EXPLANATORY STATEMENT

Defence Determination 2014/5

This Determination amends Defence Determination 2005/15, Conditions of service (the Principal Determination), made under section 58B of the Defence Act 1903 (the Defence Act) and in accordance with subsection 33(3) of the Acts Interpretation Act 1901 (AIA Act). Determinations made under section 58B of the Defence Act are disallowable non-legislative instruments and are subject to the interpretation principles in the AIA Act, as modified by section 58B of the Defence Act.

Chapter 7 of the Principal Determination sets out provisions dealing with assistance for housing and meals for eligible members of the Australian Defence Force (ADF).

This Determination has the following purposes.

  • To implement an annual review of the Group Rent Scheme (GRS).
  • To implement the annual review of allowances that ADF members may receive for, and the contributions they are required to make towards, the cost of their accommodation, meals and utilities.

Clause 1 of this Determination sets out the manner in which this Determination may be cited.

Clause 2 of this Determination provides that the Determination commences on 13 March 2014to allow time for the pay systems to be updated with the new rates provided for in this Determination.

Clause 3 specifies that the amendment is made to the Principal Determination, as amended.

Clause 4 substitutes the table in subclause 7.4.21.2 of the Principal Determination. The table provides meal allowance rates for members, their spouse or partner and dependent children aged 10 years or older. These rates apply to meals taken in hotels or serviced apartments when the family is relocating. The rates are aligned with the current travelling allowance meal rates for Colonel or lower and have increased by an average of 2.3%.

Clause 5 substitutes the table in subclause 7.4.21.3 of the Principal Determination. The table provides meal allowance rates for a member's children aged less than 10 years. These rates apply to meals taken in hotels or serviced apartments while the family is relocating. The figures are calculated by halving the rates in clause 4, and rounding up to the nearest five cents. The rates are aligned with the current travelling allowance meal rates for Colonel or lower and have increased by an average of 2.3%.

Clause 6 substitutes the example in subclause 7.4.21.3 of the Principal Determination. The example illustrates how meal allowance is calculated for a member's family staying in temporary accommodation while relocating. The figures have been updated to reflect the changes made in clauses 4 and 5 of this Determination.

Clause 7 amends table item 1 in clause 7.4.26 of the Principal Determination. This amendment increases the weekly contribution for utilities made by a member occupying temporary accommodation from$47.58 to $50.77. The adjustment reflects a 6.7% increase in the utilities subcomponent of the Consumer Price Index over the 12 month period September 2012 to September 2013.

Clause 8 substitutes the table in subclause 7.7.5.3 of the Principal Determination. This amendment adjusts the fortnightly meal charges paid by a member who regularly dines in the mess. The adjustment reflects a 0.6% decrease in the food component of the Consumer Price Index over the 12 month period September 2012 to September 2013.
