DECISION OF THE DIRECTOR GENERAL OF POST AND TELECOMMUNICATION

NUMBER: 205 YEAR 2008

ON

APPROVAL OF THE INTERCONNECTION TENDER DOCUMENT BELONGING TO THE INTERCONNECTION PROVIDERS WITH OPERATING REVENUE 25% OR MORE THAN THE TOTAL OF OPERATING REVENUE OF ALL TELECOMMUNICATION PROVIDERS IN THEIR SERVICE SEGMENTATION

BY THE GRACE OF GOD THE ALMIGHTY

DIRECTOR GENERAL OF POST AND TELECOMMUNICATION

Considering: a. that in the Decree of the Minister of Communication and

Information Technology Number 08/Per/M.KOMINFO/02/

2006 on Interconnection it is stipulated that Interconnection Tender Document (ITD) of providers of telecommunication network whose operating revenue is equal to 25% or more than the total operating revenue of all telecommunication providers in their service segmentation are obligated to obtain approval from the Indonesian Telecommunication Regulatory Body (BRTI);

  1. that in order to obtain approval as stated in point a above, an evaluation will be conducted on the proposal of ITD belonging to telecommunication network providers whose operating revenue is equal to 25% or more than the total operating revenue of all telecommunication providers in their service segmentation;
  1. that in view of what is stated in points a and b above, it is deemed necessary to provide approval to the Interconnection Tender Document (ITD) of telecommunication network providers whose operating revenue is equal to 25% or more than the total operating revenue of all telecommunication providers in their service segmentation by the Decision of the Director General of Post and Telecommunication;

  10. Decree of the Minister of Communication and Information Technology Number 08/Per/M.KOMINFO/02/2006 on Interconnection;
  11. Decision of the Director General of Post and Telecommunication Number 73/2006 on the Procedure for establishing Telecommunication Network Providers whose operating revenue is equal to 25% or more than the total operating revenue of all telecommunication providers in their service segmentation;
  12. Decision of the Director General of Post and Telecommunication Number 219/2007 on establishing Telecommunication Network Providers whose operating revenue is equal to 25% or more than the total operating revenue of all telecommunication providers in their service segmentation in the year 2008.

DECIDES

To ratify :DECISION OF THE DIRECTOR GENERAL OF POST AND

TELECOMMUNICATION ON APPROVAL OF THE INTERCONNECTION TENDER DOCUMENT BELONGING TO THE INTERCONNECTION PROVIDERS WITH OPERATING REVENUE 25% OR MORE THAN THE TOTAL OPERATING REVENUE OF ALL TELECOMMUNICATION PROVIDERS IN THEIR SERVICE SEGMENTATION

FIRST The Indonesian Telecommunication Regulatory Body (BRTI)

provides approval to the Interconnection Tender Document (ITD) of telecommunication network providers whose operating revenue is equal to 25% or more than the total operating revenue of all telecommunication providers in their service segmentation;

SECONDApproval of the ITD as stipulated in the FIRST Dictum is given to:

  1. ITD belonging to PT Telkom as included in Attachment I of this Decision;
  1. ITD belonging to PT Telkomsel as included in Attachment II of this Decision;
  1. ITD belonging to PT Indosat as included in Attachment III of this Decision.

THIRD Approval to the ITD belonging to PT Indosat as stated in the SECOND Dictum point c is limited to the material having to do with the provision of fixed network of international connection.

FOUTH :In the event that there is a proposal for the modification of ITD either from public providers and or from BRTI (The Indonesian Telecommunication Regulatory Body), the approval as stated in the FIRST Dictum is still valid until an approval is given to the new ITD in accordance with the prevailing regulations.

FIFTHThis Decision comes into force for the period of one (1) year as of the date of this Decision.
