Citywide Sanitary Sewer Improvement, Group 3 - Model 22 – Citron Street and Vermont Avenue

RECOMMENDATION:

That the City Council, by Motion, award the contract to the lowest responsible bidder, Garcia Juarez Construction, Inc., Contractor’s License No. 848401, Classifications A, in the amount of $586,941.00; and authorize the Finance Director to execute the Escrow Agreement (mandated by Section 22300 of the Public Contracting Code) pertaining to contract retentions.

DISCUSSION:

Twenty-six companies acquired the plans, specifications and bid proposals. The bid was held on Thursday, September 4, 2008, with the following result:

1. Garcia Juarez Construction, Inc. $586,941.00

2. SRD Engineering, Inc. $815,250.00

3. Nikola Corporation $824,331.00

4. Southern California Pipeline $1,058,076.00

5. VCI Telecom, Inc. $1,083,441.00

6. Paulus Engineering $1,090,663.00

7. Vasilj, Inc. $1,095,793.00

8. MNR Construction, Inc. $1,156,109.00

9. Ramona, Inc. $1,163,928.86

10. Zondiros Corporation $1,198,971.00

11. Charles King Co., Inc. $1,393,376.00

The work to be done consists of excavation, removal and/or abandonment in place of existing sewer facilities, installation of vitrified clay pipe (VCP), asphalt concrete

repairs to existing public improvements and all appurtenant work as shown on the plans and delineated in the specifications. This sewer improvement project is part of the Citywide Sanitary Sewer Improvement Program/Projects (CSSIPP) to relieve existing city sanitary sewer needs as identified in the Combined Central Anaheim Area Master Plan of Sanitary Sewers adopted by the Anaheim City Council on December 12, 2006 by Resolution No. 2006-255.

The bid price is below the Engineer’s estimate, reflects the current bidding environment, appears to be reasonable and is within the available funding.

On September 15, 2008, staff received a letter from the Center for Contract Compliance (the “Center”) protesting the award of the “Citywide Sanitary Sewer Improvement Project, Group3 - Citron Street (from South Street to Vermont Avenue), and Vermont Avenue (from Citron Street to Hampshire Avenue)” (the “Project”) to Garcia Juarez Construction, Inc. (“Garcia”). On September 26, 2008, Garcia provided a response to the Center’s letter. After reviewing Garcia’s response to the Center’s allegations and taking into consideration Garcia’s past performance on several different City capital improvement projects, staff has determined that Garcia has met all the requirements of the solicitation to perform the Project and is the lowest responsible bidder for the Project. Therefore, staff in collaboration with the City Attorney’s Office, recommends that the Project be awarded to Garcia.

Liquidated damages for this project shall be $1,700.00 per day.

IMPACT ON BUDGET:

There is no impact on the General Fund. Sufficient funds are available in the Sanitation Debt Service Fund (591).
