O R D E R
The Delhi Medical Council through its Executive Committee examined a complaint of Shri Anil Kumar r/o. Village Bagdola, Sector-8, Dwarka, New Delhi – 110075 (referred hereinafter as the complainant), alleging medical negligence on the part of Dr. Rajkumar and Dr. B.N. Pati of Ayushman Hospital, in the treatment administered to the complainant at Ayushman Hospital, Sector-XII, Dwarka, Delhi – 110075 (referred hereinafter as the said Hospital).
The Order of the Executive Committee dated 10th October, 2012 is reproduced hereinbelow :-
“The Executive Committee of the Delhi Medical Council examined a complaint of Shri Anil Kumar r/o. Village Bagdola, Sector-8, Dwarka, New Delhi – 110075 (referred hereinafter as the complainant), alleging medical negligence on the part of Dr. Rajkumar and Dr. B.N. Pati of Ayushman Hospital, in the treatment administered to the complainant at Ayushman Hospital, Sector-XII, Dwarka, Delhi – 110075 (referred hereinafter as the said Hospital).
The Executive Committee perused the complaint and documents submitted therewith.
The Executive Committee observed that the complainant had a comminuted fracture of tibial plateau with fracture of the neck of fibula. The complainant had a common peroneal nerve palsy after open reduction and internal fixation of the fracture. This is a known complication of such comminuted fracture. The doctor treated the complainant, recognized this complication in the early post-operative period and have taken adequate care for its treatment.
In light of the observations made hereinabove, it is the decision of the Executive Committee that prima-facie no medical negligence can be attributed on the part of part of Dr. Rajkumar and Dr. B.N. Pati of Ayushman Hospital, in the treatment administered to the complainant at Ayushman Hospital.
Complaint stands disposed.”
