At their meeting on 16 October 2013 the Planning Committee of the Regulatory Committee on behalf of the County Council resolved, for the purposes of Regulation 3 of the Town and Country Planning General Regulations 1992 to grant planning permission for the development referred to above and a copy of the Decision Notice is attached.

In pursuance of their powers under the above mentioned Act, Order and Regulations, the Council as the local planning authority hereby GRANT PLANNING PERMISSION for Demolition of the existing caretakers accommodation. Construction of new entrance and reception area together with new single storey extension to rear of site containing specialist teaching rooms. Internal alterations to existing school buildings and external landscaping to create a new sixth form centre for SeafordHeadAcademy. Seaford Head Old School Annexe, Steyne Road, Seaford, BN25 1QG (Within land edged red on applicants plan no. BVR/1000) in accordance with your application validated by the Director of Economy, Transport & Environment, East Sussex County Council on 9 August 2013 and the plans and particulars submitted in connection therewith and listed below and subject also to due compliance with the condition(s) specified here under:-

1.The development hereby permitted shall be commenced before the expiration of three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990.

2.The development hereby permitted shall be carried out in accordance with the plans listed in the Schedule of Approved Plans.

Reason: For the avoidance of doubt and in the interests of proper planning.

3.Development shall not commence above ground level until samples of the materials to be used in the construction of the external surfaces of the extensions hereby permitted have been submitted to and approved in writing by the Director of Economy, Transport and Environment. Development shall be carried out in accordance with the approved details.

Reason: To ensure the appropriate appearance of the development in the area in accordance with Policy ST3 of the Lewes Local Plan 2003.

4.No demolition or construction shall take place in connection with the approved development at any time other than between 0730 and 1830 on Mondays to Fridays and, between 0800 and 1300 on Saturdays and at no time on Sundays, Bank and Public Holidays unless the prior written agreement of the Director of Economy, Transport and Environment has been given.

Reason: To help safeguard the amenities of the occupiers of properties in the vicinity of the site and to comply with Policy ST3 of the Lewes Local Plan 2003.

5.The noise rating level from the plant associated with the fume cupboard shall, at all times, not exceed 45 dBLAeq, 1hr (facade) at the noise sensitive receptor to the immediate north of the site, as measured in accordance with BS 4142: 1997.

Reason: In accordance with NPPF paragraph 123 which states planning decisions should aim to avoid noise from giving rise to significant adverse impacts on health and quality of life, and should reduce to a minimum adverse impacts on quality of life.

6.The plant used as part of the fume cupboard shall not be operated outside of Centre opening times unless otherwise agreed in writing by the Director of Economy, Transport and Environment.

Reason: In the interests of neighbouring amenity and in accordance with Saved Policy ST3 of the Lewes District Local Plan 2003.

7.Details of the proposed flue, installed as part of the fume cupboard, shall be submitted to and approved in writing by the Director of Economy, Transport and Environment prior to the first occupation of the building for educational use. Details of the air filters and proposed maintenance of the equipment should be included.

Reason: In the interests of neighbouring amenity and in accordance with Saved Policy ST3 of the Lewes Local Plan 2003.

8.A Revised Travel Plan for the whole Seaford Head site, including the 6th Form Centre, shall be submitted to and agreed by the Director of Economy, Transport and Environment prior to the first occupation of the 6th form centre. The Travel Plan shall be developed in accordance with the County Council Travel Plan guidance and shall include targets for reduction in car use, a monitoring programme and remedial measures to ensure targets are met.

Reason: To increase awareness and use of alternative modes of transport for school journeys in accordance with the National Planning Policy Framework.

9.Prior to commencement of the development hereby permitted, the applicant shall submit a scheme for the provision of an additional 11 car parking spaces and an area for powered two wheelers to be provided within the Lower School (Steyne Road) site, or such other measures to the satisfaction of the Director of Economy, Transport and Environment.

Reason: In the interests of highway safety and to accord with Saved Policy T14 of the Lewes District Local Plan 2003

10.The provisions of the scheme approved by condition 9 shall be implemented in full prior to first occupation of the development and the additional spaces provided shall thereafter be retained and shall not be used other than for the parking of motor vehicles and powered two wheelers.

Reason: In the interests of highway safety and to accord with Saved Policy T14 of the Lewes District Local Plan 2003

11.The development shall not be occupied until cycle parking areas, including the additional 15 stands, have been provided in accordance with details which shall be submitted to and approved in writing by the County Planning Authority and the areas shall thereafter be retained for that use and shall not be used other than for the parking of cycles.

Reason: To comply with Saved Policy T7 of the Lewes District Local Plan 2003.

12.The approved development shall not be occupied until details of hard and soft landscaping works have been submitted to and approved in writing by the Director of Economy, Transport and Environment and these works shall be carried out as approved.

These details shall include:

- Means of enclosure including details of the security mesh fencing

- Hard surfacing materials

- Any minor artefacts and structures (e.g. benches, lighting etc)

- Planting details, including shrubs, tree species and climbing plants included as part of the mesh fencing

- Implementation and maintenance programme (Management Plan)

The landscaped areas shall be planted and maintained thereafter in accordance with the approved Management Plan.

Reason: To secure appropriate landscaping at the site in the interests of the amenity and biodiversity of the locality in accordance with Saved Policy ST3 of the Lewes District Local Plan 2004.

13.No demolition or development shall take place until the developer has secured the implementation of a programme of archaeological work, in accordance with a Written Scheme of Archaeological Investigation which has been submitted to and approved in writing by the County Planning Authority.

Reason: To ensure that the archaeological and historical interest of the site is safeguarded and recorded to comply with the National Planning Policy Framework

14.The development hereby permitted shall not be brought into use until the archaeological site investigation and post investigation assessment has been completed in accordance with the programme set out in the Written Scheme of Investigation approved under condition 13 and that provision for analysis, publication and dissemination of results and archive deposition has been secured.

Reason: To ensure that the archaeological and historical interest of the site is safeguarded and recorded to comply with the National Planning Policy Framework

INFORMATIVES

1.The buildings to be demolished have previously been searched for bats. Although no previous evidence was found, if any evidence of bats is found during demolition, work should stop and advice should be sought from a suitably qualified and experienced bat ecologist.

2.Vegetation and buildings on site have the potential to support breeding birds. Under Section 1 of the Wildlife and Countryside Act 1981 (as amended), wild birds are protected from being killed, injured or captured, while their nests and eggs are protected from being damaged, destroyed or taken. To avoid disturbance to nesting birds, any demolition of buildings or removal of scrub/trees that could provide nesting habitat should be carried out outside the breeding season (generally March to August). If this is not reasonably practicable within the timescales, a nesting bird check should be carried out prior to any clearance works by an appropriately trained, qualified and experienced ecologist, and if any nesting birds are found, work must stop until the fledglings have left.

3.The applicant is advised that in accordance with the Site Waste Management Plans Regulations 2008, a Site Waste Management Plan is required for the development hereby permitted.

The Development Plan policies of relevance to this Decision are:-

Lewes District Local Plan 2003: Saved Polices ST3 (Design, form and setting of development), ST6 (Access for people with Limited Mobility), RE10 (Community Infrastructure), T1 (Travel Demand Management), T7 (Provision for Cyclists), T14 (Vehicle Parking)

Lewes District Council has undertaken an assessment of the Saved Policies in its Local Plan to evaluate their conformity with the NPPF. Saved Policies ST3, RE10, T1, T7 and T14 were considered to be fully consistent with the NPPF. Saved Policy ST6 is not considered fully consistent. Although it would not appear to conflict with the NPPF, this issue would be covered by other regulatory controls.

East Sussex, South Downs and Brighton & Hove Waste and Minerals Plan 2013: Policy WMP3D (Minimising and Managing Waste during Construction, Demolition and Excavation)

National Planning Policy Framework March 2012:

The National Planning Policy Framework (NPPF) was published on 27 March 2012 and the Framework applies with immediate effect. It does not change the status of the development plan as the starting point for decision making. It constitutes guidance as a material consideration in determining planning applications. Due weight should now be given to relevant policies in existing plans according to their degree of consistency with the NPPF. At the heart of the NPPF is a presumption in favour of sustainable development and regard should be had to NPPF policies so far as relevant. In this case, relevant paragraphs include 32, 36, 58 and 135.

Policy Statement on Planning for Schools Development: On the 15 August 2011 the Government issued, with immediate effect, a new policy statement on planning for school development. In this context, the policy statement states that the planning system, when dealing with planning applications for state-funded schools should operate positively and there should be a presumption in favour of the development of state-funded schools. The policy statement encourages a collaborative approach to applications, particularly encouraging pre-application discussions and the use of planning obligations to help mitigate adverse impact of developments. It further asserts that where it is necessary to impose conditions, they should be necessary in order to make the development acceptable and be clearly justified, thereby demonstrably meeting the tests as set out in Circular 11/95. The policy statement indicates that the Secretary of State will be minded to consider refusal of any application for state-funded schools to be unreasonable conduct, unless it is supported by clear and cogent evidence.

In determining this planning application, the County Council has worked with the applicant in a positive and proactive manner. The Council has also sought views from consultees and neighbours and has considered these in preparing the recommendation. This approach has been taken positively and proactively in accordance with the requirement in the NPPF and as set out in the Town and Country Planning (Development Management Procedure) (England) (Amendment No.2) Order 2012.
