O R D E R

The Delhi Medical Council through its Executive Committee examined a complaint of Shri Lalit Seth r/o. 3A, Bharat Apartment, Plot No. 31, I.P. Extn, New Delhi – 110092, forwarded by Medical Council of India, alleging medical negligence on the part of Dr. Nirupama Goyal of Goyal Hospital and Urology Centre, in the treatment administered to complainant’s wife Smt. Priyanka Seth at Goyal Hospital & Urology Centre, E-4/8, (Lajpat Rai Chowk), Krishna Nagar, Delhi – 110051, resulting in death of her new born baby.

The Order of the Executive Committee dated 28th January, 2015 is reproduced herein-below :

“The Executive Committee of the Delhi Medical Council examined a complaint of Shri Lalit Seth r/o. 3A, Bharat Apartment, Plot No. 31, I.P. Extn, New Delhi–110092(referred hereinafter as the complainant), forwarded by the Medical Council of India, alleging medical negligence on the part of Dr. Nirupama Goyal of Goyal Hospital and Urology Centre, in the treatment administered to the complainant’s wife Smt. Priyanka Seth (referred hereinafter as the patient) at Goyal Hospital & Urology Centre, E-4/8, (Lajpat Rai Chowk), Krishna Nagar, Delhi – 110051(referred hereinafter as the said Hospital), resulting in death of her new born baby.

The Executive Committee perused the complaint, joint written statement of Dr. Nirupama Goyal and Dr. D.Rai, Medical Superintendent, Goyal Hospital & Urology Centre, copy of medical records of Goyal Hospital & Urology Centre and other documents on records.

The Executive Committee observes that the patient was registered with Dr. Nirupama Goyal at the said Hospital. The patient has had normal pregnancy and routine antenatal care was given to her. The patient was admitted in labour at 1:00am on 22nd August, 2013 and

was attended to by doctor on duty. The patient was monitored during at labour and according to records had normal vitals and no signs of fetal distress were observed. Dr. Nirupama Goyal visited at 11:00am on 22nd August, 2013. The progress of labor was normal. The patient had spontaneous vaginal delivery. There was a tight loop of cord around neck and the baby had no spontaneous respiration and heart beat. Resuscitation was provided by the paediatrician on duty and the baby was transferred to the Max Hospital for further management. Possibility of short and tight cord around the neck can lead to such an eventuality.

In view of observations made herein-above, it is, therefore, the decision of the Executive Committee that prima-facie no case of medical negligence is made out on the part of Dr. Nirupama Goyal of Goyal Hospital and Urology Centre, in the treatment administered to complainant’s wife Smt. Priyanka Seth at Goyal Hospital & Urology Centre.

Complaint stands disposed.”
