Dear Mr Chandler

Thank you for your e-mail of 22 October 2015relating to our response to your Freedom of Information (FOI) request, reference number VTR 4300.

In reply to the response we sent you on October 22 2015 you have said,

On this occasion your request requires us to give legal opinion and to enter into discuss of an issue. If you have any queries about this letter please contact me quoting the reference number above."

Firstly this is NOT asking for a legal opinion, this is asking for legal documented fact. I have asked for the process for which a person may take legal action against a Civil Servant if that person has overstepped their position, there by not being protected by the Charltona Doctrine.

I am sure that the DWP has processes in place for dealing with such matters. The particular case details is/are irrelivant, what does matter is the process for which a person starts the process against a DWP Civil Servant, as this process will be the same regardless of the individual case details. So I believe that you still have not provided correct information, and ask that you reconsider your last reply.

And can you please provide your name and a direct contact phone number, so that I may contact "Me", rather than wasting time being transferred and not knowing who is actually dealing with this request.

I have reviewed the response and agree with its content.

We are unable to answer your question because the purpose of the Freedom of Information Act 2000 is to provide access to recorded information held by The Department and we do not hold any recorded information regarding your request. There are other channels for advice, assistance and discussion not available through the FoI route, which you may wish to explore.

Also, I am unable to supply a name and contact number as this information is exempt under FoI section 40 (2), concerning the release of personal information.

You can find information regarding DWP complaints policy and procedures at

Yours Sincerely,

DWP HR Central Freedom of Information Team
