LEGAL ASPECTS OF REAL ESTATE
Catalog Description:
81A – Legal Aspects of Real Estate 3 units
California law as applied to real estate problems; origin and sources of California real estate law; contracts in general; real estate contracts; law of agency and regulation of agents; classification of property; easements; acquisition and transfewr of interests of property; methods and incidents of ownership; land description; recordation. Prerequisite: Real Estate 80. 3 hours.
Prerequisite Skills:
Before entering this course, the student should understand:
1. basic concepts in preparing for entry into the real estate business;
2. the fundamentals of liens and encumbrances, contracts, agencies, contracts of real property, financing of real estate leases, deeds, subdivisions, and other general information and fundamental background as a preparation for entry into other courses in real estate;
3. the principles and practices that both consumers and business people need to apply.
Expected Outcomes for Students:
Upon completion of this course, the student should understand:
1. the law of personal and real property as related to real estate;
2. various ways in which property is acquired and transferred;
3. the historical aspects of real estate law.

2. Historical aspects of land titles in California.
3. Sources of real estate law.
4. Nature and classes of property.
5. Fixtures defined and the applicable rules
6. Definition, classes, and characteristics of easements.
7. Nature and classification of estates or interests.
8. Acquisition and transfer of property.
9. Methods and incidents of ownership.
10. Land: descriptions, surveys, subdivision.
11. Recording and constructive notices.
