NOTICE TO CONTRACTORS

The County of Sagadahoc is accepting sealed bids from qualified contractors for a siding replacement project. The purpose of the project is to replace existing clapboard and shutters with vinyl siding and shutters. The project is located at the Sagadahoc County Administration Building, 33 Court Street, Bath, Maine 04530.

SCOPE OF PROJECT

Sealed bids for:

1.) The removal and disposal of all existing clapboards and shutters. As testing confirmed the presence of lead paint, any boards removed must be taken to the landfill or placed in an on-site dumpster daily. Plastic must be laid around the house to collect any paint chips, which will be placed in plastic bags for disposal. Disposal of all materials will be made at the Bath Landfill.

2.) Installation of Tyvek on the building and repair/replacement of sheathing as required.

3.) Installation of 0.42/0.43 thickness vinyl siding on a 2.5 story house approximately 25’ x 30’ and adjoining structure approximately 19’ x 25’.* Color to be selected by County.

4.) Replacing existing shutters with mid-grade vinyl shutters on fifteen windows (1 @ 38”; 5 @ 52”; 3 @ 70”; 6 @ 60”). * Color to be selected by County.

5.) Wrap all trim around windows, upper trim soffit, fascia, etc., with aluminum and install vinyl corner boards and PVC boards as needed.

*NOTE: These dimensions are approximate. It will be the responsibility of the contractor to obtain exact measurements.

A MANDATORY pre-bid meeting and site inspection will be held at the Administration Building at 10:00 a.m. on Tuesday, May 26, 2015.

Bids will be received by the County of Sagadahoc, Maine at the Administrative Building until 2:00 p.m. on Monday, June 1, 2015, at which time they will be publicly opened and read aloud.

BID SPECIFICATIONS

1.ALL BIDS SHOULD BE SUBMITTED ON THE ATTACHED “BID SHEET” and must include the following information:

a.) Bid amount;

b.) Contact name, company name and mailing address of bidder;

c.) Daytime, home and fax telephone numbers of bidder;

d.) Date available to commence work.

2.All bids must be placed in a sealed envelope labeled “Sagadahoc County Siding Replacement Project”, ATTN: County Administrator. The mailing address is 752 High Street, Bath, Maine 04530. If hand delivered, the bids should be taken to the Administration Building, 33 Court Street, Bath, Maine 04530. All bids must be received by 2:00 p.m. on Monday, June 1, 2015.

3.Any deviations from the specifications included in the bid packet must be explained on the bid sheet.

4.The successful bidder shall furnish a current Certificate of Insurance naming the County of Sagadahoc as an additional insured.

5. The minimum acceptable manufacturer’s warranty is standard limited lifetime for defects in materials and workmanship. The terms of the warranty offered by the manufacturer of the siding and shutters to be installed by the bidder must be included on the Bid Sheet.

6. The County reserves the right to waive any informalities in proposals, to accept a proposal of section(s) of the proposal, to negotiate a revised scope of services and/or fees, and to reject any or all proposals, or portions thereof, should it be deemed in the best interest of the County to do so. No proposal may be withdrawn for a period of sixty (60) days after the submission deadline. In the event of any doubt or difference of opinion as to the items to be furnished under the request for proposal, the decision of the County shall be final and binding on all parties.

7.The successful bidder must be available to commence work within two (2) weeks of the date of contract award unless an extension is granted by the County.

8.All materials and labor required to complete the work, including the disposal of the existing clapboard, shall be supplied by the Contractor. The cost and expense of all necessary labor, tools and equipment required to complete the project shall be included in the bid price.

SIDING REPLACEMENT PROJECT

BID SHEET

The undersigned bidder proposes and agrees to the following:

1.) The successful bidder has carefully examined the location of the proposed work, the proposed Contract Form (and the Contract Documents therein referred to), and that he/she proposes and agrees, if this Bid is accepted, that he/she will contract with the County of Sagadahoc to provide all machinery, tools , labor, equipment and other means of construction and to do all the work and to furnish all the materials to complete the work in the manner and time therein prescribed, in accordance with the conditions and requirements set forth in the Contract Documents;

2.)After notification of the acceptance of the bid and the readiness of the Contract for signature, the successful bidder will execute the contract within ten (10) days, Saturdays, Sundays and holidays excepted, and that the successful bidder will commence work within two (2) weeks of the date of Contract award unless an extension is granted by the County.

CONTRACT

Installation of Siding and Shutters at 33 Court Street, Bath, Maine

This Agreement, made and entered into the ______day of ______in the year Two Thousand Fifteen, by and between the County of Sagadahoc, a municipal corporation existing under the laws of the State of Maine, hereinafter called the “County” and ______herein after called the “Contractor”.

WITNESS

That the County and the Contractor for the consideration hereinafter named agree as follows:

Article 1. Scope of Work

  • The Contractor shall furnish all of the Materials, Labor, Tools and Transportation and perform all the work described in the Specifications, Scope of Project [and Scope of Project Addendum dated ______], and in the Contractor’s Bid Proposal, and shall do everything required by this Agreement.
  • The Contractor agrees to commence work within two (2) weeks of the execution of this contract.
  • Non-withstanding, and/or in addition to, any manufacturer’s warranty, the Contractor will guarantee all work for a period of two (2) years from the final completion date.
  • The Contractor shall provide a Certificate of Insurance naming Sagadahoc County as an additional insured at the time the contract is executed.

Article 2. Time of Completion

The installation shall be completed according to the following schedule:

  • Work shall commence within two (2) weeks from the execution of this contract, unless an extension is granted by the County.
  • Final Completion shall occur within two (2) weeks from the commencement of the work, unless an extension is granted by the County.

Article 3. The Contract Sum

The County shall pay the Contractor for the performance of the Contract as follows:

The County shall pay 100% of the contract cost after final inspection and quality assurance review by the Sagadahoc County Maintenance Supervisor and a determination that the work is completed to the satisfaction of the County Administrator.

Article 5. The Contract Documents

The General Conditions of the Contract, Bid Documents/Specifications/[Addendum], and Bidder’s Proposal together with this Agreement, form the Contract.

The County and the Contractor hereby agree to the full performance of the covenants herein.

GENERAL CONDITONS OF THE CONTRACT

Article 1. Definitions

Wherever the following terms are used in the contract document, the intent and meaning shall be as follows:

Contract Documents – The documents, which are comprised of the Bid Proposal, excluding Option 1, instructions for Bidder, Contract Agreement, General Conditions of the Contract, Scope of Work, [and Addendum dated ______]. They are also known as “the Contract”.

Final Completion – the condition where final inspection and quality assurance review by the Sagadahoc County Maintenance Supervisor is successful and work is completed to the satisfaction of the County Administrator.

County – The County of Sagadahoc, acting through its authorized representative.

Installation – The entire work to be performed under the contract.

Article 2. Intent and Correlation of the Contract Documents:

It is the intent of the contract documents to describe a complete installation. The Contractor shall furnish all Labor, Materials, Tools, Transportation, Insurance and Incidentals which are reasonably required to construct and complete the installation.

Should error, omissions, or inconsistencies or differing site conditions be discovered after contract award, the Contractor shall notify the County promptly and affected work suspended until a resolution is found. In the event there is a conflict between requirements of the installation and specifications, the more stringent requirement will be followed.

Article 3. Permits, Laws and Regulations

It is the responsibility of the Contractor to comply with all laws, regulations, and permit conditions in completing the installation, including safety regulations. If the Contract actor discovers that they contract documents conflict with any laws, regulations, or permit conditions, the Contractor shall promptly notify the County. In addition, if the Contractor’s proposal methods require it, it shall be the Contractor’s responsibility to obtain any variances or permit modifications requires.

Article 4. Changes in Scope of Work

The County may request changes, increases, or decreases of the installation without invalidating the original agreement. Any changes involving a change in the contract price or installation schedule must be authorized by a change order executed by the Contractor and County Administrator.

If the Contractor, in performing the installation, discovers conditions which could not reasonably have been anticipated from the site visit, inspection of the site and examination of the contract documents, the Contractor shall notify the County promptly and a change order shall be negotiated before the installation proceeds further.

Article 5. Contract Termination.

Should the Contractor fail to complete the installation with the time frame specified in the contract or in any time extension change order, the County may, after giving written notice to the Contractor, terminate the contract and arrange for the installation to be completed by others. The cost of any uncompleted work shall be deducted from the agreed upon contract amount.

Article 6. Payments

The County shall pay 100% of the contract cost after final inspection and quality assurance review by the Sagadahoc County Maintenance Supervisor and a determination that the work is completed to the satisfaction of the County Administrator. The making and acceptance of final payment shall constitute a waiver of all claims under the one year warranty, and all claims by the Contractor, except those previously made and unsettled.

Article 7. Contractor’s Insurance

The Contractor shall maintain in force for the duration of the installation Public Liability and Property Damage insurance that shall protect the Contractor from claims and damages arising from operation under this Contract Agreement. The minimum amount of coverage shall be as is customary for the work to be performed and shall provide complete indemnification of the County for the Contractors’ work. In addition, Workers Compensation shall be maintained by the Contractor as required by Maine Law. A copy of the Certificate of Insurance shall be furnished no later than the date of the Contract Agreement.

Article 8. Warranty

Non withstanding, and/or in addition to, any other manufacturer’s or contractor’s warranties cited in the contract documents, the Contractor shall warranty all work performed under the contract against defects in workmanship and materials for a period of two years from the date of final completion. During the warrantee period, the Contractor shall promptly repair all such defects at no cost to the County.

Article 9. Disputes

Disputes between the County and Contractor which cannot be resolved shall be settled by litigation.
