CRIMINAL HISTORY BACKGROUND CHECK

IDAHO DEPARTMENT OF HEALTH & WELFARE

Effective October 1, 2005, all new employees, students, contractors and agents who have direct access to children and vulnerable adults in long term care settings, which includes Home Health and Hospice services, must successfully pass a Department of Health & Welfare Criminal History Background Check prior to providing unsupervised services to clients. Those individuals with Designated and Designated Seven-Year Crimes will be disqualified from employment. BGH will comply with all requirements of criminal history rules IDAPA 16.05.05 and IDAPA 16.05.06.

Designated Crimes - Persons who have been convicted of one of the following crimes will not pass the background check and will be excluded from any program. An exemption is not an option for any Designated Crimes: Abuse, neglect, exploitations of a vulnerable adult; Aggravated, first degree and second-degree arson; Crimes against nature; Forcible sexual penetration by use of a foreign object; Incest; Injury to a child, felony or misdemeanor; Kidnapping; Lewd conduct with a minor; Mayhem; Murder in any degree, voluntary manslaughter; assault or battery with intent to commit a serious felony; Poisoning; Possession of sexually exploitative material; Rape; Robbery; Felony or first degree stalking; Sale or barter of a child; Sexual abuse or exploitation of a child; Any felony punishable by death or life imprisonment; or Attempt, conspiracy accessory after the fact or aiding and abetting to commit any of the Designated Crimes.

Designated Seven-Year Crimes – Persons who have been convicted of one of the following crimes within the past seven years will be excluded from any program. An Exemption review is not an option for any Designated Seven-Year Crime. No exemption will be granted within seven (7) years from the date of conviction for the following crimes: Burglary, grand theft, theft; Forgery or fraudulent use of financial transaction card; Forgery or counterfeiting; Insurance fraud; Public assistance fraud; A felony involving a controlled substance; Attempt, conspiracy accessory after the fact or aiding and abetting to commit any of the Designated Seven-Year Crimes.

If disqualifying items are found that are not one of the designated crimes, Health and Welfare will also notify you and your employer, if any, by mail about your denial status and if there are any options available to you to request an exemption review. Reviews may be on the telephone, or in person.

HOW TO COMPLETE A CRIMINAL HISTORY BACKGROUND CHECK

  1. Go to the Criminal History website at www.chu.dhw.idaho.gov and follow the prompts for Criminal History Background Checks and the Self-Declaration Form.
  1. Complete the Application/Self-declaration form and at the end schedule your fingerprinting appointment on the web. Your application will be assigned a verification number.
  1. On your scheduled day, take your picture ID to the Department of Health and Welfare office where you are scheduled for fingerprinting. The technician will print out your completed self-declaration form and notarize your signature.
  1. Promptly provide Bonner General Hospital, Human Resources with your verification number in order for us to access the web to learn of your clearance status.
  1. If you cannot get to a Health and Welfare office for fingerprinting, you can have this done at your local law enforcement agency (a fee may be charged for their services). Your fingerprints must be rolled on the Health and Welfare applicant fingerprint card, available from BGH Human Resources. When completed mail the card along with your signed and notarized Application/ Self-declaration form to the Criminal History Unit at 823 Park Centre Way, Nampa, ID 83651.

Applicant status will be listed on the DHW criminal history website. Both you and your employer can access the web any time to learn if your application has cleared or not by using your verification number. If any action is taken other than clearance, you and your employer will be notified by mail. It is important that you tell the Criminal History Unit if you move, change or add employers while your application is in process.

The completed fingerprint-based background check may be used for one year for additional or new employers. Employers must verify that a background check is in good standing.

Bonner General Hospital will decide when you can work directly with clients, and some positions may be allowed to provide service at the time of application/self-declaration and fingerprinting. You will be informed of this decision at the time of hire. If you require assistance with the application process, the Human Resources Department will be happy to work with you.
