Cove Landfill of Bad Axe, Inc., Huron County

A Notice of Violation was issued by the DEQ to Cove Landfill of Bad Axe, Inc. (Cove) on September 1, 1999. The DEQ alleged that Cove, doing business at the Cove Landfill of Bad Axe, 4151 South McMillan Road in the City of Bad Axe, Sheridan Township, Huron County, Michigan, was in violation of Part115, Solid Waste Management (Part115), of the Natural Resources and Environmental Protection Act, 1994PA451, as amended (NREPA), MCL324.101 etseq.; MSA13A.11501 etseq., and the administrative rules promulgated under Part115. Specifically, Cove had filled portions of the Disposal Area above approved elevations contrary to the operating license and approved plans, thereby establishing a solid waste disposal area without a construction permit. On October 26, 1999, Cove Landfill of Bad Axe, Inc. and the DEQ entered into a Consent Order to resolve the violations.

Under the terms of the Consent Order, Cove would be required to regrade the overfilled cells to comply with approved elevations, apply interim cover, and document such to the DEQ, complete closure of those areas at final grade unless a new construction permit is issued for a vertical expansion at the facility, and pay $33,500.00 in civil penalties and costs.
