ITEM 101 – CLEARING

Note to Designer:Use the version of Item 101 below based on the type of contract:

  • Grading & Grading/Paving – modified clause
  • Clearing contracts – Replace Entire Item
  • Wildlife fence contracts – Replace Entire Item

Note to Designer:For clearing on grading or grading/paving contracts, use the following rule of thumb:

  • Qty < 1 ha, or if the work is scattered over several locations, consider making the clearing incidental to Item 102.

Note to Designer:This clause is to be added only if there is clearing to be done in a buffer zone and only if clearing is to be done when the ground is frozen.

101.4.9.2The Contractor shall be responsible, at his/her own expense, to carry out any remedial measures necessary to redress any disturbed areas, including but not limited to shaping, hydroseeding and/or mulching of the exposed ground.

ITEM 101 – CLEARING(Replace entire item)

101.1Description

101.1.1This Item consists of cutting and salvaging Merchantable Timber, and disposing of all other trees, brush and slash.

101.1.2Merchantable timber is defined as any timber for which the Contractor can find an established market in the general vicinity of the Contract.

101.2Materials

101.2.1None identified.

101.3Submittals

101.3.1The Contractor shall submit, upon request, a copy of any permit(s) required to carry out the Work.

101.4Construction

101.4.1The Contractor shall carry out the Work as indicated in the Contract Documents and/or as specifically directed by the Engineer.

101.4.2The Engineer will identify clearing limits and buffer zone limits with ribbons or similar means.

101.4.3Merchantable timber shall be salvaged, unless otherwise approved by the Engineer. Salvaged material shall become the property of the Contractor and shall be removed from the Work Site by the Completion Date.

101.4.4Before commencing clearing on any part of the Work Site that had been Crown Land under licence, the Contractor shall offer to sell to the former licensee all Merchantable Timber involved.

101.4.4.1The price shall be the current price negotiated between the former licensee and the Forest Products Marketing Board responsible for the area in which the timber is harvested.

101.4.4.2If the former licensee decides to purchase the cut timber, the Contractor shall perform the Work to the former licensee’s specifications.

101.4.5The driver of any vehicle transporting wood from the Work Area(s) shall have in the vehicle a Transportation Certificate (TC) for “Crown Land Permit Harvest” for each load.

101.4.5.1In filling out the TC, “Other” (in the top right corner) use “DTI ROW”; under “Harvest Block No.” shall be “xx-xxxx” (the Contract number); and the place name of the clearing location shall be identified.

101.4.6Trees shall be cut so that stump height is not greater than 0.3 m above average ground level, or in the event of significant snow cover, to a height as agreed with the Engineer.

If it is known that there are surface boulders include 101.4.6.1

101.4.6.1The Contractor shall cut trees off only as far into the snow as practicable without risking damage to his Equipment or injury to his workers, and the resultant stump height will be considered acceptable.

101.4.7Nonmerchantable trees not felled by cutting may be shredded in place (to a stump height per 101.4.6) using Equipment designed for that purpose, but shall not be bulldozed down.

Note to Designer:This clause is to be added only if there is clearing to be done in a buffer zone and only if clearing is to be done when the ground is frozen.

101.4.7.1Shredding, chipping, or placement of shredded or chipped material shall be permitted inside of the right-of-way and material shall be prevented from entering any watercourse or wetland.

101.4.7.2All other non-merchantable trees, and all brush and slash shall be shredded or chipped and evenly distributed over the ground within the clearing limits.

101.4.7.3Disposal by burning is prohibited.

101.4.7.4Notwithstanding 101.4.7.1 to 101.4.7.3, all non-merchantable trees, brush and slash shall be disposed of such that the Engineer can set and grade stakes for cut and fills, set stakes for top of slope and toe of slope; and survey cross-sections.

Include 101.4.7.4.1 only if applicable

101.4.7.4.1Nonmerchantable trees, brush or slash shall not be left or placed between Stations ____ and ____.

101.4.8Ornamental trees and shrubs shall not be disturbed without written permission from the Engineer.

101.4.9The Contractor shall limit ground disturbance to minimize the potential for erosion and sedimentation of watercourses and wetlands.

101.4.9.1Directional hand felling and harvesting shall be used where ground conditions are not suitable for access by heavy Equipment. When cable skidders are used, the full range of the cables shall be made to avoid rutting soft ground areas.

101.4.10Clearing shall not be performed within wetland buffer zones unless such areas are frozen hard, except to provide access through the buffers, as approved by the Engineer.

101.4.11The Contractor shall not use heavy Equipment for clearing within 10 m of stream banks and shall do cutting therein by hand or by Equipment able to “reach in” to cut and yard out the timber.

101.4.12Initial clearing of merchantable timber within 5 m of either side of watercourses identified on the Plans, and any other watercourses identified during the course of the Work, shall be limited to removal of merchantable timber.

101.4.12.1Non merchantable timber shall be removed at the time of the Structure installation.

101.4.13There shall be no long skids of timber on steep slopes adjacent to watercourses, and no felling or skidding trees across a watercourse.

101.4.13.1Where clearing of a steep slope in snow or ice conditions is suspended through a written order by the Engineer or a representative of Work Safe NB for safety reasons, the Contractor shall cease Work immediately.

101.4.13.2In the case of Work suspension per 101.4.13.1, the Contractor will not be responsible to complete clearing on the affected area.

101.4.14No stockpiling or loading of merchantable timber or waste materials, adjacent to the highway will be permitted except under unique circumstances, which shall require a written request to and written approval from the Engineer.

101.5MEASUREMENT FOR PAYMENT

101.5.1The Quantity to be measured for payment will be the number of hectares of land cleared in accordance with this Item.

101.5.1.1All measurements will be made in a horizontal plane.

101.5.2The areas of removal of merchantable trees within 5 m of watercourses per 101.4.12 shall be measured for payment as clearing.

101.5.3The measurement of clearing on any steep slope on which Work was suspended per 101.4.13.1 and not resumed will be as agreed between the Engineer and the Contractor.

101.6BASIS OF PAYMENT

101.6.1Payment for Work under this Item shall be at the Unit Price.

Use this version for Wildlife Fence Projects (Item 702, etc.)

ITEM 101 – CLEARING(Replace Entire Item)

101.1Description

101.1.1This Item consists of cutting and salvaging of merchantable timber and disposing of all other trees, brush, slash and scrub along both sides of Route __, from _____ to _____, approx. _____ km, to allow for the installation of the wildlife fence and appurtenances.

101.1.1.1The Work shall also be performed along Route __ / the ramps and minor road at the ______Interchange.

101.1.2Merchantable timber is defined as any timber for which the Contractor can find an established market in the general vicinity of the Contract.

101.2Materials

101.2.1None identified.

101.3Submittals

101.3.1The Contractor shall submit, upon request, a copy of any permit(s) required to carry out the Work.

101.4Construction

101.4.1The Contractor shall carry out the Work as indicated in the Contract Documents and/or as specifically directed by the Engineer.

101.4.1.1The clearing limit is defined as being 3 m behind the future wildlife fence line as staked by the Engineer.

Include 101.4.1.2 if appropriate, modified as applicable

101.4.1.2Areas of scrub and similar growth not shown on the Plans but which will interfere with the Work under Item 702, 703 or 705 shall also be cleared.

101.4.2The Engineer shall identify clearing limits and buffer zone limits with ribbons or similar means.

101.4.3Merchantable timber shall be salvaged, unless otherwise approved by the Engineer. Salvaged material shall become the property of the Contractor and shall be removed from the Work Site by the Completion Date.

  • Not more than 0.15 m above average ground level, or as otherwise required for access of fence installation Equipment; and
  • Flush with the existing ground for 0.5 m each side of the fence line.

If a trail exists along the tree line, include 101.4.6.1

101.4.6.1Stumps shall be cut flush with the existing ground within the 3.0 m cleared zone behind the fence line adjacent to the trail easement located on the _____ side between approximate Stations ______and ______.

101.4.7Nonmerchantable trees not felled by cutting may be shredded in place (to a stump height per 101.4.6) using Equipment designed for that purpose, but shall not be bulldozed down.

Note to Designer:This clause is to be added only if there is clearing to be done in a buffer zone and only if clearing is to be done when the ground is frozen.

101.4.8Ornamental trees and shrubs shall not be disturbed without written permission from the Engineer.

101.4.9The Contractor shall minimize ground disturbance to minimize the potential for erosion and sedimentation of watercourses and wetlands.

101.4.9.1Directional hand felling and harvesting shall be used where ground conditions are not suitable for access by heavy Equipment. When cable skidders are used, the full range of the cables shall be made to avoid rutting soft ground areas.

101.4.9.2Ground exposed by the Work shall be mulched per 616.4 the day of exposure, and upon completion of clearing Work all damaged slopes shall be reshaped to match adjacent undisturbed ground and hydroseed.

101.4.10Clearing shall not be performed within wetland buffer zones unless such areas are frozen hard, except to provide access through the buffers, as approved by the Engineer.

101.4.11The Contractor shall not use heavy Equipment for clearing within 10 m of stream banks and shall do cutting therein by hand or by Equipment able to “reach in” to cut and yard out the timber.

101.5MEASUREMENT FOR PAYMENT

101.5.1The Quantity to be measured for payment shall be the number of hectares of land cleared in accordance with this Item.

  • For grubbings placed in deep fills, base the quantity calculations on 102.4.6.1 (fills 5 to 6 m high) or 102.4.6.2 (fills > 6 m high).
  • If grubbings can be buried within the right-of-way at locations other than deep fills, add 102.4.6.3.1:
