MINUTES OF DEVELOPMENT CONTROL COMMITTEE MEETING – 5TH SEPTEMBER 2005

1. DECLARATIONS OF INTEREST

Councillor Harrison declared a prejudicial interest in regards to application number 05/0424, 117-123 Talbot Road. The nature of the interest being that he lived in the area. Councillor Harrison left the meeting for the duration of this item.

Councillor Harrison did not take any part in the decisions or voting regarding applications EC05/8095, 111 Buchanan Street; EC05/8233, 47 Beech Avenue; 05/0549, 307 Dickson Road and 05/0668, 39 Lauderdale avenue, as he had been unable to attend the site visits.

2. MINUTES, 15th AUGUST 2005 - PAPERS ’A’ AND ’B’

The minutes of the meetings held on 15th August 2005 were signed by the Chairman as a correct record.

3. PLANNING/ENFORCEMENT APPEALS LODGED/DETERMINED

Resolved: To note the Planning/Enforcement Appeals lodged and determined.

4. BREACH OF PLANNING CONTROL - WITHOUT PLANNING PERMISSION THE MATERIAL CHANGE OF USE OF THE FIRST FLOOR PREMISES FROM A WAREHOUSE / STORAGE UNIT TO A PRIVATE CLUB AT 111 BUCHANAN STREET - EC05/8095

The Acting Head, Development and Building Control reported that further information had come to light and requested that the Committee consider deferment to allow consideration thereof.

Resolved: To defer the decision to allow the Acting Head, Development and Building Control to consider further information.

5. BREACH OF PLANNING CONTROL - USE OF PREMISES AS TWO SELF-CONTAINED PERMANENT FLATS AT 15 CAVENDISH ROAD - EC05/8141

The Acting Head, Development and Building Control reported that a fax had been received from the owner’s solicitors regarding a certificate of lawfulness. The Acting Head, Development and Building Control advised that agreeing the enforcement would not stop the owner submitting the certificate of lawfulness application.

Resolved: To authorise the Acting Head, Development and Building Control to issue an appropriate enforcement notice for the cessation of use of the premises as two self-contained permanent flats. The period of compliance to be three months.

7. BREACH OF PLANNING CONTROL - ERECTION OF BOUNDARY WALL INCORPORATING BRICK PILLARS AND TIMBER PANEL INSERTS ADJACENT TO A HIGHWAY EXCEEDING ONE METRE IN HEIGHT AT 47 BEECH AVENUE - EC05/8233

The Acting Head, Development and Building Control reported that a letter had been received from the owner, stating that the fence had been erected to provide a safe and secure environment for her four children, two of whom were disabled, and to protect them from a known paedophile in the area. The Acting Head, Development and Building Control, advised on the strength of the letter that the steps to be taken under enforcement be amended, for a partial removal of the fence.

Resolved: To authorise the Acting Head, Development and Building Control to issue an appropriate enforcement notice requiring the reduction of those parts of the wall, pillars and timber panels in front of the building line facing Beech Avenue, to a height not exceeding one metre. The period of compliance to be one month.

8. PLANNING APPLICATIONS

Resolved: That the decisions on the planning applications now submitted be as detailed in the Appendix to these minutes.

9. 117-123 TALBOT ROAD - APPLICATION 05/0424

The Committee considered application 05/0424 for the erection of a part four / part five storey residential development fronting Talbot Road consisting of 33 apartments with balconies and upper level walkways, and 4 apartments within a detached two storey building fronting St Anthony’s Place with associated access, car parking facilities and landscaping.

The Acting Head of Development and Building Control reported that slight amendments had been made to conditions 3, 5, 11 and 15.

Resolved: (1) To agree, in principle, to application 05/0424 for the erection of a part four / part five storey residential development fronting Talbot Road consisting of 33 apartments with balconies and upper level walkways, and 4 apartments within a detached two storey building fronting St Anthony’s Place with associated access, car parking facilities and landscaping; and

(2) To authorise the Acting Head, Development and Building Control to determine the application, subject to the receipt of the commuted sum of £26, 316.

Reasons for the Decision, Subject to the Above:

The application has been considered in relation to policies H7, TR1, TR6 and E13 of the Blackpool Borough Local Plan and policies HN5, HN7, HN9, LQ1, LQ2, LQ3, LQ4, BH3, BH10 and AS1 of the revised deposit draft edition Borough Local Plan 2001-2016, and the Council’s October 2004 policy for the release of land for housing development in Blackpool. It is considered to be in accordance with those policies and there are no other material considerations that weigh sufficiently against the proposal such as to warrant refusal.

10. 307 DICKSON ROAD - APPLICATION 05/0549

The Committee considered application 05/0549 for the erection of an extraction flue and external staircase to rear and use of the ground floor of the premises as a hot food takeaway.

Mrs Poland addressed the Committee and spoke against the application.

Resolved: That the application be approved, subject to the conditions detailed in the Appendix to these minutes.

11. 39 LAUDERDALE AVENUE - APPLICATION 05/0668

The Committee considered application 05/0668 for the erection of a two storey side extension and dormer to rear.

The Acting Head, Development and Building Control reported that the amended plans referred to in the report had been received.

Resolved: That the application be approved, subject to the conditions detailed in the Appendix to these minutes.
