ALCOHOL BEVERAGE PERMIT

This permit issued by the Town of Niagara Town Board authorizing the organization orpersons (as per the attached facility use permit) to bring and consume alcoholicbeverages at the Town Park at 7000 Lockport Road, Niagara Falls, NY.

This permit is issued subject to the following terms and conditions:

1.The applicant assumes all risks related to this permit and shall be solelyresponsible and answerable in damages for all accidents or injuries to persons orproperty, and hereby covenants and agrees to defend, indemnify and hold harmless theTown of Niagara, the Town Board and their officers, agents, servants and employees from any andall claims whether direct or indirect, arising out of the operation of this permit, orthe carelessness, negligence or conduct of the applicant or anyofficer, servant, agent or employee thereof.

2.The Town of Niagara shall not be held responsible for property damage orpersonal injury to the applicant or any person upon the premises at the invitationof the applicant.

3.The applicant is responsible for cleaning the premises and leaving it in the samecondition as it was at the time of occupancy, and shall be responsible forreimbursing the Town of Niagara for any unusual cleaning expense incurred orfor any damage caused by the applicant or any persons on the premises at theinvitation of the applicant.

4.The applicant or any persons upon the premises at the invitation of the applicantshall abide by all Park rules and regulations as well as applicable State andFederal Laws.

5.Amplification of music or other sounds is not permitted.

6.The applicant hereby waives any and all claims for compensation for any and allloss or damage sustained by reason of any interference by any public agency orofficial in the operation of this permit; any such interference shall not relieve theapplicant from any obligations hereunder.

7.Beer balls, kegs or wine balls are prohibited and the Town of Niagara reservesthe right to limit the amount of alcohol allowed.

8.The Town of Niagara reserves the right to revoke this permit at any time and for any reason and tomonitor compliance. Noncompliance may result in immediate revocation and eviction fromthe park.

9.The applicant must be 21 years or older at the time of application. Possession orconsumption of alcohol by anyone under the age of 21 years is illegal and can because for the revocation of this permit. The Town of Niagara parks staffreserves the right to require proof of age from the applicant or any other personsin the company of the applicant.

I AGREE AND ACCEPT THE RESPONSIBILITY FOR COMPLIANCE WITH THISPERMIT AND AGREE TO BE IN ATTENDANCE FOR THE ENTIRE PERMIT PERIOD.
