AGREEMENT FOR ACQUISITION OF REAL PROPERTY FOR THE BROOKHURST STREET WIDENING FROM BALL ROAD TO KATELLA AVENUE PROJECT

RECOMMENDATION:

That the City Council, by Motion, approve the Acquisition Agreement for the purchase of real property located at 1636 South Brookhurst Street, authorize the Mayor and City Clerk to execute the Agreement and authorize the acquisition payment of $348,000 to Mathew and Dolores Biazevich.

DISCUSSION:

The Department of Public Works is in the process of acquiring right-of-way along BrookhurstStreet for the Brookhurst Street Widening from Ball Road to Katella Avenue Project. The property located at 1636 South Brookhurst Street is being acquired for this project.

Brookhurst Street serves as a north/south arterial street, and is classified as a “Primary Arterial” from the south city limits to the north city limits. The project proposes to widen BrookhurstStreet from a four lane facility to a six lane facility, including three northbound through lanes and two southbound through lanes transitioning to three southbound through lanes midway between Chanticleer Road and Cerritos Avenue. The project will accommodate bikeways, sidewalks, curb and gutter, rubberized asphalt overlay pavement, traffic signal improvements, landscaping of raised medians and parkways, drainage system improvements, and a wide greenbelt meandering sidewalk on the east side of Brookhurst Street between Forrest Lane and Harriet Lane. This segment of Brookhurst Street is the only segment between Interstate 5 and Pacific Coast Highway that has not been widened to six lanes.

The purpose of the proposed improvements is to more effectively accommodate existing and future traffic volumes along Brookhurst Street, bring it into compliance with the City’s General Plan and the County of Orange Master Plan of Arterial Highways, enhance the corridor’s aesthetics, and improve vehicular safety along the project corridor through construction of landscaped medians to limit cross traffic along Brookhurst Street. The project is in conformance with the Initial Study and Mitigated Negative Declaration Report, previously approved by CityCouncil on June 22, 2010, for the Brookhurst Street Widening from Ball Road to KatellaAvenue project.

The property owners have agreed to the purchase price of $348,000. The amount of the purchase price is based on fair market value.

IMPACT ON BUDGET:

There is no impact on the General Fund. Funds have been allocated in the Capital Improvement Program Account Number 281412K891-9501 for FY 2010/11. Funding has been provided by the County of Orange Proposition 1B and OCTA MPAH (Master Plan of Arterial Highways) and GMA (Growth Management Area) funds.
