SUBJECT:FOOD COMPLAINT SAMPLE NO 37629/G357

Council is advised of a complaint regarding glass fragments allegedly found in a 2 litre bottle of Country Fresh Apple and Orange juice purchased from Bi Lo Supermarket, Woodvale Shopping Centre, Trappers Drive, Woodvale.

The complainant had used most of the contents of the bottle over a two week period for a small child to drink. Drinking directly from the bottle the complainant allegedly had several fragments of glass stuck to his tongue.

Council's Analysts Inman & Farrell have verified that the 2 litre glass container contained several fragments of clear, colourless glass. The container itself was examined and no chips, fractures of delaminations were found. The fragments of glass varied in size from approximately 0.1mm in diameter to 7 x 5 x 1.5mm. The Analyst commented that it is possible that the fragments could have come from a previous flagon that had broken or shattered in the filling line.

Section 246 of the Health Act 1911 states that a person who either prepares for sale or sells a food that is

a)unfit for consumption by man;

b)adulterated; or

c)damaged, deteriorated or perished,

commits an offence.

RECOMMENDATION

That Council in accordance with the provisions of the Health Act 1911 instigates legal proceedings against either of the following:

1the proprietors of Bi Lo Supermarket, Woodvale Shopping Centre, Trappers Drive, Woodvale;

2Country Fresh Australia Pty Ltd;

in regard to food sample 37629/G357.

SUBJECT:FOOD COMPLAINT SAMPLE NO 37631/G392

Council is advised of a complaint regarding foreign matter allegedly baked into a pack of 8 hot cross buns baked by Tip Top Bakeries and sold by Woolworths Supermarket Whitford City Shopping Centre.

Council's Analysts Inman & Farrell have identified the material as rodent faeces measuring approximately 3mm in length and 1mm in diameter. These were embedded in and had been baked onto the bottom surface of the buns.

Section 246 of the Health Act states that a person who either prepares for sale or sells a food that is:

(a)unfit for consumption by man;

(b)adulterated; or

(c)damaged, deteriorated or perished,

commits an offence.

RECOMMENDATION

That Council, in accordance with the provisions of the Health Act 1911 instigates legal proceedings against either of the following:

1Tip Top Bakeries (Canning Vale), a branch of George Weston Foods Ltd;

or

2the proprietors of Woolworths Supermarket, Whitford City Shopping Centre;

in regard to food sample 37631/G392.

Council is advised of a complaint regarding a foreign object which was cooked into a chinese meal by the Choi Sun Chinese Restaurant, Villanova Street, Wanneroo.

Council's Analysts Inman & Farrell have identified the object as a small cockroach.

Section 246L of the Health Act states that a person who either prepares for sale or sells a food that is:

(a)unfit for consumption by man;

(b)adulterated; or

(c)damaged, deteriorated or perished,

commits an offence.

RECOMMENDATION

That Council in accordance with the provisions of the Health Act 1911 instigates legal proceedings against the proprietors of the Choi Sun Chinese Restaurant in regard to food sample 37633.

Council is advised of the results of recent Court cases heard at the Perth Court of Petty Sessions in June 1993.

1Trading in Public Places

Milica Kifer pleaded not guilty to trading contrary to special conditions attached to her licence. The Magistrate found in favour of Council.

Milica Kifer was fined $50.00 with costs of $218.35.

Council's costs in this case amount to $837.20 as the trial lasted a full halfday.

2Eating House Licences

Sam's Super Deli and News, Marangaroo Legal action was withdrawn following full payment of the outstanding licence and registration fee, together with Council legal costs in this matter.

Hillarys Garden Golf The proprietor put forward a plea of mitigation in respect of Council's Eating House fees and whilst the Magistrate did impose fines of $200.00 on each charge he has discretion in respect of costs. In this particular instance the Magistrate specifically exercised his discretion in refusing to make an order for costs.

Council's legal costs amounted to $315.00.

SUBJECT:TRADING IN PUBLIC PLACES MOTHER'S DAY 1993

Council is advised of the results of surveillance by Environmental Health Officers on Mother's Day 8 May 1993 regarding trading in public places as requested at Community Services Committee on 8 June 1993.

A total of seven (7) licences were issued. Surveillance by Environmental Health Officers over that weekend revealed six (6) incidents of trading without the requisite licence.

1Devonway Holdings This matter was considered by Council in June (H40603) with a resolution to instigate legal proceedings.

218 Kingsley Drive, Kingsley Mrs S Jowers was observed selling flowers from within her front yard. She was under a misunderstanding between Wanneroo's Bylaws and her former address in the City of Stirling where such practice occurs. Mrs Jowers paid for a licence to trade in a public place on 20 May 1993.

3Gnangara Road, Landsdale Two young children were found selling flowers from buckets in a parking bay off Gnangara Road. They declined to say who employed them and refused to give their names and addresses and without a vehicle there was no possibility to identify who they were. No action eventuated on this incident due to lack of evidence.

4Gibbs Road, corner of Wanneroo Road Mrs V J Davis of 349 Gibbs road, Nowergup was observed selling flowers form the road verge, but ceased trading when informed of Council's Bylaw. A warning letter was sent to Mrs Davis on 2May 1993.

5Lot 2 (187) Wanneroo Road, Kingsley Mrs A Antulov was observed trading from the verge outside her home. Mrs Antulov stated that she had grown the flowers herself and agreed to shift behind her property line upon request. A warning letter was sent to Mrs Antulov on 26 May 1993.

6Shell Service Station, corner of Marangaroo Drive and Balgonie Avenue, Marangaroo An employee of the Doyle Court Florist, Shop 23 Newpark Shopping Centre, Marangaroo was observed selling flowers from the above service station which abuts the shopping centre. The shopping centre was closed and the florist being an internal tenancy was prevented from trading. This anomaly only exists on Mother's Day. A warning letter was sent to the florist on 26 May 1993 with advice to make suitable arrangements with the centre management for next year.

SUBJECT:SERVICES FOR AGED AND DISABLED ADVISORY COMMITTEE

The function and role of the Services for Aged and Disabled Advisory Committee has recently been reviewed. The reasons for the review is that it is felt the Committee in its present form is not achieving its objectives.

The Committee was originally formed in 1986 to advise on matters relating to services provided by the City of Wanneroo's Home Support Service. Membership comprised of volunteers, community groups, business representation, churches and the Home Support Coordinator. The Committee assisted in the establishment and development of the Home Support Service.

Services for aged and disabled have grown since this time with the introduction of day care, respite programme and the community options programme. In April 1992, the Committee was restructured and renamed Services for Aged and Disabled Advisory Committee. Its objectives were:

.to act as an Advisory Committee to Council on issues relating to aged and disabled;

.to promote the welfare and care of the disadvantaged, the frail aged and disabled in the City of Wanneroo;

The existing members of the Home Support Service Advisory Committee plus new members formed the renamed Committee.

There has been limited progress with this Committee due to memberships ability to offer regular commitment to attend meetings and to put forward, address and action issues that relate to the broad range of services for aged and disabled in the City of Wanneroo.

At the last meeting held on 25 June 1993, the future and role of the Committee was again discussed. The Committee stated that there was a need for a broader base of membership in order for all issues relating to services for aged and disabled to be addressed. A proposal was carried that the Advisory Committee in its present structure be disbanded and a new Committee formed. Service providers, both in community base care and residential, consumers and other interested individuals would be invited to nominate for membership.

It is being proposed therefore that the existing Advisory Committee be disbanded and that new terms of reference be developed to be approved by Council at a later date.

RECOMMENDATION

That Council approves the dissolution of the current Services for Aged and Disabled Advisory Committee.

SUBJECT:SENIORS' WEEK 1993

The annual Seniors' Week is scheduled for 24 October 30 October 1993. Seniors' Week celebrations aim to promote the positive role of seniors in the community and to break down the myths and stereotyping associated with ageing.

The role of Council is usually twofold:

.It supports the seniors organisations in the City of Wanneroo through the Senior Citizens Association by assisting with the coordinating and promotion of activities. The City usually contributes funds of $1,000 to help meet the costs of the Association's activities for the week.

.The Council normally hosts a special function.

The State Government's office of Seniors' Interests has invited the City of Wanneroo to apply for funding on a matched basis for the purpose of holding regional Seniors' Week events. Due to the closing date of 9 July 1993 for these applications, the following submission has been made and its endorsement is requested. A grant of $900 has been requested.

Three projects have been submitted for consideration.

.A competition requesting seniors to write about their perception of being a senior. This project intends to dispel some of the myths about ageing and give seniors an opportunity to state their role in the community.

.A Senior Citizen Award to be given to a senior who has made a contribution to the community. This will be advertised and written nominations invited. This project recognises the valuable contribution that seniors make.

.Choirs from four schools will visit four nursing homes in the City of Wanneroo. Intergenerational activities are important for interaction between seniors and young people. One of the nursing homes has predominantly Italian speaking residents and efforts will be made to match this home with children from an Italian background. The children will share afternoon tea and talk with the residents after their performance.

The following is a breakdown of the budget for the three projects.

RECOMMENDATION

That Council

1)approves a donation of $1,000 to the Wanneroo Senior Citizens Association as a contribution towards the cost of Seniors' Week activities Allocation Number 25760;

2)approves the organisation and promotion of the written competition, Senior Citizen of the Year Award and the visits by school children to nursing homes subject to the receipt of dollar for dollar funding from the Office of Seniors' Interests;

3)approves the expenditure of funds to a maximum of $1,000 to match funding sought from Office of Seniors' Interests to cover the cost of promotion and presentation of a written competition, Senior Citizens of the Year Award and visits by school children to nursing homes, Allocation Number 25760.
