Decision of Georgian National Communications Commission on

Announcement of the Tender for Selecting the Administrator of the Number Portability Central Database

According to the Article 1, clause 4 and Articles 8 and 9 of the “Regulation on Number Portability” approved by the resolution N 3 as of July 6, 2010 of the Georgian National Communications Commission (hereafter the Commission), the Commission as a result of the voting decides to:

  1. Announce the tender for selecting the administrator of the number portability central database (hereafter “Tender”) effective from July 30, 2010;
  2. Approve the enclosed terms and conditions of conducting the Tender for selecting the administrator of the number portability central database; (annex 1- hereafter “Tender Regulations”).
  3. The Tender Board shall be approved with the following composition:

  1. The Administrative Department of the Commission shall ensure publicity of thisdecisionandshall post the official text of the decision and its English translation at the web-page of the Commission ( In case of inconsistency between the official language of the decision and the English translation, the official text shall govern;
  2. The Press-secretary of the Commission shall promulgate information through mass media regarding announcement of the Tender;
  3. This decision shall be put into effect as of the date of posting announcement at the official web page of the Commission (
  4. This decision may be appealed at the board of administrative cases of Tbilisi city court (address: Tbilisi, D. Agmashenebeli ave, 12th km) within one month period;
  5. Control over implementation of this decision shall be assigned to the Administrative Department of the Commission (I.Kharebava).

Annex N 1

Terms and Conditions of Conducting the Tender for Selecting the Administrator of the Number Portability Central Database (Tender Regulations)

Article 1-Terms of Conducting the Tender

  1. The Tender shall be announced from July 30, 2010.
  2. The Tender applications and enclosed documents shall be submitted from 10:00am on August 2, 2010 before 19:00pm on August 23, 2010;
  3. Tender applications and enclosed documents shall be submitted at the following address: Tbilisi, 0144, Ketevan Tsamebuli ave/Bochorma st. 50/18;
  4. Tender applications and enclosed documents shall be received by the Administrative Department of the Commission (I.Kharebava);
  5. The first session of the Tender Board shall be held on August 24, 2010, at 15:00 pm;
  6. The effective term of the Tender Board shall be seven working days from the date of first session – until August 31, 2010, by 19:00pm;

Article 2-The Entities Interested in Participation in the Tender

  1. Any legal entity (registered in Georgia or in any other foreign country) may participate in the Tender, provided that the following requirements are met:

a) Tender participant (independently) or its interdependent (affiliated) entity shall have experience of implementing (installing) Number Portability Central Database (hereinafter NPCDB) in at least 2 countries.

b) Tender participant (independently) or its interdependent (affiliated) entity shall have experience of administration of NPCDB.

c) Tender participant or its interdependent (affiliated) entity shall not be undergoing liquidation and/or restructuring and the bankruptcy proceedings shall not be filed against it and its affiliated entity;

  1. Electronic communications network operators/service providers authorized in accordance with the Law of Georgia “On Electronic Communications” or their interdependent (affiliated) entities (defined according to the Article 2, of the Law of Georgia “On Electronic Communications”) shall be prohibited from participating in the Tender.

Article 3-Tender Application and Enclosed Documents

  1. Legal entity that decides to participate in the Tendershall submit the Tender application drawn up in Georgian language to the Commission;
  2. The following documents shall be enclosed with the Tender application:
  1. duly certified incorporation document of the legal entity (in original language along withtranslation into Georgian language certified by a notary)
  2. notarially certifiedPower of Attorney(in Georgian or English language)confirming the authority of the tender participant’s representative to act on behalf of the Tender participant;
  3. written confirmation of the Tender participant stating that it is not an electronic communications network operator/service provider authorized in accordance with the Law of Georgia “On Electronic Communications” or it’s interdependent (affiliated) entity (in Georgian or English language).
  4. documents evidencing experience of the tender participant in implementationand administration of NPCDB as laid down in clause1, Article 2 of the Tender Regulations, also, documents provingthat the Tender participant complies with the requirements laid down in sub clause c, clause 1 of Article 2 of the Tender Regulations(in Georgian or English language).
  5. Tender Proposal that includes Technical Terms and Tariff Conditions;
  6. bank guarantee worth 50 000 (fifty thousand) GEL or its equivalent in foreign currency valid for 60 days.
  1. Technical Terms of the Tender Proposal shall be submitted (in Georgian or English language) in the separate sealed envelope and shall include:
  1. detailed specifications and parametersof the offered (NPCDB) equipment/devicesand additional documents evidencing compliance of the offered equipment/devices with the technical specifications laid down in Article 4 of the Tender Regulations (catalogues and other documents issued by the equipment manufacturer shall be attached);
  2. the documents confirming the rights of the Tender participant authorized by the manufacturer to implement the offered (NPCDB) equipment in Georgia.
  1. Tariff Conditions of the Tender Proposal shall be presented in a separate sealed envelope and shall include filled-in form of Annex 1 of the Tender Regulations;
  2. Documents containing Technical Terms and Tariff Conditions submitted in envelopes shall be signed by the appropriate authorized person; documents submitted in the envelope of Technical Terms of Tender Proposal shall be duly sewn and numbered;
  3. The following must be written on the envelopes determined by clause 3 and 4 of this Article:
  1. the name and address of the organizer of the Tender;
  2. the name and address of the Tender participant;
  3. description of the contents of the envelope (table of contents).
  1. Tender participant or its affiliated entities jointly or independently are entitled to submit one Tender application to the Commission;
  2. Tender participant shall not be compensated for the charges associated with the preparation of tender application and enclosed documents;
  3. After expiry of the deadline for submitting Tender applications, the Tender application or enclosed documents shall not be amended or otherwise modified;
  4. Tender participant is entitled to refuse to participate in the Tender at any stage of the Tender. If the Tender participant decides to withdraw Tender application and enclosed documents prior to the expiry of the deadline for submitting Tender applications, alldocuments submitted by him/her, other than Tender application, including bank guarantee shall be returned to such person. In case person refuses to participate in Tender after the expiry of the effective term of accepting tender applications, the documents shall not be returned and the bank guarantee is subject to cash.
  5. The bank guaranteesof the Tender participants, except the bank guarantee of the winner of the Tender shall be returnedby the Commission within ten days after selecting the winner of the Tender. The bank guarantee shall not be returned to the Tender participant if the participant had submitted false tender application or enclosed documents;
  6. the bank guarantee shall not be returned back to the winner of the Tender and shall be cashed by the Commission:
  1. if the winner of the tender fails to submit the bank guarantee required for securing the agreement on administration of NPCDB;
  2. if the winner of the tender fails to conclude the agreement with the Commission on administration of NPCDB.

Article 4-Technical Specifications of NPCDB

  1. Technical specifications of NPCDB proposed by the Tender participant shall comply with following requirements:
  1. NPCDB shall service the electronic communications network operators/service providers;
  2. NPCDB shall ensure administration of the number portability process between following electronic communications network operators/service providers:

b.a. (non-geographical) subscriber number portability between mobile electronic communications network operators/service providers;

b.b. (geographical and non-geographical) subscriber number portability between fixed electronic communications network operators/service providers;

  1. NPCDB proposed by the Tender participant shall have possibility to administrate not less than 40 electronic communications network operators/services providers, and it shall be possible, without any essential modifications to the NPCDB hardware and/or software, to increase the number of electronic communications network operators/services providers being managed;
  2. NPCDB shall manage all ported telephone numbers;
  3. NPCDB human interface (GUI) shall be in Georgian language;
  4. NPCDB must function uninterruptedly (24 hours per day, 7 days per week);
  5. NPCDB annual availability shall be at least 99.7%.
  6. NPCDB system shall be extensible with additional modules without making essential changes to NPCDB hardware and/or software;
  7. NPCDB shall store technical information necessary for troubleshooting, system maintenance, and preventive procedures.
  1. NPCDBproposed by the Tender participant must:
  1. organize and effectively maintain the automated process of administrating number portability between the electronic communications network operators/ services providers;
  2. ensure the possibility for electronic communications network operators/ services providers to periodically (at least once in 24 hours) receive information from the NPCDB, which is necessary for synchronizing the data of NPCDB with the operational data bases of the operators that are necessary to direct the call to the ported subscriber numbers;
  3. ensure the possibility for electronic communications network operators/services providers at any time to receive information about any specific ported subscriber number (by separate single query- based synchronization of the operational data base of the operator with NPCDB;
  1. NPCDBproposed by the Tender participant shall implement the algorithm for number portability process between electronic communications network operators/ services providers which shall comply with the following requirements:
  1. the porting process shall be centralized;
  2. NPCDB shall record all process step terms and compliance with said terms.
  1. Guidelines for algorithm for administration of number portability:
  1. the recipient shall fill in the number portability request where the following shall be specified:

a. a. the date and time of filling number portability request

a.b. information about the subscriber requesting the number(s) ported: In case of natural person – name, family name, personal number and contact information: in case of legal person- name of legal entity, identification code andcontact information;

a.c. the telephone numbers to be ported: the telephone numbers to be ported shall be entered one by one or as range as a single request for each application;

a.d. the donor

a.e.the recipient

a.f.the data related to the person who received the application and is filling in the number portability request: the name and surname of the natural person and contact information;

  1. NPCDB shall validate the number portability request entered by the recipient; control the time limits specified in “Regulation on Number Portability” approved by the resolution N 3 as of July 6, 2010 of the Georgian National Communications Commissionand accept or reject the request based on the data entered.
  2. if the number portability request is rejected by NPCDB, NPCDB shall indicate the reason or the fields in error which must be amended by the recipient;
  3. if NPCDBapproves the number portability request, NPCDB shall save it and give it the “New Request” status, and a relevant notification shall be sent to the recipient and the donor;
  4. NPCDBshall give each new request a unique number;
  5. the donor, upon reception of the number portability request, shall, enter information confirming or rejecting the truthfulness of the documents submitted by the subscriber in an appropriate application field, and if any, indicate number porting rejection criteriaspecified in “Regulation on Number Portability” approved by the resolution N 3 as of July 6, 2010 of the Georgian National Communications Commission;
  6. NPCDBshall save the information entered by the donor, give it the “Reviewed Request” status and inform the recipient thereof;
  7. the recipient, upon opening the reviewed request, shall be able to see the information entered by the donor enabling it to resolve, confirm or cancel the porting process;
  8. in case the number portability request is canceled by the recipient, a request for cancellation of the number portability request shall be filled in and the following shall be indicated in the place specified by the application:

i.a. the date and time of canceling the requested number portability;

i.b. the reason(s) for canceling the requested number portability;

i.c. the data related to the person filling in the request for cancellation of the number portability request:the name, surname and contact information of the natural person;

  1. in case the recipient decides to confirm the numberportability request:

j.a. NPCDBshall assign the “Confirmed” application status;

j.b.NPCDBshall send the appropriate notification to the donor and the recipient (and all other electronic communications network operators/services providers connected to the NPCDB) with the date and time of the execution of the number portability;

j.c. the donor shall deactivate the ported telephone number(s) by the time specified by NPCDB and shall send a statement confirming the deactivation of the telephone number(s) to NPCDB;

j.d. the recipient shall activate the ported telephone number(s) by the time specified by NPCDBand shall send a statement confirming the activation of the telephone number(s) to NPCDB;

j.e. NPCDB shall assign the "Activated" request status and put the information in the NPCDB sufficient for the ported subscriber number to be accessible from the electronic communications network operators/ services providers.

  1. NPCDBproposed by the Tender participant shall comply with the following functional requirements:
  1. NPCDBshall store the following information:

a.a. all telephone numbers allocated to electronic communications network operators, providers /services providers;

a.b. all ported telephone number;

a.c. to which electronic communications network operator/services provider the ported number belongs currently and belonged previously;

a.c. number portability history (number portability message flows and related information);

a.d. how many times a telephone number has been ported

b. all information stored in NPCDB, which is related to a specific electronic communications network operator/services provider must be accessible only to that specific electronic communications network operator/services provider;

c. NPCDB shall ensure the possibility to organize theNPCDBsearch according to every feature of the stored information or a part thereof;

d. NPCDB shall ensure the possibility for the electronic communications network operators, providers and electronic communications services providers to administrate the dataaccessible to them (to filter, to group the information being provided),generate statistics reports, making use of the information stored by NPCDB related to the telephone number portability;

e. NPCDB shall ensure the possibility to receive all information provided by NPCDBin an electronic report format;

f. NPCDBshall ensure the possibility for a recipient and a donor to see all messages, their content and the entire message flow related to a number portability request (number portability requests, request status change history, and other available information);

g. NPCDBshall ensure the possibility for the electronic communications network operators/services providers to receive information messages about the following:

g.a. amendments made to the NPCDB;

g.b. malfunctioning, damage and (or) restoration of NPCDBoperation;

g.c. other messages.

  1. NPCDB proposed by the Tender participant shall comply with the following safety requirements:
  1. control of the access rights granted to the electronic communications network operators/services providers must be exerted at the level of the NPCDB.
  2. the access rights granted to the electronic communications network operators, providers and electronic communications services providers shall be limited by the measures of the internal system of the NPCDB;
  3. the access rights granted to the electronic communications network operators/services providers shall be administrated by the NPCDB Administrator only;
  4. connection to NPCDB must be available through coded channel;
  5. NPCDBshall have the possibility to propose several ways of access to the system, including connection by means of a secure electronic signature unambiguously identifying the electronic communications network operators/services providers and confirming integrity of the information provided by it. The Administrator shall be responsible for safety of the measures provided.

Article 5-Tariff Conditions of the Tender Proposal

  1. Tariff Conditions of the Tender Proposal shall be provided in a form of Annex 1 of the Tender Regulations and shall specify the following :
  1. The amount of annual tariff which each electronic communications network operator/service provider shall have to pay to the administrator of NPCDB for synchronization of operators’ operative databases with NPCDB;
  2. The amount of annual tariff which each electronic communications network operator/service provider shall have to pay to the administrator of NPCDB per each subscriber number allocated to them for ensuring number porting process;
  1. Tariff Conditions of the Tender Proposal shall be specified in EUR (Euro)
  2. Tariffs proposed by the Tender Proposalshall be VAT exclusive;
  3. Tariffs proposed by the Tender Proposal shall meet the requirements laid down in the “Regulation on Number Portability “approved by Resolution N 3 as of July 6, 2010 of the Commission;
  4. The Commission is authorized to monitorthe tariffs set forth by the Administrator of the NPCDB, for the purpose to ensure their compliance with the requirements laid down in “Regulation on Number Portability” approved by Resolution N3 of the Commission dated July 6,2010.
