I, the undersigned, authorised to represent the Co-applicant organisation, declare that I have read the entire grant application this Declaration is attached to, discussed it with the Coordinator organisation and the other Co-applicant(s) and given my agreement to it.
I certify that the Co-applicant organisation has not received any other European Union funding to carry out the action which is the subject of the grant application this Declaration is attached to.
I certify on my honour that the Co-applicant organisation is not in one of the situations outlined in Article 131(4) of Regulation (EU, EURATOM) No 966/2012 of the European Parliament and of the Council of 25 October 2012 on the financial rules applicable to the general budget of the Union[3] (Financial Regulation) which would exclude it from receiving Union grants and accordingly declare that:
a) the Co-applicant is not bankrupt or being wound up, is not having its affairs administered by the courts, has not entered into an arrangement with creditors, has not suspended business activities, is not the subject of proceedings concerning those matters, and is not in any analogous situation arising from a similar procedure provided for in national legislation or regulations;
b) the Co-applicant has not been convicted of an offence concerning professional conduct by a judgment of a competent authority of a Member State which has the force of res judicata;
c) the Co-applicant has not been guilty of grave professional misconduct proven by any means which the Commission can justify, including by decision of the EIB and international organisations;
d) the Co-applicant is in compliance with its obligations relating to the payment of social security contributions and the payment of taxes in accordance with the legal provisions of the country in which it is established or with those of Belgium, or those of the country(ies) where the action is to be implemented;
e) the Co-applicant has not been the subject of a judgment which has the force of res judicata for fraud, corruption, involvement in a criminal organisation, money laundering or any other illegal activity, where such illegal activity is detrimental to the Union's financial interests;
f) the Co-applicant is not subject to an administrative penalty for: being guilty of misrepresentation in supplying the information required by the Commission as a condition of participation in a procurement or grant award procedure or for failing to supply this information; or having been declared to be in serious breach of its obligations under Grant Agreements or a contracts financed by the Union's budget;
g) the Co-applicant has no conflict of interest in connection with the action; a conflict of interest could arise in particular as a result of economic interests, political or national affinity, family, emotional life or any other shared interest;
h) (Only applicable for legal persons other than Member States and local authorities) the natural persons with power of representation, decision-making or control[4] over the Co-applicant are not in the situations referred to in b) and e) above.
I further declare that:
- the Co-applicant will inform the Commission via the Coordinator without delay, of any situation considered a conflict of interests or which could give rise to a conflict of interests;
- the Co-applicant has not granted and will not grant, has not sought and will not seek, has not attempted and will not attempt to obtain, and has not accepted and will not accept, any advantage, financial or in kind, to or from any party whatsoever, where such advantage constitutes an illegal practice or involves corruption, either directly or indirectly, in as much as it is an incentive or reward relating to award of the grant;
- the Co-applicant provided accurate, sincere and complete information within the context of this grant award procedure;
- the Co-applicant accepts the standard conditions as laid down in the Grant Agreement;
- the Co-applicant is directly responsible for the management and coordination, preparation and implementation of the activities contained in this application and is not under any circumstances acting as an intermediary;
- the Co-applicant is fully aware of its obligation to inform via the Coordinator, without delay, the Directorate-General Migration and Home Affairs of the European Commission to whom this application is submitted, if an application for funding for the same action made to any other European Commission Directorate-General or other European Union institution/body or agency is awarded funding after the submission of this grant application.
I certify that the Co-applicant is fully eligible in accordance with the criteria set out in the specific Call for Proposals and the legal base of the funding instrument providing the funding, and that it has the financial and operational capacity to carry out the proposed action.
I declare that the Co-applicant has read and accepted the rules governing the eligibility of VAT under this Call for Proposals. Whenever the case, any cost items considered to be incurred in the framework of activities engaged in by the Co-applicant as public authority, have been identified in the column “Additional information” of the Forecast Budget Calculation Sheet of the Budget Estimate. For these items, VAT is ineligible and is not included in the cost.
I declare to be aware that the EU co-funding only covers part of the eligible project costs (up to the maximum EU grant amount or percentage specified in the Grant Agreement), and that the remaining part must be covered by the applicant's and/or co-applicants' own funds.
I declare that I will respect all ethical principles and all applicable international, EU and national law on ethical issues while carrying out the project.
I further declare that the Co-applicant:
- undertakes to perform the tasks allocated and according to the work packages and timetable of the project;
- will contribute the amounts specified in the Budget Estimate to the project (only applicable if the Co-applicant organisation contributes financially to the project budget);
- if the proposal is selected to be awarded a grant, accepts:
- to mandate the Coordinator, to sign in his name and on his behalf the Grant Agreement and its possible subsequent amendments with the Commission;
- that the Commission shall, subject to payment arrangements, pay the grant in full to the Coordinator, who is entitled to receive funds from the Commission and distribute the amounts corresponding to the Co-applicant's (future Co-beneficiary's) participation in the action;
- in advance on-the-spot checks and inspections by Commission departments, the European Anti-fraud Office (OLAF) and the European Court of Auditors.
I acknowledge that the Co-applicant may be subject to administrative and financial penalties[5] should it be found guilty of misrepresentation.
