceola Board of Supervisors will adopt the proposed project location and determine whether to fund the site-specific design and to authorize by purchase or condemnation the acquisition of right of way for the project.

This notice is given by the authority of the Osceola County Board of Supervisors and is not an offer to buy land not is it an offer to provide relocation assistance. Affected property owners are not required to move from their residences or relocation their businesses at this time. Eligibility for relocation benefits will not occur until after an offer to purchase has been made to individual property owners.
