MINUTES of the MEETING of SILKSTONE PARISH COUNCIL held on Monday 3 September2012 at 6.45pm at Silkstone Sports Pavilion.

PRESENT

Chairman: Cllr R Leech

Councillors: R Brocklehurst,J Charlesworth, Mrs P Gallamore, P Handley, P Smith and R Stier.

In attendance: 4 residentsand the Clerk

PUBLIC QUESTION TIME

A resident advised that a gully on Ben Bank Road is blocked. It is just after the wood heading towards Dodworth. The Clerk will report to Highways.

A resident asked if the Bus stop on High street/Martin Croft could be marked out. The Clerk will contact SYPTE to enquire.

A resident asked when the noticeboard on Hillside would be completed. Cllr Stier advised that the handyman will be completing work to the sign over the next few weeks.

A resident asked about the situation with the Bowling Club and Silkstone Lodge. This subject has been discussed at length at previous meetings. Cllr Handley reiterated the Parish Council’s involvement with the Bowling Club in accordance with the statement made at the last Parish Council meeting. Extract of 2 July 2012 Parish Council meeting follows for information:

A resident asked if the Parish Council can offer positive support to the Bowling club to bring them back to the village. The Chairman advised that the bowling green is privately owned; therefore any agreement is between the land owner and the bowling club and does not involve the Parish Council. The Parish Council has been fully supportive of the Bowling Club by offering them advice through the link councilor scheme and giving them an annual grant whilst the club was in the Parish.

A resident advised that the street light at the bottom of Cone Lane cannot be seen due to the overgrown trees. The Clerk will advise the street lighting department at Barnsley MBC.

A resident complained about the amount of dog mess on the Silkstone Recreation Ground. Cllr Stier advised that the issue has already been reported to the Barnsley MBC dog warden again. An article will again be included within the next newsletter.

Cllr Gallamore advised that the Local Development Framework document Development Sites and Places consultation has a deadline of 28 September 12 for comments.

12-076 APOLOGIES

RESOLVED to accept apologies from Cllrs D Liddell and Mrs M Liddell.

12-077 DECLARATIONS OF INTEREST

RESOLVED to note Cllr Stier’s declaration of a prejudicial interest in the payment to the Parish Council’s handyman under agenda item 25 (this item was approved on mass with other payments).

12-078 STOCKS AREA

RESOLVED to note that the Roggins group has been promised £1,800 from the community support fund. The Parish Council approves the expenditure of £500 to match fund the £500 from the Millennium Committee. The boundary stones group has also committed £200 to the project. This gives a total of £3,000 which means a shortfall of £600 for the preferred lamp standard design.

RESOLVED that Jim Ritchie will speak to Martin Keeling to discuss what style of light could be installed within a £3,000 budget. The Clerk will contact Cllr John Wilson for his input, the Clerk will also contact the land registry to obtain a possessory title document for the Stocks area. The Stocks area will be discussed again at the next meeting.

12-079 MINUTES

Silkstone Parish Council - RESOLVED to approve the minutes of the Parish Council meeting held on Monday 2 July 12 as a true and accurate record. The Chairman signed the minutes.

Matters arising from the minutes and not on this agenda:

Cllr Stier advised that the trees overhanging the Beck towards the terraced houses on Cone Lane have been cut back.

The Clerk advised that Berneslai homes have given their approval for the Parish Council to replace the bench on Martin croft, Silkstone.

The Clerk advised that Tom Horsfield has advised that works will be carried out on the Beck at Pot House Hamlet during September by the coal authority.

The Barnsley Judo Club will start 4 weeks of Judo classes at the Silkstone Common Methodist Church on 14th September.

Silkstone Playing Fields Committee - RESOLVED to note the minutes of the Silkstone Playing Fields Committee meeting held on Monday 16 July 12.

PLANNING

12-080 PLANNING APPLICATIONS FROM BARNSLEY METROPOLITAN BOROUGH COUNCIL (BARNSLEY MBC)

RESOLVED to note that there are No comments on the following planning applications:

108 Towngate – Erection of a single storey front and rear extension to dwelling – 080812 – No comment from Silkstone Parish Council e-mailed to BMBC under Clerk’s delegated powers following consultation with Cllrs D Liddell, PSmith and PGallamore from the planning committee.

39 Hall Royd Walk – Erection of two storey side/rear extension and single storey front and rear extension.

POLICY

12-081 PARISH CLERK’S ANNUAL APPRAISAL

RESOLVED to note the Parish Clerk’s appraisal has been completed satisfactorily.

12-082 PARISH COUNCIL COMPUTER HARDWARE AND BACKUP

RESOLVED that the Clerk and Cllr Leech will procure a new office computer and external hard drive for back up with Parish Council approval to spend up to £550.

12-083 CONSULTATION ON PAYMENTS BY PARISH COUNCIL’S

RESOLVED that Silkstone Parish Council support the proposal to repeal the two signature rule found in Local Government Act 1972 s150 (5). The Clerk will fill in the consultation paper which relates to the legislative reform order.

12-084 PARISH PLAN POLL

RESOLVED to note that only 4 responses on the Parish Plan poll have been received so far. The Clerk is still to collect boxes from The Ring O Bells and Red Lion. Parish Council concluded that residents of the Parish had been given the opportunity to engage, since there is no commitment from residents for the Parish Council to produce a new Parish Plan, no Plan will be produced.

FURTHER RESOLVED that members will give some thought to the production of a Business Plan/Action plan for the next few years. This will be discussed as an agenda item at the next meeting.

12-085 BARNSLEY MBC – PARISH & TOWN COUNCIL CHARTER

RESOLVED to note the updated Parish & Town Council Charter with Barnsley MBC.

FURTHER RESOLVED that the Clerk will request the dates of Area Delivery panel meetings which have been previously promised by BMBC but not received.

12-086 NALC’s TEMPLATE CODE OF CONDUCT FOR PARISH COUNCILS

RESOLVED to adopt the updated NALC template Code of Conduct for Parish Councils.

12-087 INSURANCE RENEWAL & ASSET REGISTER

RESOLVED to note that the Chairman, Vice- Chairman and Clerk will be meeting with the insurance company later in September to discuss the Parish Council’s level of cover and asset register. The insurance renewal date is 1 October 12.

12-088 REGISTER OF INTERESTS

RESOLVED that the Parish Council will only include statements on their website about Parish Councilors’ interests and not scanned copies of the actual signed forms. Cllr Charlesworth will forward his register of interests to Barnsley MBC as soon as possible.

ENVIRONMENT

12-089 HALL ROYD LANE WOOD

RESOLVED that the Clerk will chase the letter of support from the CARE group which it is understood may have been sent to the wrong e-mail address. Members approved the Clerk’s report for forwarding to Barnsley MBC.

FURTHER RESOLVED that should Barnsley MBC agree to this land transfer, the Parish Council will deal with the legal paperwork rather than appointing a solicitor.

12-090 WOODLANDS INSPECTIONS

RESOLVED that the Clerk will check with the insurance company what their requirements are for the inspection of woodlands open to the public in relation to public liability.

12-091 HUSKAR MEMORIAL, KNABBS WOOD

RESOLVED that the Parish Council will not formally accept responsibility for this memorial since it is in a Woodland Trust wood. The handyman will informally inspect the memorial occasionally and carry out any necessary repairsfollowing the approval of the Woodland Trust. Cllr Gallamore advised that CARE will also add the area to their list for a tidy up.

12-092 CARE

Cllr Gallamore reported on CARE’s meeting on 20 August 12. Unfortunately no one has agreed to take over as Chair or Secretary so for the time being all members are sharing the administrative tasks.

RESOLVED to note that CARE will be holding an open day for any interested residents to litter pick and do bulb planting. The dates for the year will be included in the newsletter.

RESOLVED that the Clerk will contact Colin Bower to ask him to resend the letter of support for the Hall Royd Lane wood which was sent to the Clerk’s old e-mail address.

12-093 SHINDIG FESTIVAL AT SILVERWOOD AUGUST 2012

RESOLVED to note that Cllr Leech attended part of the Shindig Festival and advised that it was very well organized but not at all well attended. Parish Council received no complaints from residents about the event.

12-094 CRIME FIGURES

RESOLVED to note that crime figures were not available for the meeting.

RESOLVED to suspend standing orders.

RESOLVED to note that Mr Fieldsend attended the last PACT meeting and has handed a copy of the minutes to the Clerk. He advised Councilors that an underage alcohol sales test was carried out by Police at the Silkstone Co-op and they passed. Mr Fieldsend advised that residents should be aware that there is a spate of thefts from diesel cars where the tanks are being siphoned.

RESOLVED to reinstate standing orders.

12-095 SILKSTONE RECREATION GROUND

  1. Rock in the Rec 2012

RESOLVED to note the report from the Rockin the Rec organisers. Members agreed this was a fair and honest report. It has been agreed that the event will finish at midnight next year should the Football Club be successful in obtaining a license from Barnsley MBC.

RESOLVED to note that the Clerk is progressing this matter through the Parish Council’s solicitor.

  1. MUGA

RESOLVED to note that Tom Markham has left Barnsley MBC so the Clerk will contact his replacement with regard to the weeds growing through the tarmac of the MUGA.

  1. Sight Screens

RESOLVED that the Parish Council do not give their consent to the Cricket Club’s proposal to erect a permanent framework for Sight screens onto the Pavilion. The cricket club will be asked to consider an alternative and report back to Parish Council. The objections to this proposal include: proposed framework will hinder access to the roof and gutter for maintenance and repair, could be used for climbing onto the roof, will block the steps, be troublesome for grass cutting around the posts.Structure will spoil the visual amenity of the Pavilion.

FINANCE

12-096 EXTERNAL AUDIT FOR THE YEAR ENDED 31 MARCH 2012

RESOLVED to approve the external audit for the year ended 31 March 2012 which has been returned from the External Auditor with no comments.

12-097 RECLAMATION OF VAT

RESOLVED to note the information from the YLCA relating to the reclamation of VAT which states that a Parish Council must not receive any reimbursement in any shape or form be it monetary,full, partial or in kind.

12-098 BANK RECONCILIATION

RESOLVED to approve the Bank Reconciliation for the period 1 April 2012 to 30 June 2012.

12-099 BUDGET MONITOR

RESOLVED to approve the Budget monitor for the period 1 April 2012 to 30 June 2012.

12-101 MEETINGS

RESOLVED to note that Cllr Gallamore had attended a CARE meeting and Cllr Stier had attended the paramount cinema meeting and reported that the cinema has now gone digital. He also attended a PACT meeting and reported that charity bag vans have been picking up donation bags belonging to other charities and that ‘peg sellers’ are working their way round and have been in Thurgoland and Oxspring.

RESOLVED that Silkstone Parish Council are disappointed that Barnsley MBC did not advise them that works were to commence to re-surface Beech ave, Silkstone Common, the Clerk is asked to advise Barnsley MBC that the Parish Council were not notified which is against the spirit of the Barnsley MBC & Parish Councils charter.
