INTERPRETATION

1In these rules:

"the club" means "Cumann Lúthchleas Gael Naomh Sailbheastair, Mullach Íde"

"secretary" means the secretary for the time being or any person appointed to perform the duties of the secretary of the club.

"officers" means chairman, secretary and treasurer for the time being or any persons appointed to perform their duties.

"committee" means the committee elected to manage the day-to-day affairs of the Club.

"real property" means the property of the club of an immovable nature and comprising any playing pitches, grounds or buildings whether of leasehold or freehold tenure with all fixtures or fittings attached thereto and used therewith.

"personal property" means the property of the club of a movable nature comprising all playing or sporting equipment of the club as well as all stock in trade and money or other assets of the club not already classified as fixtures or fittings on "real property" as hereinbefore defined.

Expressions referring to writing shall, unless the contrary intention appears, be construed as including references to printing, lithography, photography and other modes of representing or reproducing words in a visible form.

Words importing the singular number only include the plural number and vice versa and words importing the masculine gender only also include the feminine and vice versa.

NAME

2The name of the club shall be "Cumann Lúthchleas Gael Naomh Sailbheastair, Mullach Íde"

OBJECTS

3(a)The mission of the club is to:

promote Ireland's national games and pastimes under the control of An Cumann Lúthchleas Gael, the active advancement of the Irish language and the fostering of Irish culture in accordance with the rules of the Association.;

encourage the youth of the area, male and female, to select Gaelic games as their first choice in sport;

provide the organisation and facilities required for the youth of the area to participate fully and successfully in Gaelic games;

provide for the maximum participation by the broad local community in sporting and social activities associated with the games;

provide facilities for community and cultural organisations based in the area.

(b)The club shall be affiliated to An Cumann Lúthchleas Gael in accordance with the rules of the Association in force from time to time.

(c)To achieve these objectives the club shall actively foster and encourage the promotion of the aims of An Cumann Lúthchleas Gael among the juvenile members of the club.

CLUB COLOURS

4The club colours shall be blue and green.

MEMBERSHIP

5The committee of the club shall have power subject to these rules to elect members of the club upon such terms and subject to such regulations as the committee may from time to time deem advisable.

6To be elected to any class of membership of the club an applicant must secure the votes of two-thirds of those present and voting at the meeting of the committee at which his application is considered.

7Each candidate for membership of the club shall be proposed by one and seconded by another registered full member of the club to whom the candidate shall be personally known and who shall be responsible for the candidate's eligibility. The application for membership of every such candidate shall be made in writing, signed by the candidate and by his proposer and seconder and shall be in such form as the committee may from time to time prescribe.

8Every candidate for election for membership shall be balloted for by the committee of the club. The name and address of every candidate and the name of his or her proposer and seconder shall be sent to the secretary in writing and these particulars shall be displayed on the club notice board or in a conspicuous place in the club's premises for at least a week before the meeting of the committee at which their application is to be considered and an interval of not less than two weeks shall elapse between nomination and election of a member.

9Every application for membership shall be accompanied by a remittance to cover the entrance fee, if any, and the appropriate subscription from the date of application to the following 31st. December. In the event of non-election such remittance shall be returned to the candidate.

10(1)All classes of members of the club shall be elected by the committee and subject to the provisions of rule 5 hereof. Such classes shall include :

(a)Full membership of the club shall, subject to compliance with all the provisions of this constitution and rules be open to all persons of 18 years and over, who subscribe to and undertake to further the aims and objects of Cumann Lúthchleas Gael and such full members shall be registered with the county registrar of An Cumann Lúthchleas Gael. A fee as prescribed by the committee shall be payable by each full member. A registered full member who has reached the age of 65 years may be subject to a reduced annual subscription as prescribed by the committee. Members who are spouses/partners or children under 18 years of age of registered full members may be subject to reduced annual subscriptions as prescribed by the committee.

(b)Juvenile membership shall be open to all persons under 18 years of age. An annual fee set by the committee shall be payable by each juvenile member.

(c)Honorary membership shall be open to all persons who have rendered exceptional service to the club or to the games and/or activities of An Cumann Lúthchleas Gael. They may be elected for life or for any defined period but unless otherwise stated in the minute made on the occasion of their election, their membership shall terminate at the close of the year in which they were elected but may be renewed by the committee from year to year. Honorary members shall have all the privileges of full members except otherwise specified by the committee on their election and they shall not be obliged to pay the annual subscription as herein provided for.

(d)Subject to the provisions of rules 6, 7 and 8 hereof such other classes of membership as decided by the committee from time to time. An annual fee set by the committee shall be payable by each member in each such class.

(2)The committee may from time to time prescribe for payment of an entrance fee by new or lapsed members in addition to the annual subscription above.

11Subject to the provisions of these rules every applicant whose application has been approved by the committee and whose subscription for the current year has been paid shall be admitted as a member of the club and shall be entitled to all the rights and be subject to all the duties of a member of his particular class of membership from the date of his admission.

12Except in the case of an honorary member as hereinbefore defined any member whose annual subscription is unpaid on the 1st March, shall cease to be a member of the club and shall forfeit all right in and claim upon the club and its property.

13Subject to the express provisions of these rules and any bye-laws for the time being in force made by the committee of the club as herein provided, all members of the club shall be entitled at all times to use in common all the premises and property of the club and to be supplied, at such charges as the committee shall from time to time determine, with such facilities as are provided by the club for the use of its members.

14In case conduct of any member shall in the opinion of the committee be injurious to the character of the club or objectionable in any respect such member may be required by the committee to resign, and if the member so requested shall not resign within one week, such member shall be expelled by resolution of the committee and cease to be a member of the club and all sums which shall have been paid by such member shall thereupon be forfeited.

15A member expelled under rule 14 shall have the right to appeal by giving written notice of appeal to the secretary within 10 days of the posting of the notice of expulsion. Thereupon an extraordinary general meeting of the registered full members of the club shall be convened within fourteen days and if such meeting shall pass an ordinary resolution rescinding the expulsion then the member shall be reinstated as from the date of such resolution.

16If any member be convicted on indictment of any criminal offence or shall be adjudged a bankrupt, or shall make any composition or arrangement with his or her creditors or being engaged in any profession shall be prohibited by the disciplinary body of that profession from continuing to practice, such member shall ipso facto cease to be a member of the club. Any person so ceasing to be a member may be readmitted to membership by the committee at their discretion.

17Any member wishing to resign his or her membership of the club shall give seven days notice in writing of his or her intention so to do and send to the secretary of the club before 31st. March in any year failing which such member shall be liable to pay the subscription for the next year.

18Any member expelled in accordance with these rules or otherwise ceasing to be a member of the club shall forfeit all rights to or claim upon the club or its property or funds.

19. The rights of a member as such shall be personal and shall not be transferable and shall cease upon his death.

OFFICERS AND COMMITTEE

20The day-to-day affairs of the club shall be managed by a committee consisting of Chairperson, Vice-Chairperson, Secretary, Assistant Secretary, Treasurer, Registrar, Communications Officer, Adult Football Representative, Adult Hurling Representative, Juvenile Games Representative, Ladies Football Representative, Children’s Officer and three ordinary committee members.

21(a)The Chairperson, Vice-Chairperson, Secretary, Assistant Secretary, Treasurer, Registrar, Communications Officer and the three ordinary committee members shall be elected at each Annual General Meeting of the club and subject to rule 22 hereof retiring members of the committee shall be eligible for re-election.

(b)The Adult Football Representative, Adult Hurling Representative, Juvenile Games Representative and Ladies Football Representative shall be appointed annually by the elected committee members, normally on the nomination of the relevant sub-committees, as designated in Rule 28, and shall, on appointment, be co-opted to the club committee.

(c)The Club's delegate to the County Committee shall be appointed by the elected committee members. Delegates to subcommittees of the County Committee shall be appointed by the elected committee members, normally on the nomination of the relevant Club sub-committees as designated in Rule 28. Delegates to the Ladies Football County Committee and subcommittees shall be appointed by the elected committee members, normally on the nomination of the Ladies Football Committee as designated in Rule 28.

(d)The Patron, President and Vice-presidents shall be elected by the registered full members at the annual general meeting, normally on the nomination of the officers.

(e) The Children’s Officer shall be appointed annually, normally on the nomination of the Juvenile Committee. The Children’s Officer will be responsible for the implementation of the Irish Sports Council’s ‘Code of Best Practice for Youth Sport’. The Children’s Officer will be responsible for all child welfare issues within the club and shall report to the committee from time to time and prepare an annual report for the AGM.

22No person shall be eligible to serve as chairman of the club for more than three consecutive years or as secretary or treasurer of the club for more than five consecutive years provided that this provision does not entail the retirement of all three officers at the same time. In such a case, either the secretary or the treasurer, by agreement or, failing that, as nominated by the outgoing chairman, shall be eligible to serve for a further year.

23The committee shall meet periodically together for the despatch of business, adjourn and otherwise regulate their meetings as they think fit. Questions (other than the admission of new members) arising at any meeting shall be decided by a majority of votes. Where there is an equality of votes the chairman shall have a second or casting vote.

24A member of the committee may and the secretary on the requisitions of a member of the committee shall at any time summon a meeting of the committee. If the committee so resolve it shall not be necessary to give notice of a meeting of the committee to any member of the committee who being resident in the State is for the time being absent from the State.

25The committee shall exercise all such powers and do all such things as may be exercised or done by the club save such as are by these rules or by any statute for the time being in force required to be exercised or done by the club in general meeting and may act notwithstanding vacancies.

26The committee shall have power to co-opt any number of registered full members of the club but not exceeding three in any one year, in addition to those specified at rules 21 and 31 hereof, unto the committee if they deem it necessary for the efficient running of the club affairs.

27(1) The club committee shall have power from time to time to make, alter and repeal all such bye-laws as they deem necessary or expedient or convenient for the proper conduct and management of the club and in particular, but not exclusively, they may by such bye-laws regulate:-

(a)The terms and conditions upon which guests, children of members of the club and visitors shall be permitted to use the premises and property of the club;

(b)The times of opening and closing the pavilion grounds and premises of the club or any part thereof;

(c)The conduct of members of the club in relation to one another;

(d)The setting aside of the whole or any part or parts of the club's premises for any particular time or times, or for any particular purpose or purposes;

(e)The imposition of fines for the breach of any byelaw or any of the club's rules.

(f)And generally all such matters as are commonly the subject matter of the club's rules.

(2) The committee shall adapt such means as they deem sufficient to bring to the notice of members of the club all such bye-laws, alterations and repeals and all such bye-laws so long as they shall be in force, shall be binding upon all members of the club provided nevertheless that no bye-laws shall be inconsistent with or shall affect or repeal anything contained in these rules and that any bye-law may be set aside by a special resolution of a general meeting of the club.

28The committee may from time to time delegate any of their powers to such subcommittee or subcommittees consisting of one or more member or members of the club and not necessarily a committee member or a full member as they shall think fit to appoint and in particular the club committee shall delegate to the Adult Football Committee, Adult Hurling Committee, Juvenile Games Committee and Ladies Football Committee which shall consist of the relevant team managers (or mentors) the power to manage and regulate activities for club teams and players and may recall or revoke any such delegation or appointment. Any subcommittee shall in the exercise of the powers so delegated, conform to any regulations that may be prescribed by the club committee. The officers shall be entitled to participate in meetings of any subcommittee of the club.

29(1) The committee shall cause proper Books of Account to be kept in respect of :-

(a)All sums of money received and expended by the club and the matters in respect of which such receipts and expenditures take place;

(b)All sales and purchases of goods by the club;

(c)The assets and liabilities of the club.

(2)The books of accounts shall be kept at such place or places as the committee shall think fit and shall always be open to the inspection of the members of the committee. The committee shall from time to time determine whether and to what extent and at what times and places and under what conditions and regulations the accounts and books of the club or any of them shall be open to inspection of registered full members of the club, not being a committee member and no member (not being a committee member) shall have any right of inspection of any account or book or document of the club except as authorised by the committee.

(3)Once at least in every year the committee shall lay before the registered full membership of the club in general meeting an account of income and expenditure for the period since the preceding account. A Balance Sheet shall be made out in every year and laid before the club in general meeting, made up to a date not more than six months before such meeting. Every such Account and Balance Sheet shall be accompanied by a report of the committee and of the Auditors and the Account, Report and Balance Sheet shall be signed by the chairman and treasurer and countersigned by the secretary.
