I, Tyson Paul Sara, acting in accordance with the delegation of powers to me under section I3 of the Defence Enterprise Collective Agreement 2012 – 2014 (DECA) by the Secretary to the Department of Defence, hereby determine under section H10 of the DECA that the conditions for employees travelling and working overseas are to be adjusted as set out below.

The conditions of service amended by this determination are published in the Defence Pay and Conditions Manual Overseas Conditions of Service volume.

Definitions
For the purpose of applying the conditions in the Defence Pay and Conditions Manual Overseas Conditions of Servicevolume, the terms in the following table that apply to ADF members are to be taken to include the corresponding terms in the table that apply to APS employees, except where there is an express contrary intention (such as supporting a specified ADF operation):

Determination
I determine that table item 5 under subclause 17.10.7.2 (Rate of allowance) of Chapter 17 Part 10 Division 1 of the Defence Pay and Conditions Manual Overseas Conditions of Service volume, is amended with the following.
5. / Maritime operations including counter piracy in the specified area. / The seas and superjacent airspace of:
  1. The Arabian Sea;
  2. The Gulf of Aden;
  3. The Gulf of Aqaba;
  4. The Gulf of Oman;
  5. The Gulf of Suez;
  6. The Persian Gulf;
  7. The Red Sea;
  8. The Indian Ocean north of Latitude 15 degrees South and west of Longitude 68 degrees East;
This includes the ports adjacent and the area within a 10 kilometre radius of each port. / 83.77

Transitional
1. / This clause applies to an employee who meets both of the following conditions.
a. / They were assigned for duty in the operational area specified in clause 4 of this determination between 14 May 2015 and the commencement of this determination.
b. / They did not receive operational support allowance for the previous specified operational area for Maritime operations including counter piracy in the specified area.
2. / The employee is eligible for the payment of operational support allowance at the relevant daily rate set out in the following table for any day they met the conditions set out in subclause 1.
