Preamble

TheDepartment of Education and Human DevelopmentintheEugene T. Moore School of Educationherebyestablishthefollowingbylawstoprovideamechanismforparticipationinplanning,policymakinganddecisionmaking,withregardtoacademicmattersandinmattersthatmayaffectthewelfareofitsmembersandthemissionoftheDepartment,School,andUniversity.

ArticleI.NameandVision

A.Name

Theofficialnameshallbe“Department of Education and Human Development”hereindesignated“EHD”.Thenameshallberepresentedonallofficialdocumentsandassociatedwithallofficialbusiness.

B.Vision

Clemson University’s Department of Education and Human Development (EHD) will prepare professionals to provide exemplary leadership and educational services to improve outcomes for ALL persons, with an emphasis on underserved schools and communities.

EHD will be a state and national leader in addressing issues within schools and communities by:

•Delivering outstanding practitioner preparation programs

•Conducting high-quality research that informs policy and practice

•Enhancing outreach and advocacy through collaborative relationships/partnerships.

EHD endorses education as the foundation through which all persons are empowered to live healthy, fulfilling, and productive lives.

ArticleII.Membership

Votingmembershipshallconsistofallregular faculty(as defined by the Clemson University Faculty Manual) in the departmentincludingtheregular facultyofanyaffiliatedcenters,whoarenotcurrentlyenrolledinadegreeprograminEHD.Other specialfacultymaybegrantedspecifiedvotingand/oracademicprivileges in according to the Faculty Manual,providingsuchamotionispassedbytwo-thirdsofthevotingfaculty.Hereafter“votingfaculty”referstoALLfacultyeligibletovote.

ArticleIII.Quorum

Aquorumofthefacultyshallconsistofasimplemajorityofthevotingfaculty,excludingfacultyonleave.Thisnumberwillbeestablishedandenteredintotheminutesofthefirstmeetingofeachsemester.Everyeffortshallbemadetoconductbusinessthatrequiresafacultyvoteduringthefallandspringsemesters.Conscientiouseffortshallbemadetoensurefullfacultyparticipation.

ArticleIV.Meetings

A.RegularMeetings

Thefacultyshallmeetregularly,typicallyatleastthreetimesduringeachacademicterm, but at least once per fall and spring semesters.MeetingsshallbemoderatedbytheChairorhis/herdesignee.Meetingdatesandbusinessitemsrequiringavoteofthefacultyshallbecommunicated to facultyby email and/or web posting atleastfour business dayspriortothescheduledvote.Exceptionstothisruleforbusinessitemsrequire1)aspecificmotiontosuspendruleswhichdetailswhatwillbevotedupon,and2)passageofthemotiontosuspendrulesbytwo-thirdsofthevotingfaculty.Meetingsofthevotingfaculty,standingcommittees,oradhoccommitteeswhereavoteisscheduledshallbeconductedaccordingtothemostrecenteditionofRobert’sRulesofOrder. The Chair shall appoint a person who will keep records of these meetings and will make the minutes available to the faculty within one month following the meeting.

B.SpecialMeetings

A special or emergency faculty meeting can be called with less than one week’s notification by the Chair in extremely rare situations where the Chair has documented evidence that strongly suggests that the well-being of the faculty is in danger if such a meeting is not held within the week. Faculty members may also request that the Chair call a special or emergency meeting if five or more faculty members send similar documentation to the Chair via written or electronic communication.

C.SpecialVotes

Special faculty votes on issues raised in faculty meetings can be taken outside a faculty meeting via electronic means. This requires voting faculty, during a faculty meeting, to pass a motion for a special vote. Such a motion must clearly state the issue/question for voting, the time frame and procedure for the vote, and the means for dissemination of results. All voting results will be entered into the next faculty meeting minutes. Electronic votes should include faculty names unless an anonymous ballot has been requested and passed by the faculty.

ArticleV.AmendmentstotheBylaws

Thebylawsmaybeamendedbyatwo-thirdsvoteofthevotingfaculty. Dates that amendments are approved and a brief statement as to the substance of the amendment should be recorded in an Appendix by the Chair of EHD or his/her designee.

ArticleVI.StandingCommittees

ThestandingcommitteesforeachFacultyareasfollows:

1)AdvisoryCommittee;

2)CurriculumCommittee;

3)DoctoralProgramAdvisoryCommittees, one for each doctorate:

•Learning Sciences (LS) Ph.D.

•Language, Literacy, and Culture (LLC) Ph.D.

•Special Education (SpEd) Ph.D.

4)Promotion,Tenure,andAppointmentRenewal(TPR)Committee;

5)PostTenureReview(PTR)Committee;

6)ElectionsCommittee.

A.Membership

1.AllvotingmembersofthefacultyasdeterminedinArticleII,areeligibletoserveonstandingcommitteesasstatedinthecommitteedescriptions.Note: only regular faculty, as defined by the Faculty Manual, shall have voting privileges on TPR, curriculum, and PTR committees. Membersofallstandingcommitteesservethree-yearterms,unlessotherwisenoted.Thetermofacommitteememberwillbeextendedtoallowhimorhertofulfillassociatedschooloruniversitycommitteetermobligations.Whenacommitteeisfirstinitiated,termswillbestaggeredrandomlyamongthemembers.

2.Membersofallcommitteesshallbeelected at large,exceptwhereotherwisespecified.

3.Students:Studentrepresentationoncommitteesisencouragedwhereappropriate.Studentsshallbenon-votingmembers. The method for selecting student members will be determined by the committee.

B.Meetings

Meetings shall be called by the committee chair at least once every semester, or more often as appropriate to conduct committee business. Following each spring election the current committee chair will call a meeting with continuing and new members to choose the chair for the following year. The current chair will promptly notify the Elections Chair of this choice. A standing committee chair may be removed by a two-thirds vote of the committee that he/she chairs. The committee chair shall delegate the recording of minutes, or other form of report, for each meeting. The committee chair shall distribute the minutes or other report of each meeting to the committee members and to the Chair within two weeks of the meeting. Minutes or other reports for each meeting shall include a description of all the formal actions taken and the names of all members in attendance. Each committee chair will submit an academic year committee 1-page summary to the EHD Department Chair by May 1st. The summary will include a list of issues tackled, list of actions taken, attendance of members, and notations about above-average member participation/contributions.

C.Reports

Committeereportsrequiringactionbythefacultyshallbedistributedbythecommitteechairtothefacultyatleastfour work dayspriortothescheduledfacultymeeting.

AmendmentsmaybemadefromthefloorinaccordancewithRobert’sRulesofOrder.

Standing committee chairs should present an oral or written report of committee activities to the EHD faculty during regular faculty meetings, as appropriate. Allmeetingminutes,reports,announcements,andothercorrespondencemaybetransmittedtothefacultyintheformof e-mail and/orwebposting.

D.StandingCommitteeDescriptions

1.AdvisoryCommitteeMembership

All voting departmental faculty.

Responsibilities

Thedepartment chair is the standing chair of this committee. The advisory committee shall advise the chair on matters that the chair or faculty bring to the committee, which include but are not limited to: (a) advising on academic issues, (b) evaluating and recommending resources, (c) addressing general faculty concerns. The Advisory Committee meets concurrently with the departmental meeting.

2.CurriculumCommittee

Membership

Four regular faculty members, one from special education, literacy, foundations, and counseling.

Responsibilities

TheCurriculumCommitteeistoreviewproposalsforcoursechanges,newcourses,andothercurricularchanges.TheCommitteeshallevaluateandmakerecommendationstothefacultyonallacademicrequirements,courses,andcurricula.TheCurriculumCommitteewillproviderepresentationforinterdisciplinarycollegiateoruniversitycurriculum-relatedactivities.Inyearswhentheterm(s)oftheEHDrepresentative(s) to the School of Education Curriculum Committeeend,theEHDCommittee,ata springmeeting,willselectamembertoservethe3-yeartermontheSoECurriculumCommittee. This member’s term will be extended in the EHD Curriculum Committee to include the 3 years. ThecurrentchairwillpromptlynotifytheElectionsChairofthechoice.

3.DoctoralProgramAdvisoryCommittees: LS, LLC, and SpEd

Membership

In each committee, three regular faculty members, the SoEGraduateCoordinator, and a non-voting doctoral student in that program.

Responsibilities

EachDoctoralProgramCommitteeisresponsibletooverseeitsprogramincludinggeneralmonitoringofstudentprogressaswellasrecommendingtothefaculty:a)programpoliciesandprocedures,b)draftresponsestoGraduateSchoolrequests,andc)candidatesforadmission.

4.Promotion,TenureandAppointmentRenewal(TPR)CommitteeMembership

TheTPRCommitteeshallconsistofelected, tenured professors, as described in the EHD TPR Guidelines, elected by the faculty to three year staggered terms. The chair of this committee shall be a full professor.

Responsibilities

TheCommitteeshalldeveloppoliciesandprocedures,whicharealignedwiththoseoftheSchool andUniversity,togovernpeerreview.ThesepoliciesandproceduresmustbeconsistentwithUniversitypoliciesandprocedures(asdelineatedintheFacultyManual),andmustbeapprovedbythefaculty.Inaddition,theCommitteeshallannuallydisseminateguidelinesforapplicationsforcontractrenewal,promotion,andtenure.

Theseguidelinesshouldspecify:(a)theformatinwhichapplicationsandsupportingmaterialsaretobesubmitted;(b)thecriteriatobeusedbytheCommitteeinevaluatingapplications;and(c)theproceduresthatwillbefollowedbytheCommittee.TheCommitteeshallalsodisseminate,separately,deadlinesforTPRmaterialsforeachacademicyear.DeadlineswillbedisseminatedpriortothebeginningoftheFallsemesterandearlierwhenfeasible. The Committee shall make recommendations to the Chair and Dean for the awarding of promotion and/or tenure and for reappointments, including reappointment of lecturers. The TPR committee shall follow the EHD TPR Guidelines (separate document) and all other procedures, rules, and regulations for TPR described in the Faculty Manual.

In addition, a comprehensive review of lecturers, following the guidelines in the Faculty Manual, must be conducted after their fourth year of service. According to the Faculty Manual, Senior Lecturers will be evaluated by the TPR committee every three years.

5.Post-TenureReview(PTR)Committee

Membership

ThePost-TenureReviewCommitteeshallconsistofthreetenuredfullprofessors,electedforthree-yearterms,andoneexternalClemsonfullprofessor(onefromoutsidetheSchoolofEducation)electedtoserveastheexternalreviewerfor anapplicantwhochoosesthisoptioninplaceoftheexternalletters for a PTR Part II review.NooneshouldrunforelectionwhoanticipatesgoingupforPTRPartIIreviewduringthatterm.MembersofthePTRcommitteewhogoupforPTRPartIreviewduringtheirtermwillberecusedfromtheirownreviews,butwillparticipateinallotherPTRbusinessthatyear.

Responsibilities

ThePost-TenureReviewCommitteewill follow the EHD PTR Guidelines (see Appendix A) and all other procedures, rules, and regulations for PTR described in the Faculty Manual.

The PTR Committee will also perform the first review for all requests for sabbatical leave. The dates and steps for sabbatical leave are detailed in the Faculty Manual.

6.ElectionsCommitteeMembership

TwomembersappointedbytheChair.

Responsibilities

TheElectionsCommitteerunselectionsasneeded.SeeAppendixCforElectionprocedures.ThechairservesontheSoEElectionsCommittee.

ArticleVII.Ad-HocCommittees.

TheChairmayestablishspecialcommitteesasdeemedappropriate.ThesecommitteesshallhavesuchmembersanddutiesandtermsofofficeasdeterminedbytheChairwiththeadviceandconsentoftheDepartmentAdvisoryCommittee.Ad-HocCommitteeswillhaveaterm-limitofno more than one year.IfaCommitteeisnecessaryforlongerthan that,itmustbecomeastandingcommitteethroughanamendmenttothebylaws.

ArticleVIII.DepartmentPoliciesandProcedures

AllpoliciesandproceduresmustbecompatiblewiththosedescribedintheFacultyManual.

AppendixA:PostTenure ReviewGuidelines

Post-tenurereview(PTR)servestoevaluaterigorouslyafacultymember’sprofessionalcontributions.Thereviewshouldbeusedtoidentifyandrewardexcellentfaculty,and,byidentifyingcaseswhereremediationandsupportmayberequired,shouldensurethatallfacultyservetheneedsofthestudentsandtheinstitution.

Post-tenurereviewiscarriedoutaccordingtotheFacultyManualandtheguidelinesprovidedbytheProvost’sofficeeachyear.TheEHDby-lawsstipulatethatpost-tenurereviewistobecarriedoutbythePost-tenureReview(PTR)Committee.Thiscommitteehasthreememberselectedaccordingtothedepartmentalby-laws.AnadditionalmemberfromoutsidetheSchoolofEducationmaybeelectedtoserveasanexternalreviewer.

Theperiodforposttenurereviewisaftereveryfiveyears.Thefirstfive-yearperiodbeginsatthetimethattenureisgranted.Promotionduringthatperioddoesnotalterthescheduleforreview.Periodsofsickleave,sabbaticalleave,orleavewithoutpaywillbeexcludedfromthisfive-yearperiod.SeetheFacultyManualforothervalidreasonsforrequestinganextension.

ThePTRprocessconsistsoftwoparts.ThosePTRapplicantswhoreceivearatingof"satisfactory"inPartIareexemptfromPartII.TheDepartmentChair,byMay1,willnotifyfacultygoingthroughthePTRreviewthefollowingyear,andprovidenamesandratings(nonarrative)tothechairofthePTRcommitteebyOctober1.

PostTenureReviewProcess:PartI

ThePTRcommitteewillreviewtheratingsreceivedonthemostrecentavailableseries offiveyearsofannualperformancereviews(Form3)asprovidedbytheDepartmentchair.Alltenuredfacultymembersreceivingnomorethanone(offive)annualperformanceratingsof"fair","marginal",or"unsatisfactory"inPartIofthePTRprocessreceiveaPTRratingof"satisfactory".ThesefacultymembersaretherebyexemptfromPartIIofPostTenureReview.ThePTRcommitteewillsubmitalettertotheDepartment Chair and School Dean identifying thefacultymembersexemptfromthePartIIPTRreviewprocess.Inaddition,aletterofnotificationofthe"satisfactory"PTRratingwillbesenttoeachofthosefacultymembers.

PostTenureReviewProcess:PartII

1.Notification.ByOctober15,thosefacultywhohavebeenidentifiedasapplicantsforPartIIPTRwillbeindividuallynotifiedbyletterfromthePTRcommitteechairthattheyshouldbeginpreparingtheirapplicationsforpost-tenurereview.

2.Choosingexternalreviewprocess.ByNovember1,eachfacultymemberunderreviewwillnotifythePTRcommitteechairinwritingofhisorherchoiceofexternalreviewmethod:participationbyanexternalcommitteemember,orsolicitedexternalsupportletters(inwhichcase,thenamesandcontactinformationofatleastsixpotentialrefereesmustbeincluded).IntheeventthatthiswrittennotificationisnotreceivedbythePTRchairbytheduedate,thedefaultwillbetheuseoftheexternalcommitteemember

inthatapplicant’sreview.

3.SubmissionofCompleteApplication.AnotebookcontainingsectionsprescribedbytheProvostandprovidedbytheSchoolDeanwillbegiventoeachPTR Part IIapplicantbythePTRcommittee.This notebook may be paper or electronic, as determined by the Provost or Dean. AllrequiredapplicationmaterialsmustbesubmittedtothePTRChairpriortothedeadlineestablishedbytheCommittee.Thesematerialswillbekeptinasecure location availableonlytoPTRCommitteemembersandtotheSchoolDean.Duringtheperiodbeforetheapplicationdeadline,anapplicantmayaddressanyproceduralquestionstothePTRCommitteeChair,forexample,questionsregardingthematerialstobesubmitted.

4.ExternalLettersandAdditionalMaterials.Iftheapplicantchoosestheoptionofsolicitedexternalsupportletters,aminimumof4referenceletterswillbeobtainedbythePTRcommittee,ofwhichatleasttwoofthereferencesmustcomefromthelistsubmittedbytheapplicant.ThePTRcommittee,throughthePTRchairordesignatedmember,mayasktheapplicantforadditionalmaterialsorwrittenclarificationatanytimebeforetherecommendationismade.Ifanapplicantreceivesinformationaboutanadditionaldistinctionpriortothecommitteemeetingatwhichthecommitteerecommendationismade,theapplicantmaysubmitthatmaterialtothePTRchairpriortothemeeting.

5.Review.IndividualPTRcommitteememberswillreviewtheapplicationspriortothecommitteemeetingatwhichtherecommendationwillbemade.Inreviewingmaterials,thePTRcommitteewillevaluateeachapplicantusingtheestablishedcriteria.Theapplicantwillbenotifiedofthedateoftherecommendationmeetingwithareminderthatthemeetingdateisalsothefinaldeadlineforadditionalinformation(recentdistinctions).

6.RatingsandRecommendation.AtaclosedmeetingofthePTRcommitteeinearlyspring,atwhichadesignatedcommitteememberwilltakeminutes,aratingofSatisfactoryorUnsatisfactorywillbegiventotheapplicantforeachofthethreeperformanceareas(Teaching,Research/Scholarship,andService).Intheeventthataconsensuscannotbereachedforarating,themajoritywillhold.Foreachapplicantareportwillbewrittenbythecommittee.Foreachofthethreeperformanceareasthereportwillincludeanarrativeandarating(SatisfactoryorUnsatisfactory).ThereportwillfinishwithastatementoftheoverallrecommendationofSatisfactoryorUnsatisfactory.(SeetheFacultyManualformoreinformation.)

CriteriaforEvaluatingFacultyPerformance

Injudgingpost-tenureperformance,theCommitteewillprimarilyconsidertheapplicant’sperformanceduringtheperiodsincethelastpeerreview,butperformancepriortothelatestreviewwillalsobeconsidered,aswellasplansforfuturedevelopmentandpotentialcontributions.EHDfacultyatClemsonUniversityreceiveaformalyearlyevaluation(“Form3”)oftheircontributionstotheUniversity,providedbytheEHDchair.TheseForm3evaluationsaccordaveryhighweightinthePTRdecisions.

A.CriteriaforRatingsintheThreePerformanceAreas(Teaching,Research,andService).GuidedbytheEHDTPRGuidelinesandForm3Criteria,andgivingstrongconsiderationtotheForm3evaluations,thecommitteewillgivearatingofSatisfactoryorUnsatisfactorytoeachapplicantineachofthethreeareasofTeaching,Research/Scholarship,andService.

B.CriteriafortheOverallRecommendation.TheapplicantwillreceiveanoverallrecommendationofSatisfactoryifheorshereceivesaratingofSatisfactoryinallthreeperformanceareas(Teaching,Research,andService).ThisresetsthePTRtimeclock.IfanyoneperformanceareaisUnsatisfactory,theoverallrecommendationwillbeUnsatisfactory,resultinginremediationtocorrectdeficienciesintheUnsatisfactoryperformancearea(s)(seetheFacultyManualforremediationdetails).

ThePTRNotebook(requiredforPartIIreviewonly).MaterialswillbeorganizedinthePTRNotebookwithtabsintheorderspecifiedbytheProvost'soffice.ThefollowingmaterialsarerequiredbytheTEPTRcommittee(evenifnotrequiredbytheProvost):

AppendixB:ElectionProcedures

A)Theelectionswillbeheldeachspring prior to or simultaneously with the School of Education elections.TheElectionChairwillsendhis/herfacultyalistofthosecommitteesatalllevelswithopenseats.

B)At-largeElections:

1.TheElectionChairwillreceiveelectronicnominationsfromthenomineesthemselves.Nominationsmaybemadefromtheflooroffacultymeetings,aslongasthenomineegivesverbalconsent,recordedintheminutesofthemeeting.Nominationswillbecollectedforaminimumof3days.

2.Theslatewillbeemailedtofacultywiththenamesofallnomineeswhowillappearonhis/herballot.Theslatewillbeemailedatleast2daysbeforetheelection.

3.TheElectionCommitteeshallconducttheelectionbysecretballot.Avalidballotisoneinwhichthereareasmanyvotesinthatcommitteeelectionastherearevacanciesforthatcommittee.Therearenowrite-ins.Thereisnoabsenteevotingiftheelectionisinternet-based.Collectionofballotsmustcontinuefornolessthan2.5days.

4.Electionwillbebyplurality.

5.Theelectionresultsshallbeemailedtothefaculty,andthecommitteelistswillbemaintainedontheweb.

6.Intheeventthatafacultyvacancyoccursafterthespringelection,theDepartmentChair(fordepartmentcommittees)ortheDean(forSchoolcommittees)mayappointaninterimmembertofillthevacancyuntilthenextspringelection.
