RULE10

DUTYTOSELF-REPORTCERTAINMEDICALCONDITIONS

The purpose of this rule is to provide additional guidance regarding the duty to report certain medical conditions and eligibility for entering into a Confidential Agreement with the Director as set forth in § 12-29.7-113, C.R.S.

A.Nolaterthan30daysfrom thedateaphysicalormentalillnessorconditionthataffectsaregistrant’sabilitytoperformathletictrainingserviceswithreasonableskillandsafety,theregistrantshallprovidetheDirector,inwriting,thefollowinginformation:

1.Thediagnosisandadescriptionoftheillnessorcondition;

2.Thedatethattheillnessorconditionwasfirstdiagnosed;

3.Thenameofthecurrenttreatmentprovideranddocumentationfromthecurrenttreatmentproviderconfirmingthediagnosis,dateofonset,andtreatmentplan;and

4.Adescriptionoftheathletictrainer’spracticeandanymodifications,limitationsorrestrictionstothatpracticethathavebeenmadeasaresultoftheillnessorcondition.

B.TheregistrantshallnotifytheDirectorofanyworseningoftheillnessorcondition,oranysignificantchangeintheillnessorconditionthataffectstheregistrant’sabilitytopracticewithreasonableskillandsafety,within30daysofthechangeoftheillnessorcondition.TheregistrantshallprovidetotheDirector,inwriting,thefollowinginformation:

1.Thenameofthecurrenttreatmentprovider,documentationfromthecurrenttreatmentproviderconfirmingthechangeoftheillnessorcondition,thedatethattheillnessorconditionchanged,thenatureofthechangeoftheillnessorcondition,andthecurrenttreatmentplan;and

2.Adescriptionoftheregistrant’spractice,andanymodifications,limitations,orrestrictionstothatpracticethathavebeenmadeasaresultofthechangeofcondition.

C.CompliancewiththisruleisaprerequisiteforeligibilitytoenterintoaConfidentialAgreementwiththeDirectorpursuanttoSection12-29.7-113,C.R.S.However,merecompliancewiththisruledoesnotrequiretheDirectortoenterintoaConfidentialAgreement.Rather,theDirectorwillevaluateallfactsandcircumstancestodeterminewhetheraConfidentialAgreementisappropriate.

D.IftheDirectordiscoversthataregistranthasamentalorphysicalillnessorconditionthataffectstheregistrant’sabilitytopracticewithreasonableskillandsafety,andtheregistranthasnottimelynotifiedtheDirectorofsuchillnessorcondition,theregistrantmaybesubjecttodisciplinaryactionpursuanttoSection12-29.7-113,C.R.S.
