complaints of Discrimination

Complaints of discrimination on the basis of a disability shall be given prompt and fair consideration. The following procedure may be a parallel process; that is, the employee's request for informal resolution and investigation by the Section 504/ADA Compliance Officer may be pursued in conjunction with the complaint procedures through the work agreements between the School District and various organizations representing employees or the United States Department of Labor, Office of Federal Contract Compliance Programs. The formal complaint process is available whether or not the employee participates in the District resolution process, which is as follows:

District Resolution Process:

An employee complaint shall be filed with the Section 504 and ADA Compliance Officer. Complaints of discrimination must be filed within 90 calendar days of the alleged violation.

The Section 504/ADA Compliance officer will investigate the matter. When appropriate, the Employee Health Services division of the Department of Human Resources will provide relevant health information and/or consult with the Section 504/ADA Compliance Officer. The complainant may request a hearing on the grievance. In that event, the Compliance Officer shall conduct a hearing at which additional evidence and testimony will be received from the complainant. In addition, the Compliance Officer may require the attendance of other District personnel to provide relevant information.

If the complainant desires a hearing on the merits of the grievance, they shall notify the Compliance Officer within five (5) working days from the submission of their grievance. Any such hearing shall be held within twenty (20) working days from the receipt of the complaint, unless the complainant requests additional time, or the Compliance Officer determines additional time is required to adequately investigate the allegations.

In the event that the complainant does not request a hearing, the Compliance Officer shall issue written findings within ten (10) workings days from the receipt of the complaint. In the event that a hearing has been conducted, the Compliance Officer shall issue written findings within ten (10) working days from the conclusion of the hearing. The complainant shall be notified of the decision by certified mail.

If the employee is dissatisfied with the decision of the Section 504/ADA Compliance Officer, he/she may request a de novo review of the written decision by the Superintendent or designee. Any appeal must be submitted to the Superintendent within five (5) working days of receipt of the Compliance Officer's decision. The Superintendent or designee shall render a written decision either affirming the action of the Section 504 and ADA Compliance Officer, or, alternatively, recommending another resolution within ten (10) days of the receipt of the appeal.

Should the complainant still not feel satisfied, within 10 days after the Superintendent's decision has been rendered, he/she may request a review by the United States Department of Labor, Office of Federal Contract Compliance Programs.
